Former Massachusetts State Police Trooper Michael Proctor was scheduled to testify at a hearing regarding a motion to dismiss in the Myles King murder case, but unexpectedly exercised his Fifth Amendment right against self-incrimination after a private sidebar with the judge. Defense attorney Rosemary Scapicchio expressed frustration over the sudden reversal, as Proctor's lawyer had previously indicated he would testify. Scapicchio argued that Proctor's lead role in the investigation tainted the case due to explicit racial bias demonstrated in his text messages, asserting this constitutes structural error warranting dismissal. The court order addressed discovery delays and police bias, mandating that remaining testimonies—including continued cross-examination of Attorney Adam Lally and statements from Milton police officers—proceed under narrow focus, with several witnesses submitting evidence via affidavit.

Keffe D Trial: Prosecution & Defense Clash in Intense Courtroom Charging Conference | Case Brief Aug 29, 2026
    Show notes

Watch the full coverage of the live stream on The Emily D. Baker YouTube channel: https://youtu.be/E9560lA271A

This Case Brief highlights a legal charging conference where the judge and attorneys debate and establish over 50 jury instructions. The proceedings focus on crucial, fact-based instructions including the voluntariness of the defendant's statement, corpus delicti and its relation to confession corroboration, and the law of self-defense. While the defense successfully fights for a voluntariness instruction, the corpus delicti debate culminates in a modified instruction clarifying that a defendant's confession—if believed—does not require further corroboration as long as independent evidence proves the victim's death was caused by a criminal act. Ultimately, the judge plans to pre-read these instructions to the jury before closing arguments begin on Monday.

Following cross-examination, the defense rested, the prosecution declined to present rebuttal witnesses, and the jury was dismissed until Monday, when closing arguments are scheduled to begin.
