    Sports Law competition rivalries! Our website posts law school spotlights with Sports Law programs. Recently there has been some heated debate over which law school holds the prestige for the Sports Law competitions. Dan Lust, Mike and Jason (2:15) discuss their experience with sports law competitions and the recent debate between Fordham and Villinova law schools.

    The world of sports has been punishing Russia for their military involvement in Ukraine. (19:15) We discuss the International Olympic Committee being the first large scale ban on Russia and Belerus, preventing them from competing in international games. The IOC is also urging FIFA and UEFA to do the same for international football (which they have also done since recording this episode).

    We are very excited to annouce the launch of our new segment called Opening Arguments hosted by Conlan Farrell, a sports law debate show with a betting angle. Conlan's first episode is with the Dans. The three discuss (25:00) Brian Flores, Deshaun Watson and Dan Snyder lawsuits.

    NCAA NIL and Conference Realignment; and USWNT Settlement with US Soccer Feb 25, 2022

    Contributor to Conduct Detrimental Brendan Bell (@bbell5_) talks about the NCAA's role with NIL moving forward (5:04) and any federal legislation possibilities. Dan, Tarun and Brendan also break down the unfair labor practice charges in the PAC12 (15:45) and what does the NCAA model look like as student-athletes become employees. They also break down the Marshall University lawsuit against Conference USA (23:43) and the battles to come from conference re-alignment in the NCAA.

    Juwan Howard Slapped with Suspension; Cowboys Cheerleader Settlement; Watson Criminal Case; Flores Hired by Steelers Feb 23, 2022

    Another loaded week of sports law.

    Juwan Howard (5:41) slapped Wisconsin assistance coach Joe Krabbenhoft. Was the 5 game suspension enough? Will we see other punishments come down?

    Brian Flores (17:46) was hired by the Steelers as Senior Defensive Assistant and will be the linebackers coach. How does this impact his lawsuit? Does it help his case that he took a "step back" in terms of his position with the Steelers?

    Bruce Beal's (28:42) right of first refusal is in jeopardy if there is a forced sale of the Dolphins from Stephen Ross. The right of first refusal only kicks in when there is a voluntary sale by Ross, but in a forced sale situation, the NFL may have the authority to prevent the right of first refusal clause. Dan Wallach has more here.

    It is reported that a confidential settlement was paid by the Dallas Cowboys (32:03) for $2.4 million in 2015 regarding voyeurism allegations against Richard Dalrymple, Cowboys longtime senior vice president for public relations and communications. Dalrymple recently retired, holding his position at the Cowboys for 7 years after this settlement and these allegations. Should the House Oversight Committee expand their investigation of the Washington Commanders to include the Dallas Cowboys organization?

    Deshaun Watson (47:36) is back in the news as Watson's attorney Rusty Hardin states that the District Attorney's office should be making a decision to bring criminal charges by April 1.

    U.S. -v- Eric Kay: The Tyler Skaggs Trial, Part 2 Feb 18, 2022

    VERDICT: Guilty.

    It's U.S. versus Eric Kay. A full breakdown of the criminal trial alongside Conduct Detrimental Resident District Attorney Matt Tympanick of Tympanick Law (@TympanickLaw).

    NFL Coverage: Super Bowl, Brian Flores; Stephen Ross and Dan Snyder Forced Team Sale Feb 16, 2022

    The NFL season is officially over and the Dans give their take on the Super Bowl (1:50). Was St. Louis robbed of a national spotlight because of the lawsuit and ultimate settlement?

    There are reports that Brian Flores (9:26) is going to amend his complaint to assert Title 7 employment discrimination against the Houston Texans as a retaliatory failure to hire after Flores brought his initial lawsuit. Does the hiring of Lovie Smith hurt Flores' case? Is he even permitted to bring the Title 7 claim without having exhausted all of his administrative remedies?

    Stephen Ross (25:46) is under the scope with the allegations of offering $100K per loss to Brian Flores. Is there enough evidence there to warrant the rumors of him being forced to sell the team?

    There are now reports about Dan Snyder (33:05) possibly being forced to sell the team as well. Washington has started another "independent" investigation.

    There have been a number of reports and allegations surrounding the tanking of teams. (42:15) Do these reports fall under the Federal Sports Bribery Act? Could Stan Kroenke be implicated? What about Brian Flores' allegations against Stephen Ross? Ross could potentially be charged under Florida State law if the allegation of making the bribe has any veracity.

    New York Sports Betting (48:46) has been live for one month and brought in $2 billion in bets and brought in $70 million in tax revenue.

    Brian Flores Continues; Alvin Kamara Arrested; Trevor Bauer Exonerated; & Tyler Skaggs Trial Begins Feb 10, 2022

    Big week in Sports Law!

    We broke down the Brian Flores racial discrimination class action lawsuit on our last episode. This week the Texans (4:45) hired Lovie Smith and the Dolphins hired Mike McDaniel, which brings the total of black NFL head coaches to three including Mike Tomlin. Not too long ago, and before bringing the lawsuit, Flores was a top candidate to be hired by the Texans. How does Lovie Smith's hiring impact Flores' lawsuit?

    Standard head coaching contracts have an arbitration (22:36) provision that Roger Goodell arbitrates any disagreements between a coach and a team. How does the arbitration clause play into the Flores and Gruden lawsuits? Dan Wallach wrote an article on this and you can read more here.

    Alvin Kamara (28:34) was charged with battery resulting in substantial bodily harm after an altercation that occurred in a night club in Las Vegas leaving a man with an orbital fracture on his right eye. We discuss the case and impact going forward.

    Trevor Bauer (37:06) will not face criminal charges from the allegation of sexual assault. What is next? Will there be a civil lawsuit?

    Tyler Skaggs' criminal trial (45:52) against former Los Angeles Angels' communications director Eric Kay began this week and there are a list of 7 Angels players to be called as witnesses. The defense has named Matt Harvey, former Mets pitcher, as a witness for allegedly being a drug source and giving Percocet to Skaggs.

    Former LA Angels Visiting Locker Room clubhouse employee Bubba Harding (55:12) sued MLB and LAA for defamation after he was fired for reporting that MLB pitchers came to him for illegal sticky substances. A California appeals court has reinstated the defamation claims.

    Brian Flores Update, Washington Commanders Name Change, & Toxic Congressional Hearing Feb 04, 2022

    The Brian Flores lawsuit (1:25) has had some recent developments where more coaches are coming out about sham interviews and Hue Jackson saying the Browns ownership offered money to him to tank. Criminal implications and investigations could be looming for Dolphins owner Stephen Ross. Will this class grow under the class action?

    Washington Football Team (23:01) finally has a new name, the Washington Commanders, but that is not the biggest news on the team. Congress held a hearing (26:53) with the victims from the sexual harassment culture that was created and fostered by Washington's organization and Dan Snyder. The Congress House Oversight Committee is making a call for the investigation report the NFL has conducted on the WFT culture and the 650,000 emails. Congressman Connelly was even wearing a #releasethereport shirt. Steph takes you through the whole hearing and gives her impressions on the implications and what's next for Washington and the NFL.

    Brian Flores v. NFL Feb 02, 2022

    Brian Flores filed a Class Action Lawsuit against the NFL, NY Giants, Miami Dolphins, and Denver Broncos alleging racial discrimination in hiring/firing practices. Flores is attacking the systemic racial discrimination issue in NFL history regarding minority head coaches and general managers. This 58-page lawsuit comes with explosive allegations, including Dolphins owner, Stephen Ross, bribing Flores with $100,000 per loss incentives to lose games. We break down the allegations, implications, and ramifications of this lawsuit.
