    As many of you know, neck and back pain can have serious effects on your daily life. Veterans are often unaware of why they are in pain, and what that pain is telling them.     #34: EASY Ways to Service Connect Your VA PTSD Claim [Fast!] Nov 23, 2019

    Many veterans who experience a traumatic event on active duty develop PTSD, also called your VA PTSD Claim.

    This traumatic event is called a PTSD stressor by the VA. It is estimated that veterans are four times (4x) as likely to have or develop PTSD compared to those who didn’t serve in the military–a truly shocking statistic. It’s reasonable to assume a veteran will pursue a VA claim for PTSD at some point, and this post will help you on your path to service connection for PTSD.

    The VA states a stressor involves exposure to death, threatened death, actual or threatened serious injury, or actual or threatened sexual violence. The exposure can be related to: Direct exposure Indirect exposure, such as learning that a close relative or close friend was exposed to trauma Witnessing in-person Repeated or extreme indirect exposure to details of the event For rating purposes, the VA classifies PTSD as either (1) PTSD Combat or (2) PTSD Non-Combat.

    Examples of PTSD combat stressors • Rocket and mortar attacks in Iraq • Enemy ambush in Vietnam • IED event in Afghanistan • Flight deck plane crash in the Gulf War • Seeing another service-member killed while deployed Examples of PTSD non-combat stressors

    Military Sexual Trauma (MST), assault or harassment • Service-member suicide • Serious car accidents • Training accidents • Witnessing a rape • Serious weather event such as a hurricane • Death of a family member

    How to Prove Your Service-Connected VA Claim For PTSD Stressor verification is a huge deal for VA disability claims for PTSD. The reality is if the veteran can’t prove their PTSD stressor on an “at least as likely as not” basis, you’ll likely be denied service connection. This is also referred to as “corroboration” of a claimed stressor. By definition, “corroborate” means “to support with evidence or authority and make more certain.” The VA has different rules to assess whether a stressor event needs further verification. But in our experience, I want to make something very clear to veterans seeking service connection for PTSD: The burden of proof is on YOU to show on an “at least as likely as not” basis that the stressor event happened to YOU.

    You can download a copy of 38 CFR Part 4 The Schedule For Rating Disabilities from https://www.govinfo.gov/app/details/C...There is a link at the top left of the page that says PDF and you want to click the download button. Once you have downloaded a copy of 38 CFR Part 4 The Schedule For Rating Disabilities you can use your favorite PDF editor or viewer and you can start looking up your VA service-connected disabilities and see what you need in order to receive a particular rating for your service-connected disabilities.

    38 CFR Part 4 The Schedule For Rating Disabilities covers pensions, veterans' compensation, and bonus and this is the law. Title 38 is the principal set of rules and regulations issued by the VA regarding pensions, bonuses, and veterans' relief. It is available in digital and printed form and can be referenced online using the Electronic Code of Federal Regulations (e-CFR).

    VA Disability Rates 2020 were released on October 10, 2019, with the implementation of the Social Security Administration’s announcement of a 1.6% increase in the 2020 COLA. If you’re wondering if disabled veterans got a VA disability pay increase in 2020, watch this video for a full explanation! 2020 VA disability rates are effective December 1, 2019, and disabled veterans will see the new 1.6% increase on their January 1, 2020 VA compensation payment. This means Disabled Veterans with a current VA disability rating of 10% of higher will receive a 1.6% increase in their VA disability pay rate for 2020.

    How Many Veterans Have PTSD? According to the Department of Veterans Affairs, the prevalence of combat related Post Traumatic Stress Disorder among Veterans depends on which conflict a service member was involved with. About 11 to 20 out of every 100 veterans (or between 11% and 20%) who served in operations Iraqi Freedom and Enduring Freedom have PTSD each year. About 12 out of every 100 Gulf War Veterans (or 12%) have PTSD each year. About 15 out of every 100 Vietnam veterans (15%) were currently diagnosed with PTSD when the most recent study of them (the National Vietnam Veteran Readjustment Study) was conducted in the late 1980s. It’s believed that 30% of Vietnam veterans have had PTSD in their lifetime.

    How Many Veterans Have PTSD MST? Sadly, another common cause of non-combat PTSD in the military is referred to as PTSD MST, which stands for Military Sexual Trauma (MST). This is any form of sexual harassment or sexual assault that occurs on active duty. MST can happen to both men and women and can occur during peacetime, training, or war. Among veterans who use VA health care, it is reported that: 23 out of 100 women (or 23%) reported sexual assault when in the military. 55 out of 100 women (or 55%) and 38 out of 100 men (or 38%) have experienced sexual harassment when in the military.

    According to the VBA’s statistics reported to congress, PTSD was the #3 most commonly claimed VA disability, with 1,753,091 veterans (of 4,743,108) receiving VA compensation having a service-connected PTSD VA rating at 0 percent or higher.

    Brian Reese VA Insider breaks down “How to Win Your VA Lifestyle Impact Claim!” A Lifestyle Impact Claim is also Chronic Pain Syndrome and Somatic Symptom Disorder. Those terms are synonymous with depression and anxiety in veterans. These three terms all mean the same thing when it comes to VA claims for mental health.

    What is a Lifestyle Impact Claim? I consider this a high-value va claim and if you meet the criteria under the law, a Va Lifestyle Impact Claim is something you should consider as you are developing your strategy for veteran benefits. A Lifestyle Impact Claim is a high-value secondary claim that many veterans are eligible for due to one or more primary service-connected disabilities. Many veterans, lawyers, and VSOs DON’T know about secondary claims, which are eligible for compensation under the law, just like any other ratable disability. It is also actually called Somatic Symptom Disorder according to DSM-V, and the VA used to call it “Chronic Pain Syndrome with Depression/Anxiety.” You are eligible for this if you already have a rating from the VA as 0% or higher, and you have specific, rated, disabilities. For example, you are rated at 20% for your left shoulder, 10% for your right knee, and 0% for your back. If these disabilities have caused chronic pain and negatively limiting your life, then you may qualify for a secondary claim to mental health. You will need a certification from a Psychologist for Somatic Symptom Disorder, which will link the two together.

    There are three types of service connection, there is direct service connection, secondary service connection or presumptive service connection and we are going to be talking about secondary service conditions because that is exactly what Chronic Pain Syndrome - Somatic Symptom Disorder is. Va rates all service-connected disabilities based on your social and occupational impairment and VA will rate you based on how Somatic Symptom Disorder affects your ability to work and your social life. If you are unable to lift your niece because of the chronic pain in your neck then that is an example of a disability that directly affects your lifestyle and that is why we call it a Lifestyle Impact Claim.

    Many veterans don't realize they are eligible for high-value secondary VA disability claims, also called Secondary Service Connection. Service connection on a secondary basis requires a showing of causation. A showing of causation requires that the secondary disability be shown to be proximately due to, or the result of, another service connected VA disability condition. In order to prove secondary service connection, however, you'll need to get a VA DBQ and a VA Nexus Letter, or you risk having your secondary VA claim denied. What this means is that you're telling the VA that your current disability was caused or made worse by ANOTHER service connected disability in your body rated at 0% or higher. Secondary VA disability claims are rated just like primary VA disability claims. You can get rated between 0-100 for any secondary disability claims you're suffering from as a result of another service connected disability rated by the VA.

    The benefit of secondary VA claims and secondary service connection is that they are much easier to win and service connect, especially if you've been out of the military for more than 12 months. Total and Permanent Disability VA, also known as 100 percent P&T, applies to veterans whose disabilities are Total (meets total disability definition) AND Permanent (impairment is reasonably certain to continue throughout the life of the disabled person).

    Many veterans mistakenly interchange “Permanent” and “Total,” when, they have very different meanings. For example, a veteran can have a Total disability that’s temporary, such as a total knee replacement OR a Permanent disability rated less than 100 percent, such as Sleep Apnea that’s been rated at 50 percent for the past 10 years. Veterans can also be both Permanent and Total, not just one or the other. The major benefit of being deemed both “Permanent and Total” or 100 P&T is that veterans are protected from a VA ratings reduction. Furthermore, being rated 100 percent P&T entitles you or your family to a host of additional VA benefits.
