    ***Fibromyalgia, what is it and how to properly file a VA Disability Claim for it*** - How does the VA rate Fibromyalgia - * 10% if the symptoms require continuous medication for control * 20% if the symptoms are episodic, with exacerbations often precipitated by environmental or emotional stress or by overexertion, but symptoms that are present more than one-third of the time * 40% if the symptoms are constant or nearly constant, and are refractory to therapy. - How do I know if I have Fibromyalgia? - First of all, Fibromyalgia is a rule out diagnosis. Before the diagnosis of Fibromyalgia can be made, the muscle pain must be present for longer than three months. There is no blood test, or X-ray can tell if you have Fibromyalgia. The diagnosis is made solely by taking a history and doing a physical exam. During the exam, pain must be occurring at specific sites on the body called tender points. There are 18 of these sensitive spots. Most are located on the neck and back.

    - Symptoms of Fibromyalgia in Veterans - Some of the other symptoms of fibromyalgia include: * Fatigue * Insomnia * Headaches * Nervousness * Numbness * Dizziness * Intestinal distress, including Irritable Bowel Syndrome (IBS) Check out our awesome blog post for more information on Fibromyalgia and other VA Claims information!

    ***How to Get a 60% VA Rating for GERD in 2021!*** - GERD VA Disability Rating Criteria - Yes, GERD is a VA disability and can be rated at 10%, 30%, or 60%, depending upon the severity of your symptoms. GERD is most often rated under CFR 38, Part 4, VA Schedule of Ratings, Diagnostic Code 7346, Hernia Hiatal. - Common Symptoms of GERD in Veterans - * A burning sensation in your chest (heartburn), usually after eating, which may worsen at night * Chest pain * Difficulty eating and swallowing * Regurgitation of food particles or sour liquid * Sensation of a lump in your throat

    - GERD Secondary to PTSD & PTSD secondary to GERD - Many veterans with GERD or acid reflux, especially those who were diagnosed long after leaving the military are eligible under the law for GERD secondary to PTSD. For example, if veterans are taking SSRIs to help manage their PTSD symptoms, perhaps you’re suffering from side effects of those SSRI medications, which can lead to digestive system issues. - What you need before you can get a GERD VA rating secondary - By law, there are three evidentiary elements that must be satisfied for GERD secondary to PTSD to prove secondary service connection: * A medical diagnosis of GERD in VA medical records or private records (unless you already have a diagnosis of GERD in your service treatment records) * Evidence of a service-connected primary disability (such as PTSD, depression, anxiety, migraines, IBS), AND * Medical nexus evidence establishing a connection between the service-connected disability (PTSD) and the current disability (GERD)

    What is Chronic Pain - Chronic Pain is long lasting pain which interferes with your daily life. It begins to qualify as chronic once it lasts over six months. In some cases, chronic pain is persistent for years of someone’s life. Chronic Pain can be linked to a number of different reasons, including injury, disease, or damage to nerves. Chronic pain is a condition which directly affects someone’s mental health. Through anxiety, lack of sleep, hopelessness, and depression chronic pain can reveal itself. How to prove Chronic Pain - Another step in this process is establishing credibility. One way you can do this is by proving that you have tried to relieve the pain in other ways. This could be done with some approaches, including massage therapy, seeing a chiropractor, or visiting with a pain specialist.

    How to file - Chronic Pain can be submitted as a primary or secondary to other service related conditions. With this, you will need to understand how primary and secondary claims are rated. First off, when filing the initial primary claim, you have to prove beyond a reasonable doubt, that your military service directly causes it. Secondly, to keep your current rating or increase it from the VA, you have to prove, that is has created your “quality of life” and “impairment to your earning capabilities”, and has progressively gotten worse over time.

    Who is eligible for VA disability compensation? To be eligible for VA disability compensation benefits under the law, a veteran must prove that their disability was caused or made worse by their active duty military service.
