He saw organizations use a variety of tactics to reduce COVID-19, some of which worked while others didn’t.     Managing Environmental Legal Risk - What To Know May 19, 2022

    Sarah Lintecum, Counsel at Lathrop GPM LLP, provides what Risk Managers should know about Environmental Risks. She shares three types of environmental risks that organizations should consider in terms of insurance needs: climate change, Potential liability caused by emerging contaminants, such as PFAS, and air pollution and indoor air quality. She explains how environmental liability is expensive and claims become very complex. Specifically with PFAS, risk management professionals and entities should monitor new regulations with an increase in legal, regulatory and claims. Specific circumstances to consider PFAS include when purchasing new property, the potential exposure to liability if you work within water utilities or wastewater treatment plants. Sarah shares the common coverage issues related to PFAS, the two sources of coverage that can apply and what to expect this year for PFAS is an increase in claims, litigation, and requests for information during the underwriting process, along with best practices and tips for procuring coverage.

    Christine Packard, the Director of Enterprise Risk Management at the University of Massachusetts talks about Leveraging Enterprise Risk Management as a Crisis Response Tool, applied to the specific instance of COVID 19. With two decades of experience in crisis response prior to working at the University of Massachusetts, she has in-depth expertise on managing crisis. Christine shares how the foundation of effective crisis response is built upon the collaboration upon existing networks of different disciplines. She details how the structure supports effective crisis response through consistent meetings of stakeholders; which builds partnership and awareness of each other's respective positions, as well as improved health and safety measures. enrollment, staffing, and finance. An ongoing sharing of information allows comprehensive mitigation strategies and keeps the board of trustees informed. Christine shares how they Operationalized ERM for crisis response, using COVID 19 as an example. She explains how Leadership is a fundamental component and the importance for communication and in the case of COVID 19 it meant providing daily updates to provide situational awareness. Lastly, she informs how the crisis strengthened the ERM Program and brought about updated risk assessment and mitigation tools, as well as more developed relationships and network.

    Minimizing Pharmacy Plan Costs with Lisa Stamm Lisa Stamm, VP of Consulting Services at Sherril Morgan discusses minimizing pharmacy plan costs. She explains how the pharmaceutical industry is one of the most complex and expensive costs for companies that sponsor health plans, specifically determining how much is being paid toward pharmacy benefit management. Pharmacy Benefit Managers (PBM) main role is to facilitate transactions when a member fills their prescriptions at a pharmacy. There are four traditional ways of how a PBM is compensated. The first is spread, which is adding a cost to every prescription they process; with this cost being built into the pricing makes it difficult to quantify for the employer. The second is Rebate Retention, this is retaining all the rebates that plans get when members use their prescription drugs, instead of hitting the employer's plan. The third way is by obtaining the part of the co-pay that was higher than the cost of the prescription, and the fourth is in a traditional structure by being a part of the mail order process. Each time someone uses mail order the PBM is obtaining revenue from the transaction. She shares the problems of a traditional model and the benefits of Pass Through as an alternative, which is when a PBM is given a fixed and controlled administrative fee. She also explains how focused an employer should be on pharmacy rebates, mail-order and the co-pay structure’s best strategy to prescription drugs management

Carl’s advice for new risk managers is to create a risk awareness culture within your organization and several options on how to do so. He also shares the experience of a presentation from PRIMA’s annual conference having significant relevance to his upbringing and his line of work.
