    ***A Legendary Journey Dealing with Invisible Injuries and PTSD Service Dogs*** What is a service dog? You have probably heard the terms service dog and assistance dog before, but do you know what these terms truly mean? Generally speaking, a service dog or assistance dog is a working dog specially trained to help a person or group of people with a disability or specific needs. Under the ADA, service dogs cannot be denied entrance to businesses, even food service establishments, state and local government facilities or nonprofit organizations that serve the public. However, service dogs must be under control at all times. This generally means they should be leashed or harnessed—unless these get in the way of the dog's duties, in which case the dog must still be under the handler's control. Eligibility for a Service Dog If you are a veteran or first responder who is interested in applying for a service dog, please review the following information to determine if you meet our eligibility requirements.

    ***Back Pain, What you need to know to maximize your VA disability rating!*** How are VA claims for back pain rated? Many veterans suffer from various back conditions due to their active duty military service and perhaps you’re wondering if you can get VA disability for back pain. Generally, VA disability ratings for back pain range from 10% to 100% and depend upon the frequency, severity, and duration of symptoms, including Painful Motion, Limitation of Range of Motion (ROM), and Functional Loss or Impairment. What is the “Limitation of Range of Motion” for VA disability for back pain? The limitation of the range of motion principle is arguably the most important principle that applies to VA disability ratings for back pain.

    Why? Because the general rating formula for diseases and injuries of the spine talk about “flexion,” which is the act of flexing or bending. Any limitation of Range of Motion (ROM) should be measured with a Goniometer by the medical professional at your VA C&P Exam for Back Pain. You must be open, honest, and truthful at your C&P exam for back pain, and make sure to STOP the C&P examiner as soon as you feel any pain. If you can’t move at all without pain, make sure to let the examiner know that. Can I be rated for more than one VA disability for the back? In some situations, you can be rated for more than one disability condition for your back that causes different levels of impairment and is clearly separately rated conditions. For example, you may have a 50% VA rating for your back due to unfavorable ankylosis of the entire thoracolumbar spine.

    What are the steps for the appeals process? The VA has updated its appeals system. As of February 19, 2019, you have the option of having your first-time claim or a supplemental claim reviewed without filing an appeal with the Board of Appeals. In the new appeal system if you disagree with a decision, you have the following options: * Decision Review Request: Supplemental Claim (VA Form 20-0995) * Decision Review Request: Higher-Level Review (VA Form 20-0996) * Decision Review Request: Board Appeal (VA Form 10182)

    *** VA Disability Claims for Plantar Fasciitis*** In 2020, Plantar Fasciitis VA ratings range from 0% to 50% with breaks at 10%, 20%, and 30%. A veteran's final VA disability rating for Plantar Fasciitis depends upon the frequency, severity, and duration of symptoms, meaning, the more severe your symptoms, the higher the VA rating for Plantar Fasciitis. Plantar Fasciitis in Veterans Plantar Fasciitis is one of the most common causes of heel pain in veterans It involves inflammation of the thick band of tissue that runs across the bottom of your foot and connects your heel bone to your toes (called the “Plantar Fascia”). According to the Mayo Clinic, “Your plantar fascia is in the shape of a bowstring, supporting the arch of your foot and absorbing shock when you walk. If tension and stress on this bowstring become too great, small tears can occur in the fascia. Repeated stretching and tearing can irritate or inflame the fascia, causing severe heel pain.” VA Rating for Plantar Fasciitis – Common Symptoms in Veterans Many veterans have or develop Plantar Fasciitis and common signs and symptoms include: * Heel pain (especially after standing, walking, or running) * Painful motion * Tenderness * Swelling

    ***Why a Great Buddy Letter Can Help You Win Your VA Claim!*** How to write a VA buddy letter for PTSD. When writing or obtaining a buddy letter for PTSD, you can simply use the VA Form 21-4138, Statement in Support of a Claim. I’ve heard others talk about why the VA Form 21-4138 might be hurting your VA claim… Guess what I think? I think they are WRONG. The VA Form 21-4138, in official .pdf format, is still the PREFERRED method of personal statements and buddy letters according to Rating Veteran Service Representatives (RVSRs), aka, VA Rating Officials. A great VA buddy letter for PTSD is short and sweet. Think less is more. We’re not writing a novel here veterans! 1: How do you know the Veteran? 2: What you witnessed or are witnessing. 3: The veterans’ current symptoms of the disability. 4: Sign and date your name to the best of your knowledge and belief.

    ***How to Get a VA Disability for Depression*** Symptoms of Depression in Veterans - According to the Mayo Clinic, Depression is a “mood disorder that causes a persistent feeling of sadness and loss of interest.” Clinical Depression is most often diagnosed as Major Depressive Disorder (MDD), and it affects how you feel, think, and behave and can lead to a range of mental, emotional, physical, and social problems. Veterans may have trouble accomplishing normal day-to-day activities, you may be too depressed to leave your home or get out of bed, and sometimes you may even feel as if life isn’t worth living (suicidal thoughts). Pre-screening for Major Depressive Disorder typically begins with having a Veteran complete the Patient Health Questionnaire (PHQ-9).

    Chronic Fatigue Syndrome VA Rating: What is Chronic Fatigue Syndrome? In 2020, the VA disability ratings for Chronic Fatigue Syndrome are 10%, 20%, 40%, 60%, and 100%, and depend upon the frequency, severity, and duration of a veteran’s symptoms. This means the more severe your symptoms, the higher the VA rating for Chronic Fatigue Syndrome. The highest possible VA disability rating for Chronic Fatigue Syndrome is 100 percent. So, let’s take a minute to explore the law regarding the symptoms and impairment required to warrant a VA disability rating for Chronic Fatigue Syndrome. Many veterans, especially Gulf War Veterans, suffer from a variety of unexplained medical conditions to include Chronic Fatigue Syndrome. Chronic Fatigue Syndrome is a complex disorder characterized by extreme fatigue in veterans that can’t be explained by any specific medical condition.
