    Alex Murdaugh Status Hearing For New Trial Part 2 Jan 16, 2024
    Show notes Alex Murdaugh, convicted of murdering his wife and son, appeared in a pre-trial public status hearing on Tuesday. The judge discussed the upcoming hearing later this month, which will determine if Murdaugh should be granted a new trial.
    In October, Murdaugh's legal team filed for a new trial, arguing that the court clerk had unduly influenced the jury during his trial for the murder of his wife and younger son. At the pre-trial hearing, the defense presented reasons for an evidentiary hearing, while the state contended that such a motion should have been filed within 10 days of the verdict. They also claimed the defense was aware of the clerk's alleged misconduct before this deadline.
    Former South Carolina Supreme Court Chief Justice Jean Toal, who replaced Judge Clifton Newman in the case, emphasized the need for factual evidence. Toal faces the decision of whether to repeat a six-week murder trial that involved over 70 witnesses and around 800 exhibits. She was appointed by the state's highest court to manage the significant decision of a retrial.
    Central to the defense's appeal are claims that Colleton County Clerk of Court Becky Hill tampered with the jury, influencing their verdict for personal gain. Allegations include Hill questioning jurors about Murdaugh's guilt, discrediting his testimony, and accompanying jurors to post-trial media interviews in New York City. Hill has denied these accusations.
    Toal will also decide if jurors can testify privately for their protection. The defense is scheduled to present evidence in a three-day hearing starting January 29.
    Murdaugh is currently serving a life sentence without parole for the June 2021 murders, plus an additional 27 years for financial crimes, including stealing about $12 million.

    Will Becky Hill's Actions Set Alex Murdaugh Free? Jan 12, 2024
    Show notes As the date for the pivotal evidentiary hearing approaches, questions swirl around the possibility of a new trial for Alex Murdaugh. Central to this debate is Becky Hill, whose character and actions as the clerk of court have come under intense scrutiny. Psychotherapist and author Shavaun Scott joined Tony Brueski on the "Hidden Killers" podcast to dissect the implications of Hill's conduct on the trial's integrity and Murdaugh's fate.
    Hill's alleged jury tampering and a slew of other accusations including plagiarism, improper use of office, and her son's involvement in wiretapping, paint a concerning picture of her ethical standing. "It looks horrible," remarked Scott. "It's so traumatic...to think we're going to have to go through this again. But it does increasingly look terrible."
    The initial perception of Hill as a "nice lady" is now juxtaposed against allegations of serious ethical breaches. As Brueski noted, "There are allegations here about her cashing checks in excess of $10,000 in her own name that were made out to Colleton County." Scott suggested that this might reflect a long-standing pattern of behavior, raising questions about the integrity of other cases overseen by Hill.
    The conversation then delved into the psychological aspect of Hill's behavior. Scott emphasized the importance of patterns in predicting future actions. "People have patterns...and we can make a lot of guesses about what people are going to do in the future based upon what they've done in the past," she explained. This raises the possibility that Hill's actions in the Murdaugh case may not be isolated incidents.
    Interestingly, Hill has admitted to the plagiarism allegations, a move that might indicate her seeking leniency or perhaps a strategy to mitigate further damage. Scott pondered, "She may be doing that. She may do more of that as it becomes clearer that she's not going to be able to finagle her way out of it."
    As the discussion concluded, Brueski and Scott speculated on the upcoming hearing's outcome. With Hill's credibility increasingly in question, the hearing's results could significantly impact Murdaugh's future. "It will be very interesting to watch as it continues to unfold," Brueski noted, emphasizing the hearing's importance in determining whether Murdaugh receives a new trial.

    South Carolina Clerk of Court Faces Dual Investigations Amidst Controversy and Legal Challenges Jan 11, 2024
    Show notes Rebecca "Becky" Hill, the Colleton County Clerk of Court who gained notoriety during the high-profile trial of former-lawyer Alex Murdaugh, finds herself embroiled in a web of legal challenges and controversy as two separate investigations by the South Carolina Law Enforcement Division (SLED) come to light.
    The first investigation revolves around Hill's alleged improper interactions with the jury during Alex Murdaugh's trial for the murder of his wife, Maggie, and son Paul in early 2023. This development comes as a stunning turn of events for Hill, who initially garnered admiration for her charm, humor, and composure during the six-week trial that drew international attention to Walterboro, South Carolina.
    The second investigation centers on allegations that Hill utilized her elected position for personal gain, further complicating her legal predicament.
    The controversy surrounding Hill began to escalate in early September, following the release of her insider memoir about the Murdaugh trial, titled "Behind the Doors of Justice." Murdaugh's defense attorneys raised concerns in court filings, alleging that Hill had inappropriately influenced jurors, potentially compromising the integrity of the trial.
    Among the accusations were claims that Hill engaged in private conversations with jurors, denied them permission to take smoke breaks during deliberations, and instructed them "not to be fooled" by evidence presented by the defense team. Additionally, the defense contended that Hill had plotted to remove a juror she believed was not inclined to deliver a guilty verdict. These actions, the defense asserted, were aimed at enhancing the sales of a book Hill intended to co-author about the trial with Neil Gordon.
    In response to the jury tampering allegations, Hill vehemently denied any wrongdoing and submitted a sworn affidavit refuting more than two dozen accusations outlined in the defense's motion. She enlisted the legal representation of State Rep. Justin Bamberg and former assistant U.S. attorney Will Lewis to navigate the legal challenges.
    However, Hill's troubles continued to mount. In November, her son, Jeffrey Hill, who served as Colleton County's technology director, was arrested and charged with wiretapping. The South Carolina Attorney General's Office assumed jurisdiction over the case, and Jeffrey Hill was subsequently terminated from his employment.
    The release of a trove of Hill's emails just before Christmas added further complexity to the situation. Among these emails, co-author Neil Gordon discovered evidence of plagiarism, as Hill had lifted parts of the introduction of her book from a BBC article mistakenly sent to her. In response, Gordon pledged to donate a portion of his book profits to charity, and the publication of the book was halted.
    With the looming three-day court hearing beginning on January 29, where allegations of jury tampering will be aired, Hill faces significant credibility challenges. Lawyers familiar with the case have suggested the possibility that Hill may invoke her Fifth Amendment right not to testify. This series of legal and ethical challenges has cast a shadow over Hill's previously admired reputation and brought her to the forefront of the ongoing legal saga surrounding Alex Murdaugh.
