    On September 18, 2020, Ruth Bader Ginsburg passed away at age 87 after serving as an Associate Justice of the United States Supreme Court for over 27 years. The U.S. Supreme Court’s second female judge, Justice Ginsburg—or the Notorious RBG, as she was fondly called—left her mark as a women’s rights activist and a legal icon, including a robust footprint in the intellectual property (IP) field.

    This two-part series, airing on March 30 and April 13, presents three distinguished guests who offer a rare “behind the scenes” look at Justice Ginsburg. In a wide-ranging and candid discussion, they shed light on the many ways Justice Ginsburg shaped U.S. IP law through her opinions and share anecdotes about the Justice’s life.

    Our guests are themselves IP trailblazers. Professor Jane Ginsburg is a renowned authority on IP law, a staunch defender of authors’ rights, and Justice Ginsburg’s daughter. She is Professor of Literary and Artistic Property Law at Columbia Law School and directs Columbia’s Kernochan Center for Law, Media and the Arts.
    Our second guest, Professor Mary Hartnett has been at Georgetown University Law Center since 1998, first as executive director of the Woman's Law and Public Policy Fellowship Program and now as an adjunct professor of law. In 2016, Justice Ginsburg wrote the bestselling book “My Own Words” with Professor Harnett and Professor Wendy Williams.

    Our third guest is Judge Margaret McKeown of the U.S. Court of Appeals for the Ninth Circuit, where she has authored essential IP decisions since her confirmation in 1998. She has lectured throughout the world on IP, anti-trust, constitutional law, ethics, international law, human rights law, and litigation.

    We’re bringing back our interview with Cristina Carvalho, managing partner of Arent Fox LLP, a law firm based in Washington, D.C., USA—in honor of International Women’s Day, March 8, 2021, and to mark the newly released INTA’s The Women’s LeadershIP Report and Best Practices Toolkit.

    In this episode, which originally aired March 31, 2020 as part of Brand & New’s Women’s Empowerment in IP series, Ms. Carvalho discusses the challenges she faced to raise to the top, the pivotal role of women mentoring programs, and what it means to be one of the most powerful women in Washington, D.C.

    Her thoughts align with key findings of The Women’s LeadershIP Report and Best Practices Toolkit. Among the findings, the Report found that while an increasing number of women are entering the legal field, particularly in IP, women are under-represented in the IP sector, particularly in leadership positions. Mentoring programs are one of the recommendations to fill the gap.

    Intellectual property (IP) law is engineered to foster innovation and creativity. In some countries, the way IP applies to traditional forms of creativity such as music, painting, design, or even perfumes is understood and accepted. But, at least in principle, it may be less obvious when it comes to emerging popular forms of art, such as street and body art.

    How does IP apply to street and body arts? Who owns what? What are the competing rights at stake—those of the owner of the building on which a graffiti is painted or the person bearing the tattoo?     Video conferencing and social media apps like Zoom, Houseparty, and TikTok have exploded in popularity during these times of global social distancing. While these apps have become much more popular among regular users, they also have attracted potential hackers, raising opportunities as well as risks to a brand-new scale and prompting some platforms to institute stronger security features.

    Will this surge in usage have a lasting impact on these companies in terms of value, brand reputation, diversification of services, available security features, or even future privacy regulations?

    In this episode, we discuss these issues with Dominique Shelton Leipzig, a partner in the Privacy & Data Security Group and co-chair of the Ad Tech Privacy & Data Management team at Perkins Cole LLP, Los Angeles, California, USA.     Welcome to this special episode of Brand&New in Boston, Massachusetts recorded during INTA’s 2019 Annual Meeting.     Counterfeiting is no less than one of the biggest issues of our times. It is self-evident to say that it is linked to crimes, that it costs billions to companies and societies every year in all areas. So relevant actions are more essential than ever, particularly to tackle illicit sales. Our episode today is about the most efficient ways, with the development of innovative tools, to fight these new pirates. Our focus will be China, and its challenges about IP, including the impact of so-called trade war with the US.

    Our guest is partner at one of the largest law firms in the world, Baker & McKenzie, present in more than 40 countries. Loke Khoon Tan leads the IP Practice Group in Hong Kong and China and co-leads the firm’s luxury and fashion industry practice. He works with global brands, helping them to structure and implement anti-counterfeiting strategies. Loke is the author of the “Pirates” trilogy and other publications about IP protection.
