Slam the Gavel welcomes back Karielee Barrere to the podcast. She was last on Season 3, Episode 113 and Season 4, Episode 50. Joining us briefly was Phillip Simon who was last on the podcast Season 5, Episode 17. We discussed the corrupt Family Court system in San Diego, California and those involved entertaining the deceit.
Apparently Karielee and Phillip had the same judge, Sharon L. Kalemkiariam who is nicknamed, "The Closer." So if your case is running a lengthy amount of time, even if she is out of her jurisdiction, she flat out doesn't care. We also talked about Judge Michael T. Smyth who is very guarded about letting there be recordings in the Family Courtroom although they run continuously in Small Claims Court.
Karielee discussed what parents go through as they have to pay $500.00/per hour for a Court Reporter, $2-3,000.00 for the transcript and $700.00/per hour for an attorney only to not receive justice.
This was a highly informative podcast on the goings on in San Diego, that brags about caring for the vulnerable. Karielee explained what a Peremptory Challenge is, how to file a Peremptory Challenge and Karielee's solution to avoiding judges.

Phillip Simon Speaks Out On Being Falsely Imprisoned Within His Own Home, A False DVRO And A Family Court Trying To Force Him Into Bankruptcy Oct 21, 2023

Slam the Gavel welcomes Phillip Simon to the podcast. Phillip is a Veteran, serving his country in both the U.S. Air Force and U.S. Army. Phillip served during OEF & OIF and for his efforts he received a Bronze Star. However, veteran Phillip Simon also had sustained injuries from those efforts that has left him with permanently disabled and suffering with PTSD, 100%. PHILLIP DOES NOT HAVE A CRIMINAL RECORD.
There was a "Kick Out" order issued on 7-29-2021 on his ex-wife and her sister who already had Temporary DVRO's against them. However, on 8-3-2021 The San Diego County Superior Court FAMILY LAW DIVISION allowed the two women to move back into Phillip's home just five days after kicking them out despite his attorney's objections. This shows DIRECT PROOF that the SDCSC acted with BIAS and PREJUDICE against THIS VETERAN from then on EVER SINCE.
The San Diego County Superior Court (SDCSC) continues to be prejudice and bias against all of Phillip's attempts to find a redress to end his unnecessarily high divorce conflict case. SDCSC made the VETERAN'S house the NUMBER ONE issue needing to be addressed in the divorce dissolution. For almost THREE YEARS, the SDCSC have fought against Phillip keeping his case, house and/or property FALSELY within their jurisdiction when it has clearly been proven by federal law, statue and official court transcripts that it is not.
Phillip Simon has filed an action in the United States District Court, Southern District of California (USDC, SDC), against the Superior Court: Simon v. Superior Court of California, County of San Diego, Case No. 23-CV-00889 for Fraud Upon the Court.
Evidence Phillip is seeking within the family law case has been denied to him per his public records request because of the current federal lawsuit pending, officially making the SDCSC an adversary against Phillip. The SDCSC (trial judges) refuses to acknowledge any awareness of the pending federal case and continues to exact revenge and punishment against Phillip while the federal case is still pending. An immediate injunction is needed because the SDCSC (Family Law Division) has ruled against a long standing federally protected statute and now rules Phillip's DISABILITIES are NOW considered COMMUNITY PROPERTY. The SDCSC is using this time to continue to violate Phillip's CIVIL RIGHTS in hopes to take his house away (leaving the veteran BANKRUPT AND HOMELESS) before the USDC, SDC responds to the pending FRAUD UPON the COURT CASE.

Melissa Vagle Discusses How Divorce Doesn't End With Divorce And How The Red Flags Of Abuse Become Normalized Oct 18, 2023

Slam the Gavel welcomes Melissa Vagle to the podcast. She is a mother with three children. Melissa served in the Army National Guard for almost six years when she met her second husband while she was still a soldier. At 22 years of age when they met there were the red flags that went unrecognized prior to their marriage that lasted 20 years.
Going through a grueling three year divorce, Melissa has had the same judge preside over it. Melissa had to rethink her future soon after her mother died in August 2019 and decided to file for divorce when her ex-husband stated not only to Melissa, but to the children as well, that her mother, "deserved it."
Wanting to learn more about the system, Melissa wanted to help others with their cases, so she became a Notary Public and then a Certified Paralegal with the goal to be an ADVOCATE in these areas.
Two of her children have special needs and her other child has mental health issues. Melissa states that going through her long divorce and now SEPARATION ABUSE has shown her so much.
Homeschooling her children for eleven years has forced Melissa to become good at researching. Her own personal experience in having to deal with abuse before, during and after marriage/divorce has afforded her the opportunity to help strangers that have now become her friends.
Melissa encourages others to, "ALWAYS GO WITH YOUR GUT, and ask your friends their thoughts on an incident that has occurred in your new relationship to see what their take on it is so you can catch an odd behavior early on and when a new person in your life begins to blame you for something , it usually means they are doing something."

Slam the Gavel podcast welcomes back Claudia Ovalles to the podcast. Claudia was last on the podcast Season 2, Episode 46 and Season 4, Episodes 33, 86 and 130. She had great news to tell listeners that in Texas HB 969 will take affect September 1, 2023 has been passed on a municipality enacting an ordinance on creating a civil penalty for child custody orders. This will take affect September 1, 2023.
We discussed the awareness of the campaign, #itsnotacivilmatter and the importance of accountability for parents as well as law enforcement. #itsnotacivilmatter is the number one response by law enforcement. This will be changing. ACCOUNTABILITY is coming and it is CRIMINAL to withhold a child from the other parent. This is a FELONY and each state has to understand their laws.
We also talked about Time Taken, Time Back, SB718, and how Robert Garza implemented this bill and is working on getting it into other states as well.
October is Domestic Violence Awareness Month. Law Enforcement needs training on both these bills as these Custodial laws have been on the books for 40 years. This has a drastic affect on the children going through this, as they need to see both parents, provided that abuse is not in the picture.

Brian wrote the forward to my book, "Raised By These Wolves, How Family And Federal Courts Are Failing Our Children." On the last podcast we had discussed the Secret Society, The Infected System Of The Judiciary And Judges On The Take.
Brian Vukadinovich gave updates to his case and explained how he had served as executive director of The Posner Center of Justice for Pro Se’s based in Chicago, Illinois for retired federal court of appeals judge Richard A. Posner.
We also talked about the "KIDS FOR CASH," case in Luzerne County, PA, where both judges Michael Conahan and Mark Ciavarella had been convicted of receiving monies while imposing egregious decisions on juveniles in order to increase the residence at the PA Child Care for-profit detention centers.

Parental Alienation is where another parent, relative or carer is deliberately trying to DAMAGE the relationship with a Target Parent's child and this can even result in the Target Parent having NO CONTACT with them.
Parental Alienation is insidious, counter intuitive, misunderstood and is traumatic for both the child and the Target Parent and their relatives that are being alienated.
Charlie McCready teaches parents how Parental Alienation is having an IMPACT their children, why they are demonstrating particular behaviors, how to ADAPT their parenting styles and REBUILD those precious BONDS with their children they once had.

Supreme Court Attorney T. Matt Phillips Speaks Out On Bringing The Constitution Back Into The Courtrooms Or The Families Will Oct 09, 2023

Slam the Gavel welcomes back Supreme Court Attorney, T. Matthew Phillips. Attorney Phillips was last on the podcast Season 3, Episodes 137 and 152. We discussed this brilliant, unique and one- of-a-kind CLASS ACTION LAWSUIT that is including ELEVEN families.
The named Defendant is the Judicial Council of California, which is the policy making body that trains judges. The Plaintiffs are arguing that there is no Constitution in the California state court system, particularly in the "Family Court." They don't recognize that the Constitution exists and yet the Constitution is supposed to be the SUPREME LAW OF THE LAND. The judges and the Attorneys are not arguing the Constitution.
Attorney Phillip's Clients are arguing that Parenting is a fundamental right and Constitutional right that is protected under the 14th Amendment. They believe the judges in California NEED TO BE TRAINED in this and need to know and understand that PARENTING is a FUNDAMENTAL RIGHT. They can't take away custody and parenting time unless a parent is actually found UNFIT with ACTUAL EVIDENCE found in a fitness hearing not in a divorce proceeding.
The parents contend that they are having their FIRST and FOURTEENTH AMENDMENTS violated. In the FIRST AMENDMENT, it protects FAMILIAL ASSOCIATION, the right to association and private speech. The FOURTEENTH AMENDMENT, protects the RIGHT TO PARENT. However, parents are being ROBBED of PRIVATE SPEECH with their children, especially in SUPERVISED VISITS. The GOVERNMENT is in control and LISTENING and it's a HUGE VIOLATION of the FIRST AMENDMENT right to familial association.
Parents involved in custodial rights are getting their children taken away based on standards that fall below the minimum Constitutional standard. Once the CONSTITUTIONAL STANDARD drops below the minimum, they believe the federal government should get involved to protect these federally protected civil rights.
This is a different lawsuit as they are not suing judges; they are suing the Judicial Council. The judges are not recognizing the Constitutional Parameter and the judges are just exercising arbitrary discretion.....
