Did Bryan Kohberger Build His Legal Case From a True Crime Book? Aug 05, 2026
    Show notes

Bryan Kohberger's handwritten petition uses a phrase that is the title of a book published months before he filed. The evidence term he cites appears in no court record β€” only in that book. And the evidence he says was hidden from him was examined by an expert his own lawyers paid for.Bob Motta of Defense Diaries joins Tony Brueski to break down what this petition is built on, what the sworn record says about whether the plea was voluntary, and what the historical pattern tells you about defendants who tried to undo pleas they took to avoid execution. They also cover Steve Goncalves welcoming a retrial, the procedural reality of what happens if the plea is withdrawn, and why the question that matters most is not whether Kohberger can get this heard β€” it is whether any attorney would stand beside him at trial.Tony Brueski and criminal defense attorney Bob Motta of Defense Diaries.

Clancy Trial Bombshell: Blood in the Basement Was Cora's β€” DNA and Nanny Testimony Collide Aug 05, 2026
    Show notes

The murder trial of Lindsay Clancy, the Duxbury, Massachusetts mother accused of strangling her three children β€” 5-year-old Cora, 3-year-old Dawson, and 7-month-old Callan β€” with exercise resistance bands inside the family's Summer Street home on January 24, 2023, moved from courtroom procedure to hard evidence in one sitting. Clancy faces three counts of murder and three counts of strangulation, has pleaded not guilty, and is mounting an insanity defense through attorney Kevin Reddington, built on claims of severe postpartum psychosis and psychiatric overmedication.

Plymouth Superior Court Judge William F. Sullivan read stipulations already agreed to by both prosecution and defense β€” meaning no one's contesting them. The exercise bands recovered from the scene carry DNA from Lindsay Clancy, Patrick Clancy, and the children on their ends. Blood recovered from the basement has been confirmed to belong to Cora. Stipulated facts, not theories.

Former Massachusetts State Police criminalist Katarina Stashyn followed with a breakdown of how DNA testing works and what it actually revealed from the samples collected in this case β€” testimony meant to make sure jurors understand the science behind the stipulation, not just the conclusion.

The day closed with something less clinical. Elaine Rossi, who worked as the Clancy family's nanny, testified about her time in the household, including conversations where Lindsay told her she was dealing with postpartum depression. It's the kind of detail the defense will lean on hard in the weeks ahead.

Prosecutors maintain Clancy understood what she was doing regardless of her mental state. After the killings, she allegedly attempted suicide by jumping from a second-story window and is now paralyzed from the waist down. Her husband, Patrick Clancy, was running errands at the time and has since relocated to Manhattan. The trial continues in Plymouth Superior Court.

What Nancy Guthrie's Kidnapper Proved He Knew About Her House Aug 05, 2026
    Show notes

The first ransom note contained details about Nancy Guthrie's home that retired FBI negotiator Jason Pack says almost nobody knew β€” a smartwatch on the floor, a destroyed floodlight. The writer proved he had been inside the house. He never proved he had Nancy.

Psychotherapist Shavaun Scott goes through the first note with Tony Brueski β€” the demand structure, the proof-of-presence, the language that reads like a man closing a transaction, and the line about Nancy that changes meaning entirely when you read the second note.

Why Clancy's Surgeon Called Her Injuries Superficial Aug 05, 2026
    Show notes

A South Shore Hospital surgeon took the stand at Plymouth Superior Court and told the jury that Lindsay Clancy's wrist and neck injuries on the night she allegedly killed her three children were superficial. The cuts went through skin and exposed fat but didn't reach muscles, arteries, or tendons. The prosecution needed that testimony to support their argument that Clancy's attempt on her own life wasn't real. Then Clancy's defense attorney Kevin Reddington revealed something the surgeon never knew β€” her patient's heart had stopped at Brigham and Women's Hospital and she required massive blood transfusions to survive.

The rest of Day 6 centered on prescription evidence. Thirteen bottles were presented to the jury, most nearly full. Prosecutors argued Clancy wasn't taking her medications. The defense showed all thirteen were prescribed in a three-week span. Forensic scientists confirmed five psychiatric drugs in Clancy's blood β€” mirtazapine, lamotrigine, quetiapine, trazodone, and benzodiazepines β€” and confirmed the absence of any recreational or illicit substances. Post-mortem results on Cora, five, Dawson, three, and Callan, eight months, showed nothing in their systems. Clancy also spoke in court for the first time, agreeing to stipulations that concede all physical evidence and narrow the trial entirely to her mental state.

Clancy Trial: Toxicologist Says Drug Levels Were Within Therapeutic Range Aug 05, 2026
    Show notes

The murder trial of Lindsay Clancy, the 34-year-old Duxbury, Massachusetts mother accused of strangling her three children β€” Cora, 5, Dawson, 3, and Callan, 7 months β€” with exercise resistance bands inside the family's Summer Street home on January 24, 2023, continued this week with a run of clinical, detail-heavy testimony. Clancy faces three counts of murder and three counts of strangulation, has pleaded not guilty, and is pursuing an insanity defense under attorney Kevin Reddington, who argues she was in the grip of severe postpartum psychosis compounded by psychiatric overmedication.

Physician Assistant Eitan Negri opened the day describing the treatment of Clancy's wrist injuries. From there, jurors moved into the science. Nicholas Roberts, formerly of the Massachusetts State Police Crime Lab's toxicology division, testified to the drug levels detected in Clancy's blood and urine. Then forensic toxicologist Dr. Justin Brower took the numbers further, telling the court that the levels he tested for were within therapeutic range β€” not elevated, not consistent with the kind of overmedication the defense has leaned on to explain her state of mind.

That's a problem for a defense strategy built partly on the idea that Clancy was chemically overwhelmed. Toxicology doesn't argue with a jury. It just sits there as a number, and today's number wasn't the one the defense probably wanted.

After the killings, Clancy allegedly attempted suicide by jumping from a second-story window and is now paralyzed from the waist down. Her husband, Patrick Clancy, was out running errands at the time and has since relocated to Manhattan. The trial is underway in Plymouth Superior Court and expected to run several weeks.

What Patrick Clancy Concluded About His Wife's Doctors Aug 05, 2026

Bryan Kohberger's Case Rests On A Woman He Blames Aug 05, 2026
    Show notes

Bryan Kohberger is trying to withdraw his guilty plea and win a new trial β€” and he seems not to have priced what winning would cost him.

He traded a trial for his life. The agreement he signed in the Idaho student murders took the death penalty off the table in exchange for four consecutive life sentences and a waiver of his right to appeal. Now he wants the agreement gone.

If a judge vacated that plea, the deal dissolves β€” and legal experts told Newsweek that Kohberger would be facing capital punishment all over again. One former federal prosecutor called the attempt foolish, and said that if this case were actually tried, there is a very good chance he is convicted and sentenced to death. Idaho's attorney general said his office stands ready to do whatever is necessary.

So the lawyer Kohberger is calling ineffective is the one who got the needle taken away, and saving his life is the failure he is alleging.

Tony lays out how he got here. A witness list filed by prosecutors weeks before trial. A name on it that changed the math. A guilty plea entered days later, under oath, with the judge asking him point blank whether he actually committed these crimes because he didn't want the man confessing to something he hadn't done.

And then, thirteen months later, five handwritten pages saying none of it was true.

The petition is not frivolous and there is a real statute behind it. But there is a difference between a door being open and a man being able to walk through it. This episode is about exactly where that line falls, and what four families are being asked to sit through while it plays out.

Lindsay Clancy Trial: Crime Lab Experts Detail What the Evidence Actually Shows Aug 04, 2026
    Show notes

The Lindsay Clancy trial spent a day in the world of lab coats and evidence logs, and it was no less devastating for it. Clancy, 34, of Duxbury, Massachusetts, is accused of strangling her three children β€” 5-year-old Cora, 3-year-old Dawson, and 7-month-old Callan β€” with exercise resistance bands inside the family's Summer Street home on January 24, 2023. She faces three counts of murder and three counts of strangulation, has pleaded not guilty, and attorney Kevin Reddington is arguing an insanity defense centered on severe postpartum psychosis and psychiatric overmedication.

Plymouth Superior Court Judge William F. Sullivan started afternoon proceedings by reading the stipulations prosecution and defense had already agreed on regarding the children's toxicology findings. Then the state called its scientists. Alicia Zimmermann of the Massachusetts State Police Crime Lab explained how toxicology testing is conducted when the deceased is a child β€” a process that demands its own protocols, not adult ones scaled down. Sherri Crook, who supervises the State Police Crime Scene Response unit, followed with a breakdown of blood spatter analysis, distinguishing spatter from pooling from smearing, and mapping those categories onto the physical evidence recovered at the Clancy home.

This is the unglamorous backbone of a strangulation prosecution β€” chain-of-custody science, pattern interpretation, and testimony that doesn't editorialize because it doesn't have to. Prosecutors Jennifer Sprague and Shanan Buckingham are using it to build a factual floor under the state's case. The defense still has to get the jury from "this happened" to "she didn't know it was wrong." That gap is where this trial will actually be decided. Proceedings continue in Plymouth Superior Court.

No Damage to the Window: Duxbury Sergeant's Testimony in the Lindsay Clancy Trial Aug 04, 2026
    Show notes

Two witnesses with very different vantage points took the stand this week in the Lindsay Clancy trial β€” one clinical, one procedural, both consequential. Clancy, 34, of Duxbury, Massachusetts, faces three counts of murder and three counts of strangulation over the deaths of her three children β€” Cora, 5, Dawson, 3, and Callan, 7 months β€” who prosecutors allege she strangled with exercise resistance bands inside the family's Summer Street home on January 24, 2023. She's pleaded not guilty, and her attorney, Kevin Reddington, is arguing an insanity defense centered on severe postpartum psychosis and psychiatric overmedication.

Sgt. Robert Flynn of the Duxbury Police Department testified he was present when State Police executed the search warrant at the home, and told the court there was no damage to the window or screen β€” a detail that's going to matter a great deal to anyone tracking the physical evidence around Clancy's alleged fall. Flynn confirmed State Police took over the investigation after that.

Forensic psychiatrist Dr. Jhilam Biswas described her initial assessment of Clancy, focused on evaluating her safety and state of mind. Biswas told the court psychosis symptoms present differently from person to person, but said that during the roughly 20 minutes she communicated with Clancy, she observed no signs of active psychosis.

Clancy is accused of attempting suicide after the killings, leaving her paralyzed from the waist down. Her husband, Patrick Clancy, was running errands at the time and has since relocated to Manhattan. The trial is underway in Plymouth Superior Court and is expected to run several weeks.

How Nolan Wells' Medical Examiner Helped A Deputy Walk Aug 04, 2026
    Show notes

In 2021, a twenty-nine-year-old Black man named Damien Cameron was restrained by Rankin County sheriff's deputies and transported to a hospital, where he was pronounced dead. Mississippi's chief medical examiner, Dr. Staci Turner, performed the autopsy. Her own findings documented internal bleeding in his neck consistent with compression injuries. She ruled the death "undetermined."Three national forensic pathologists β€” including former NYC chief medical examiner Dr. Michael Baden and Rutgers forensic pathology chief Dr. Zhongxue Hua β€” independently reviewed the case at the request of the New York Times and Mississippi Today. All three concluded the death was a homicide. A grand jury relied on Turner's ruling and declined to indict the deputies. One of them β€” Hunter Elward β€” is now serving federal time for the "Goon Squad" torture cases. That same medical examiner performed Nolan Wells' autopsy on July 7. Those results remain sealed. The independent autopsy came back undetermined with significant limitations. And the family's attorney β€” Ben Crump β€” is the same attorney who represented Cameron's family and now represents Trey Reed's family in another disputed Turner ruling.Even a perfect autopsy from this office, in this framework, won't be believed. That's not the family's fault. That's what happens when institutions lose credibility and nobody in power fixes it.
