    NIL Showdown: Saban v. Jimbo with Darren Heitner May 23, 2022

    The Dans are joined this week by Darren Heitner (@DarrenHeitner) to break down the allegations that Nick Saban stated about Jimbo Fisher and Texas A&M. Saban accused Texas A&M of buying every recruit on their team, making reference to an NIL deal.

    Darren breaks down the current landscape of NIL and the accusations that Saban threw around about Deion Sanders and Jimbo Fisher. He also discusses John Ruiz, a supporter of University of Miami with NIL deals for athletes, and his response to Saban's comments.

    NFL Sports Law Combine: Rams, Jeudy, Lambo, Gruden, Watson; and Matt Harvey Suspension May 19, 2022

    The Dans break down all the latest in sports law this week!

    They discuss the NHL's player injury reporting procedures regarding Crosby's concussion and whether he was playing game 7. (4:15) The talk about the impact this has on sports gambling and betting lines.

    The St. Louis Rams lawsuit is back. (11:05) There have been hundreds of pages that were unsealed after the St. Louis Post Dispatch filed a motion to unseal arguing they were public records. These documents show that Kroenke was lying all along and the NFL was aware regarding the land purchase in California and the ultimate move to LA. The NFL aslo referenced the possibility of the Raiders moving to St. Louis.

    Jerry Jeudy was arrested for criminal tampering. (21:24) He allegedly locked some items in a car away from the mother of his child. However, she is not cooperating at this time and that will make it difficult to bring charges and for the NFL to issue any suspension.

    Josh Lambo files a lawsuit against the Jacksonville Jaguars, his former team, for a hostile work environment. (27:27) Urban Meyer was the prior head coach who allegedly kicked Josh in the leg during warmups. The lawsuit he was verbally and physically abused and the environment as a whole was hostile to play and work in and seeks $3.5M in compensation. Does the aribitration clause apply here?

    Jon Gruden has a hearing coming up in his lawsuit against the NFL. (37:54) Will his case remain in the courtroom? Or will it be forced into arbitration?

    Updates on the civil suits against Deshaun Watson. (43:28) Watson appeared back for depositions and some of the testimony has been leaked by Tony Buzbee. The NFL has not placed a suspension on Watson. Is Buzbee attempting to push Goodell to suspend Watson?

    Matt Harvey suspended for 60 games after his testimony in the Tyler Skaggs drug overdose lawsuit and involvement in providing drugs to Skaggs. (52:15) Trevor Bauer speaks out that his punishment in comparison to Harvey's is excessive.

    Saving College Sports, Advice for Grads, & Conduct LIVE Recap w/ Maddie Salamone & Steve Simmons May 18, 2022

    Joining Dan Lust as a guest host today is a veteran writer for ConductDetrimental.com, Landis Barber (@LandisBarber) for this episode packed with college sports topics.

    Dan speaks with Maddie Salamone (@madsal15) who is a former Duke lacrosse player and a current athlete advocate who spoke at the Sports Lawyer Association conference in Atlanta this year. (12:16) Maddie discusses ways that the NCAA model can change for the better and the pressing need to focus on student-athlete mental health awareness. The NCAA must start to actually put the student-athletes first. Dan and Maddie also give some advice for law students as they graduate and enter the job force.

    Dan and Landis are joined by Steve Simmons who is the co-founder of @NilPartners and a former D1 rower at Colgate University. (49:30) Steve talks about the biggest issues in college sports surrounding transfer portals and how the collectives with NIL are impacting student-athletes. Steve also discusses the impact and pressures that NIL is placing on athletes to succeed, epecially in the context of mental health.

    College Sports Law: SCOTUS to the NIL Era May 10, 2022

(8:25) They break down the latest in the Name, Image, and Likeness space. What is going to happen with the collectives that are occurring? They also discuss the landscape of high school NIL laws.

    Adam Dale joins (24:00) who is an Associate at Winston & Strawn LLP in NYC. Adam worked on the Alston v. NCAA case and discusses his experience working on the case. Adam breaks down the historical SCOTUS ruling and how it relates to NIL.

    MLB Antitrust Exemption Lawsuit; Brian Flores Class Action Update; Sports Lawyers Association Conference May 05, 2022

    The Dans discuss the recent updates in the Brian Flores v. NFL class action lawsuit following the initial status conference with the Judge. (3:15) They discuss what to expect seeing forward with the motion to compel arbitration, and who that arbitrator might be due to the bias of Roger Goodell.

    We are joined again by Jim Quinn (20:30) to discuss updates in his case against the MLB and its antitrust exemption. Jim discusses the recent motion to dismiss filed by the MLB and his arguments for the strength of his case, as well as the impact of striking down the MLB antitrust exemption. Jim gives his take on the lockout and CBA negotiations of the MLB. The last time Jim was on he discussed his Oakland relocation lawsuit against the NFL and gives an update here.

    We are also joined by Gregg Clifton (@Gregg_Clifton) who is a sports law attorney and prior MLB agent to discuss the wild wild west of NIL. (47:48) Gregg also discusses the upcoming Sports Lawyers Association (SLA) Conference in Atlanta.

    Trevor Bauer Suspended; Isaiah Wong NIL Controversy May 02, 2022

    Isaiah Wong (27:25) is a basketball player for the University of Miami and a statement was released that he was unhappy with his current NIL compensation and if he did not receive more compensation then he would enter the transfer portal. Will there be more hold-outs, similar to what we see in professional sports? Dan and Tarun discuss the current NIL landscape.

    Jerry West & Trevor Bauer Defamation; Yankees Letter with Evan Drellich Apr 28, 2022

    The Dans and Mike break down the potential Jerry West defamation lawsuit against HBO for their series "Winning Time." (1:51) Is there enough merit to West's claim to show actual malice for the way he is portrayed in the series?

    Trevor Bauer (12:58) has brought a defamation lawsuit against the woman who made sexaul assault allegations against him and one of her lawyers. We discuss the merit of this lawsuit and the burden of actual malice.

    We are joined by Evan Drellich (@EvanDrellich) of The Athletic (19:42) to break down the release and contents of the unsealed Yankees letter surrounding the sign stealing scandals. Evan discusses what this letter actually means for how MLB handled the investigation.

    Dan Snyder & Commanders with Washington Post's Nicki Jhabvala Apr 20, 2022

    The Dans are joined by Nicki Jhabvala (@NickiJhabvala) from the Washington Post (4:51) to break down the latest financial allegations against Dan Snyder and the Washington Commanders. Nicki dives into her coverage of the Washington Commanders and Dan Snyder from the beginning of the allegations a couple years ago to the present. Nicki takes us through the Commanders' response to the financial allegations and the credibility of ex-employee Jason Friedman. Nicki talks about the pressure from other NFL owners and the potential vote out of ownership of Dan Snyder.

    The Dans also went head-to-head this week in our latest episode of Bench Points (rebranded from Opening Arguments) talking about the latest in the Washington Commanders legal troubles.     FTC v. Commanders; 18 Other Watson Masseuses; and $120M Oregon Ducks Football Trial Apr 14, 2022

    Dan Lust, Mike and Tarun dive into this week in sports law.

    The Washington Commanders continue to be under fire for their cooking the books allegations. (6:39) The FTC has now been brought in to investigate, and there are more allegations that fans' season ticket deposits were also being kept illegally.

    Deshaun Watson's civil cases are moving forward with discovery. (19:33) The scheduling order has come out that no trial shall be scheduled from August 1, 2022 through March 1, 2023 (vis-à-vis the NFL season). There has also been a discovery ruling that Deshaun Watson must disclose his relationships with the 18 masseuses who testified in his favor.

    The lawsuit against the NCAA and Oregon trial began this week. (29:44) Doug Brenner, a former OL with Oregon football has brought suit against the NCAA, Oregon, and former Oregaon head coach Willie Taggart for $120 million dollars in combined pain and suffering and punitive damages. The allegations stemmed from the 2017 season in which the players pre-season strength and conditioning sessions were physical punishment and caused a number of health issues for players.

    We brought on Kevin Darby (@KODarby) who won the inaugural Conduct Detrimental March Madness bracket. (43:53) Kevin talks about his interesting path to law school.
