    Oral Arguments, with Context

Real court arguments, crisp audio, with context. Court recordings can be difficult to follow, and many suffer from poor audio quality. This podcast enhances the audio, provides a brief introduction to each case, and explains legal concepts that may be unfamiliar to some listeners. We hope these enhancements make oral argument recordings easier to understand, more accessible, and more enjoyable to listen to. Recordings come from the courts’ own public releases; Supreme Court timing is derived locally from the Court’s official transcript and audio.

    Show notes

The Fifth Circuit hears cross-appeals from a trade-secret trial between competing freight brokers. Pittsburgh Logistics Systems will argue that the trial improperly reopened whether its customer list was a trade secret and that it is entitled to a new trial. Glen Rose Transportation Management will defend the jury's verdict and pursue litigation costs that the district court has not yet ruled on. Pittsburgh Logistics Systems v. Hayatullah Zahid v. Todd Blanche — 5th Cir. (Aug 31, 2026) Sep 03, 2026
    Show notes

The Fifth Circuit hears two consolidated petitions from Hayatullah Zahid, a former Afghan education official seeking protection from removal under the Convention Against Torture. An immigration judge found past persecution but denied that protection. The Board of Immigration Appeals affirmed, declined to send the case back for new evidence, and later denied reconsideration. The court will examine whether the agency adequately considered the record and properly handled Zahid's new evidence. Hayatullah Zahid v. Louisiana Bucket Brigade v. Louisiana Department of Environmental Quality — 5th Cir. (Aug 31, 2026) Sep 03, 2026
    Show notes

The Fifth Circuit reviews three emission limits in Louisiana's permit for Venture Global's CP2 LNG terminal. Louisiana Bucket Brigade and Sierra Club will contend that LDEQ never explained why the turbines at CP2 could not meet lower limits used at grid-connected plants. LDEQ and Venture Global will answer that the isolated power island and fuel mix at CP2 support those limits. David Bookbinder represents the groups. Louisiana Bucket Brigade v. Jackson Federation of Teachers v. Fitch — 5th Cir. (Aug 31, 2026) Sep 03, 2026
    Show notes

The Fifth Circuit reviews a preliminary injunction against parts of Mississippi House Bill 1193, a law governing how public schools address race and sex. The challengers say the provisions are vague and chill speech; Mississippi calls the tests wrong and the relief overbroad. The panel also considers reassignment after a law clerk used AI while drafting a temporary restraining order filed before review. Mississippi Deputy Solicitor General Anthony Shults will ask the court to vacate the injunction. Jackson Federation of Teachers v. Ramirez v. Guerrero — 5th Cir. (Sep 1, 2026) Sep 03, 2026
    Show notes

The Fifth Circuit considers whether Juan Ramirez may appeal the rejection of two federal habeas claims. One concerns mental-health evidence at sentencing; the other uses later evidence to challenge his confession. A certificate of appealability permits an appeal to proceed if reasonable jurists could debate the district court's ruling. Assistant Federal Public Defender Jennifer Garcia will represent Ramirez. She will argue that state courts never decided the first claim and that both warrant further review. Ramirez v. The Fifth Circuit considers whether cocaine found at a fixed immigration checkpoint should have been suppressed. Border Patrol agents sent Walter Houze's vehicle to secondary inspection, where a dog alerted and agents found cocaine. Kathryn Shephard will represent Houze. She will argue that agents used the checkpoint for drug enforcement without reasonable suspicion and continued detaining him after he withdrew consent. United States v. The Fifth Circuit considers who should pay the legal fees caused by moving a Texas Tylenol lawsuit into federal court. Texas alleges that Johnson & Johnson and Kenvue violated state consumer law in marketing Tylenol. The judge sent the suit back to state court but denied Texas its fees. Ashley Keller of Keller Postman will represent Texas. He will argue that removal lacked an objectively reasonable basis and that the judge used the wrong legal standard. State of Texas v. The Fifth Circuit hears a payment dispute over cleanup after Hurricane Laura. Poor Boy Tree Service and Mobile Help 4U say Winnfield owes them for the work. The district court ruled for the city without a trial, finding no enforceable contract or open account. Colby Lane Bowman will represent the contractors. He will argue that Louisiana's emergency provisions allowed city officials to arrange the work and that the claim should go to trial. Poor Boy v.
