    Episode 36 Justice Without Peace? Jul 13, 2016

Can there be peace…when there is no justice? this past week we saw, yet again, another example of SENSELESS loss of life. Will we see these two police officers let off the hook, for what looks to many, like complete abuse of power? When we see white officers of the law, in most of these cases, overpowering a black man either by physically wrestling him to the ground with three or more people and then shooting or taking him, or as in other cases, shooting them dead in the street….you have to ask the question…. are these cases of an abuse of power and authority? Or are they….simply mistakes? Tonight there is a distinct theme as we look at how is justice actually carried out in this country? Because there seem to be different rules for different people…. Native News: Medical Marijuana Company Lead Sponsor at Gathering of Nations Vincent Schilling 7/6/16 Ultra Health, a national provider for the healthcare cannabis industry with operations and facilities in Arizona, Nevada, and New Mexico, and retail dispensaries to commercial-scale cannabis production in New Mexico and Las Vegas has become the title sponsor for the Gathering of Nations Powwow for 2017. In addition to the sponsorship, the official name of the event will be the "Ultra Health - Gathering of Nations." This marks the first time a medical cannabis company has sponsored such an event. Ultra Health has agreed to the title sponsorship for the next five years and holds an option to consider sponsorship through 2027. "The Gathering of Nations Powwow is a very spiritual and social celebration," said Duke Rodriguez, CEO and President of Ultra Health in a company release. "At Ultra Health we believe such components are vital to well-being, and sponsoring the event was an obvious decision in light of the importance Native people have historically put on healing and natural medicine." Deborah White Plume, whose husband, Alex White Plume has been an advocate for the growing of hemp for decades, says she has mixed emotions about the sponsorship. “First of all, I am curious what the organizers get for sponsorship. But ultimately though I use medical marijuana, I feel this is an exploitative and corporatizing of Native people. I think it would be friendly and respectful if Ultra Health took their name off of the event name, otherwise, it is just another exploitative and oppressive gesture to the red nation.” http://indiancountrytodaymedianetwork.com/2016/07/06/medical-marijuana-company-lead-sponsor-gathering-nations-165042 A deconstruction of Ultra Heath’s promotional video On the Ultra Health website, they have a promotional video which is VERY pro-native. but not in a goo way. It features a slogan at the beginning which states “In an Industrial World, what is Healthy?”. From that point on, visuals include shots of the New Mexico countryside, then shots of native traditional drummers, and dancers, then a shot of what looks to be more like a coffee shop from new England, then back to shots of a white girl doing aerobics, and then of a black man running, then a bit more concerning is a shot of native children when the voiceover mentions “spirituality”. Then next transitioning to a shot and soundbite of a woman talking about the fact that cannabis is now legal and seen as a medicine.” As she is saying this, there is a shot of a Navajo woman who is unboxing what appears to be “Ultra Heath chocolate bars” which presumably have cannabis in them. it is also worth noting that the only people speaking or consuming cannabis in this video are white. But as these soundbites are used, shots cut back and forth to NATIVE people dancing, or drumming. There is even a tribal elder in a headdress dancing. The music in this video is also very questionable. Possibly a producers concept of what they think is “contemporary native music.” It’s way off base. Another concern: On Sept. 11, 2014, about four years after it earned one of the first nonprofit producer’s licenses in the state and set up shop in Santa Fe, New Mexico Top Organics founders—Peter Ferrara, Mark Baker, and their wives, Christina Ferrara and Annie Campbell—signed over 100 percent of the nonprofit dispensary’s revenue to Ultra Health, LLC, a for-profit management firm working in three states. At the helm of the Arizona-based business is Duke Rod­riguez, a former chief financial officer for Lovelace Medical Center, who helped transition the hospital from a nonprofit facility to a for-profit organization and who also served as Human Services Department cabinet secretary under then-Gov. Gary Johnson. Dispensary and cultivation management contracts provided to SFR by the New Mexico Department of Health show that the parties agreed to a 30-year deal granting Ultra Health use of the nonprofit’s license to staff, manage and operate dispensaries around the state in exchange for Ultra Health returning up to $12,500 per calendar year to the nonprofit entity for its “exclusive use and/or charitable purposes.” Ultra Health wouldn’t say how the money was used last year, which individuals make that decision, or whether any other sums changed hands. Roberts today announced the approval of a $23.5 million loan guarantee to the Navajo Tribal Utility Authority (NTUA) that will allow it to acquire a greater ownership interest in NTUA Wireless, LLC, a telecommunications services company serving the Navajo Nation. The company is a partnership of NTUA and Commnet Wireless, a rural wireless service provider based in Atlanta, Georgia. “I congratulate the Navajo Tribal Utility Authority on becoming the majority owner of the largest tribal telecommunications company in the United States,” Roberts said. “The goal of the Indian Loan Guarantee Program is to build strong, sustainable tribal economies by supporting business development and expansion throughout Indian Country. Thanks to that program, the Navajo Tribal Utility Authority can move forward in building out the reservation’s telecommunication network for the benefit of the Navajo Nation and its people.” The loan guarantee, issued by the Indian Affairs Office of Indian Energy and Economic Development, enables NTUA to acquire a 51 percent interest in the telecommunications services company , making it America’s largest wireless/internet business primarily owned and operated by a tribal enterprise. Title: Comey: FBI didn’t put Clinton under oath By Stephen Dinan - The Washington Times - Thursday, July 7, 2016 Hillary Clinton was not put under oath and there is no transcript of her interview with the FBI, Director James Comey told Congress on Thursday. Mr. Comey said it’s still a crime if she lied to his agents — though he said he doesn’t believe that happened. Republicans have called for the FBI’s interview with Mrs. Clinton to be released so her public defense of her secret email system can be stacked up with what she told agents. But Mr. Comey said no transcript exists. Testifying before the House Oversight Committee, Mr. Comey revealed other new details both about Mrs. Clinton’s secret email account and about the parameters of his bureau’s investigation into it. He indicated they did see evidence that foreign governments tried to gain access to Mrs. Clinton’s server, though it’s impossible to know whether they succeeded. He said they didn’t find definitive evidence one way or the other. Mr. Comey also said Mrs. Clinton agreed to make herself available for the interview on Saturday, which lasted three and a half hours and involved about half-dozen agents. This is news that on this show we did not wish to have to give. We have this from two news sources…. CNN who wrote: “Bernie Sanders is poised to endorse Hillary Clinton at a campaign event Tuesday in New Hampshire, provided that final disagreements in the Democratic platform can be resolved during a weekend party meeting in Orlando, people familiar with the talks say. For three weeks, Sanders has been steadily walking closer to throwing his full support behind Clinton but has been withholding a formal endorsement until the platform is written. He repeated his pledge to help defeat Donald Trump again Thursday in an interview with Bloomberg View's Al Hunt.” Sadly, here on our show we truly held the belief that Bernie was staying in the race as there was the main question of Hillary Clinton possibly being indicted. I myself in particular (Michael) was completely convinced based on a recent chain of factual events: 1.) Bernie met with president Obama were (I believe) he asked Bernie to concede. Bernie didn't. I also believe that President Obama made it known at that time that he will campaign with Hillary. 2.) Bernie then met with non-presumptive nominee Hillary Clinton to discuss with her

Bernie Sanders addresses NCAI General Assembly Audio Source: National Native News Manning: Pushing Back Against Racist War Cry Mockery Sarah Sunshine Manning 7/1/16 While many Americans today are boldly leaning into social consciousness, other pockets of American society remain stubbornly swathed in the white supremacist cloaks of 1950 – an era when racism and bigotry were the celebrated norm. Enter, Boston-based radio show host, Howie Carr, who recently opened up a Donald Trump rally in Bangor, Maine, with an all-too American mockery of Native Americans while referencing Elizabeth Warren, who claims Cherokee ancestry, And the crowd loved it. Men turn toward each other laughing in amusement, while someone in the crowd even cheers with a loud whistle of support. A racist rally is a good ol’ time for those Trump Republicans. But let’s just be clear – this particular critique of yet another charade at the Trump circus isn’t about Trump the Clown or his clown accomplice, Howie Carr. Nor is this critique about Elizabeth Warren, who has failed to adequately address her questionable Native American identity. Instead, this critique is about the hand-over-mouth mockery and the degree of complicity behind it at the recent Trump rally, which is indicative of a much greater social problem – accepted racism, bigotry, and more specifically, the long-standing history of dehumanizing and demeaning Native Americans, while the masses stand by, complicit, and often amused. This is the 26th in a series of 44 stories exploring past presidents’ attitudes toward Native Americans, challenges and triumphs regarding tribes, and the federal laws and Indian policies enacted during their terms in office. When Theodore Roosevelt took office in 1901, he already had a long legacy of animosity toward American Indians. Seventeen years earlier, Roosevelt, then a young widower, left New York in favor of the Dakotas, where he built a ranch, rode horses and wrote about life on the frontier. When he returned to the east, he famously asserted that “the most vicious cowboy has more moral principle than the average Indian.” Roosevelt’s seven and a half years in office were marked by his support of the Indian allotment system, the removal of Indians from their lands and the destruction of their culture. In his first message to Congress, in December 1901, Roosevelt called the General Allotment Act “a mighty pulverizing engine to break up the tribal mass.” Under the act, passed in 1887, more than 60,000 Indians had already become citizens, but “the effort should be to steadily make the Indian work like any other man on his own ground,” Roosevelt said. “In my judgment the time has arrived when we should definitely make up our minds to recognize the Indian as an individual and not as a member of a tribe,” he said. “The Indian should be treated as a individual—like the white man.” But Indians were not equal to whites, Roosevelt told Congress. He has consistently demonstrated that he is no friend to minorities as a whole. But tonight we are going to focus a bit on Indian country, and what we feel are concrete examples of why many native people feel this way. But some people may be wondering why suddenly there is this surge of Trump attacks against native people? Many people only know Donald Trump though his Television show “The Apprentice”. Others only know him as New York Business man. But myself, I know Donald J Trump because of his dealings with close tribal relatives of mine. Relatives that Donald Trump sought to exploit. You see, shortly after the opening of Foxwoods Resort Casino, which is owned and operated by my tribe, the Mashantucket Pequots , other tribes here in Connecticut were also pursuing Federal Recognition. R. Lee Fleming, the director of the Office of Federal Acknowledgement, said "the only available remedy" now available to the Historical Eastern Pequot Tribe in North Stonington and the Schaghticoke Tribal Nation in Kent is Congress passing legislation granting them federal recognition. Fleming sent similar letters to the Eastern Pequots on June 2 and the Schaghticokes on April 25. The recognition would make the tribes eligible for federal aid for such things as housing, health care and education. It also would give them the ability to pursue economic development, such as casinos. Richard Velky, chief of the Schaghticoke Tribal Nation, said the letter sent to his attorney came as a complete surprise. He said the tribe does not have any applications currently pending. "I was taken aback.  This election has so far seen a variety of caucus-related issues, primarily, it seems, on the Democratic side. Another such case, this time regarding the Colorado caucus, has just been revealed, thanks to reporting by The Denver Post. On April 12, the Colorado Democratic Party admitted to miscounting the results in ten percent of the state’s precincts in caucus. The Denver Post discussed in detail the potential consequences of this miscount: ‘The mistake is a minor shift with major implications. The new projection now shows the Vermont senator winning 39 delegates in Colorado, compared to 27 for Clinton. Even if Clinton wins all 12 superdelegates in the state, Sanders can finish no worse than a split decision. The new count contrasts with prior projections from The Post, Bloomberg Politics and The Associated Press that indicated Clinton would probably win the majority of the 78 delegates in Colorado because of her support from party leaders with superdelegate status. If Sanders lands one Colorado superdelegate — two are still undecided and others are facing significant pressure — he could win the state’s delegation.’ What is most controversial about this issue isn’t the fact that a mistake was made, but the fact that a mistake was made and the Colorado Democratic Party tried to cover it up rather than fix it. The news is: The Eastern Pequot Tribe has renewed its pursuit of federal recognition, a crucial status it won in a 2002 Bureau of Indian Affairs decision that was reversed three years later. In a petition sent last month to the BIA, the tribe — identifying itself as the “Historical Eastern Pequot Tribe” — asks the agency to “declare and reaffirm” its status as a “Previously Federally Acknowledged Tribe.” Summary: Taken from the article. What does this mean for The Eastern Pequot Nation? Following a lengthy overhaul of the federal-recognition process, the Interior Department adopted new regulations last year that many believed would preclude the Eastern Pequots and other tribes that had been denied recognition from resurrecting their claims. “Any petitioner that was previously denied Federal acknowledgment under this process may not re-petition,” the Interior Department announced. “This includes any petitioners that have reorganized or been renamed or that are wholly or primarily portions of groups that have been denied under these or previous acknowledgment regulations.” The Easterns’ petition, submitted by James Benny Jones Jr., a Washington, D.C.-based attorney and a member of the tribe, contends that the Historical Eastern Pequot Tribe “has never previously petitioned for Federal acknowledgment as either the Historical Eastern Pequot Tribe or under its constitutional government of the Eastern Pequot Tribal Nation.” Jones did not respond to phone and email messages seeking comment. In 2002, the BIA acknowledged the Eastern Pequot Indians and the Paucatuck Eastern Pequot Indians as one group, the Historical Eastern Pequot Tribe. The state and the towns of Ledyard, North Stonington, and Preston joined a challenge of the decision, prompting the Interior Board of Indian Appeals to review it. The Interior Department announced in October 2005 that it declined to recognize the Eastern Pequots and the Paucatuck Eastern Pequots, ruling that both tribal factions failed to meet two of seven mandatory requirements for acknowledgment. The department found that the state’s recognition of the Historical Eastern Pequot Tribe did not constitute evidence that the tribe had existed as a “community” or that it had maintained “political authority and influence” over its members from historical times to the present. Article 2: Mashpee Wampanoag Tribe of Massachusetts isn't worried about a lawsuit filed by casino opponents. Opponents are asking a federal judge to halt construction but Chairman Cedric Cromwell said the facility is on track to open in the summer of 2017. "We do not see this lawsuit against the federal government as having any impact on our progress,' Cromwell told The Cape Cod Times. The tribe appears to be on the strong legal ground because the complaint in Littlefield v. Department of the Interior names the Bureau of Indian Affairs as the defendant. Due to sovereign immunity, the tribe cannot be sued without its consent. "In no other case has a court had to confront a sovereign tribe, put into immediate possession of trust lands, starting to construct a casino before any judicial review has occurred," attorney David Tennant, who is representing the casino opponents, said in an affidavit that was filed in support of a request to halt construction on the project. The BIA approved the land-into-trust application for the casino last fall and the land was declared a reservation in January. Summary: Once again, the attempts to halt Native progress is in full swing. It does not matter if it is wearing an Eagle feather at a graduation, or a project that will help Natives become, or stay self-sufficient. Even though I am not a supporter of Indian gaming, and there is a good reason why I am not a supporter, the fact remains, there are forces at work that are determined to halt ANY progress Natives try to make. That has been the case since contact. We were made citizens in our own country! 91 years ago, Congress passed and President Calvin Coolidge signed the Indian Citizenship Act, which stated “all noncitizen Indians born within the territorial limits of the United States be, and they are hereby declared to be, citizens of the United States: Provided that the granting of such citizenship shall not in any manner impair or otherwise affect the right of any Indian to tribal or other property.” Only a non-Native would presume and assume the right to decide the fates of those who they have no right to judge, rule, or treat less than human. The Clintons’ Haiti Screw-Up, As Told By Hillary’s Emails The family still doesn't know how to wield its own power. By Jonathan M. The Clinton’s own daughter was less than enthused with what she saw happening, and even less of what should have been happening. According to, Chelsea Clinton, and I quote: “The incompetence is mind numbing,” she told her parents. “The UN people I encountered were frequently out of touch … anachronistic in their thinking at best and arrogant and incompetent at worst.” “There is NO accountability in the UN system or international humanitarian system.” The weak Haitian government, which had lost buildings and staff in the disaster, had something of a plan, she noted. Yet because it had failed to articulate its wishes quickly enough, foreigners rushed forward with a “proliferation of ad hoc efforts by the UN and INGOs [international nongovernmental organizations] to ‘help,’ some of which have helped … some of which have hurt … and some which have not happened at all.” End quote. You will see the media stating that Hillary Clinton only needs 70-90 votes to win. This is false because they are counting SUPER DELEGATES in those projections. They have been doing that since the beginning, and they are all wrong. Super delegates only vote AT the democratic convention in July. The media is purposefully inflating Hillary Clintons voter numbers to sway public opinion away from Bernie Sanders. The race is much closer between her and Senator Sanders. Then the context. The news is that Deborah Parker has been named to the Democratic National Convention’s Platform Committee. That’s both remarkable and important. She was appointed by Bernie Sanders. As Nicole Willis posted on Facebook: “I am beyond pleased that American Indian and Alaska Native issues are such a high priority for this campaign– so much that one of our platform spots has gone to Deborah Parker!” (Willis is the National Tribal Outreach Director for the Sanders’ campaign.) Summary: What does this mean for Indian country? Well, it could mean good things for Indian country IF everyone follows through, and people are not paying lip service to win the Native vote. Ms. Parker is respected, knowledgeable and a forward-looking individual when it comes to Native concerns. Here are some of her accomplishments. Ms. Parker, a former vice chairman of the Tulalip Tribes in Washington, was an early supporter of Sanders. Parker has much to offer any platform committee. First, she understands and can communicate the relationship between tribes and the federal government and what might be possible in terms of improvement. Second, Parker was a critical voice in the enactment of the Violence Against Women Act. Wait! I know! It USED to belong to Indians. They don’t exist any longer. WRONG! We do still exist. It is a common practice for non-Natives to sell articles that used to belong to their ancestors. I am not surprised they have no respect for the ancestors of Natives. Many cultures (European cultures come to mind), have no respect for other cultures, especially Native American culture(s). As, Mr. Bradley Marshall of the Hoopa Valley Tribal Council states, he called the auction “deplorable” and said “items are living beings that belong to their communities. Summary: Hillary Clinton failed to follow State Department rules involving her email servers. I am not surprised she failed to follow the rules. Positions of power sometimes lead to the assumption of “the rules don’t apply to me.” Clinton has failed to disclose that minor detail about her not following the Department rules. I am not sure she is not the only person to not follow the Department email rules, but she IS the only one running for the office of the President of the United States. I believe that is a detail she should have cleared up before deciding to run for office, again, and a problem that should disqualify her from running. Because it helps to substantiate, Clinton’s track record of not telling the truth. Here are a couple of quotes from one of her former supervisors, Jerry Zeifman, a now-retired general counsel and chief of staff of the House Judiciary Committee, who supervised Hillary when she worked on the Watergate investigation, and a lifelong Democrat, supervised the work of 27-year-old Hillary Rodham on the committee. “Hillary’s history of lies and unethical behavior goes back farther – and goes much deeper – than anyone realizes.” Why? “Because she was a liar,” Zeifman said in an interview last week. “She was an unethical, dishonest lawyer. Mrs. Obama received a gracious welcome as only Indian country can provide. Her comments were well-received by those who attended the ceremony of the graduating class of 2016. Congratulations to all of the Santa Fe Indian School, graduating class of 2016! To use a phrase the First Lady stated; “Our world needs you.”
