Why Savannah Guthrie Stopped Asking For Proof Aug 02, 2026
    Show notes

For six months, Savannah Guthrie's public messages to whoever took her mother Nancy followed the same pattern: proof of life, a willingness to talk, an open door. On July 27th, that pattern broke.
The new video dropped the demands entirely. In their place was something that sounded like acceptance rather than negotiation — and it landed the same week investigators couldn't agree among themselves on whether the case's ransom notes are genuine. One report called all of them fake. Another said some might be real. A third ranked the original two as more credible than not.
Tony Brueski connects the timing: a family's language shifting toward forgiveness right as the evidence underpinning the entire kidnapping theory came apart in public, three different ways, in the same week. He also covers Derrick Callella's guilty plea for posing as a kidnapper and sending fake messages to the family during an active abduction, the dozen separate Bitcoin-demand emails TMZ received from someone else entirely, and the DNA testing that began in February with no results shared five months later.
Retired FBI Special Agent Jennifer Coffindaffer has posted a ten-point challenge to investigators, including why the enhanced photo of the man known as porch guy has never been released.
Nancy Guthrie has been missing for nearly six months. Her daughter's words just changed. This episode covers why.

What Bryan Kohberger Wrote About His Own Lawyers Aug 02, 2026
    Show notes

Bryan Kohberger's guilty plea was supposed to close the Idaho student murders case. A handwritten petition filed from his cell on July 27, 2026 says otherwise, and it opens by turning on the three attorneys who kept him off death row.
Kohberger, representing himself now, calls their work ineffective. He argues he was convinced to falsely confess and that he agreed to the plea based on a gross misrepresentation of what life without parole would actually mean. He doesn't write that he's innocent. He writes that his innocence is his truth, which is a very different sentence to build a legal argument on.
Tony Brueski walks through what's actually in the filing, how a judge is likely to weigh a pro se petition against a plea that was entered in open court with Kohberger affirming it himself, and what changed in the twelve months between that plea and this reversal. There's also the detail that reached the New York Times before it reached his own mother — a choice that says something about who this petition is really for.
At sentencing, Kohberger stayed silent when Judge Hippler gave him the chance to speak. He walked past his mother without turning his head. Kaylee Goncalves' sister was sitting close enough to watch it happen.
This episode breaks down the petition line by line, the families it reopens old wounds for, and what happens next in a case a lot of people thought was finally over.

What Prosecutors Made Patrick Clancy Count In Court Aug 02, 2026
    Show notes

Patrick Clancy lost his three children on January 24, 2023. Now prosecutors have put him on the stand as their first witness against the mother of those children, and the exhibit they built the moment around was a bag of nine pill bottles.
Assistant District Attorney Shanan Buckingham told the jury this trial is not a conversation about how the medical system treats women. Then her office spent the afternoon walking Patrick through four months of prescriptions, one bottle at a time, asking how much was missing from each. The defense sees it differently — thirteen prescriptions from more than one prescriber in four months, with nobody adding it up until it was too late.
Tony Brueski breaks down what the state is actually trying to prove with that exhibit, why the defense might be just as happy to see it in front of the jury, and what it cost Patrick Clancy to be the one reading those numbers out loud in a courtroom.
There's also the detail almost nobody is talking about: the specific number Patrick gave investigators early on, the one that sent him to find his own attorney before this case ever reached a jury.
This is the exhibit both sides think proves their case. This episode covers why they can't both be right.

What Was On Celeste's Fingers Before They Vanished Aug 02, 2026
    Show notes

What was on Celeste Rivas Hernandez's fingers before prosecutors say two of them were removed. That's the detail sitting in a court brief that most coverage of this case hasn't touched, and it's the thread running through everything we cover in this breakdown of the d4vd preliminary hearing.
A call went out from David Burke's phone at 12:04 in the morning, from an empty stretch of road in Santa Barbara County, to Celeste's number, hours after prosecutors say she was already dead. An LAPD criminalist testified that Bluestar sprayed across a garage floor lit up on rubber mats, the bricks beneath them, a rowing machine, a tarp, a charging cord, and a trash bag of wipes. All presumptive positive. Defense attorney Blair Berk pushed back hard, getting the criminalist to admit she can't call it definitively blood, and raising two chainsaws that were never swabbed.
Then the hearing's final session. The medical examiner testified Celeste died from two sharp-force wounds and had been dead for weeks before her body was found. A detective walked jurors through her phone records, messages dating back to when she was eleven years old, close to fifty images labeled illegal material involving a minor, and texts from January 2024 showing she was thirteen and pregnant.
Her mother cried in the gallery through the testimony. Burke has pleaded not guilty to every count. The bindover ruling is expected soon. We take every piece of evidence the state put forward and hand it to the defense to answer. None of it lands on a jury's desk until a judge weighs every piece of it first.

What Bryan Kohberger Said Under Oath Sinks His Case Aug 02, 2026
    Show notes

A judge asked Bryan Kohberger, under oath, whether he was pleading guilty because he was guilty. He said yes. Thirteen months later, that exchange is the exact thing threatening to sink the petition he just filed to take it all back.
Representing himself, Kohberger filed a handwritten petition for post-conviction relief in Ada County District Court, telling the New York Times that his actual innocence is his truth and calling the investigators' account a work of fiction. Before any of that reached a court, he got to a prison phone and called a reporter. Not a lawyer. Not a filing. A newspaper. What followed has put the families of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin in a position they were promised in writing they'd never be in.
The petition alleges ineffective assistance of counsel, evidence his defense team failed to disclose, and a distorted picture of what a life sentence and death row would actually look like, with threats and false promises blamed for the original confession. He's also said he'd welcome prosecutors seeking the death penalty again if this goes to trial.
There's a procedural detail most coverage has skipped: the appeal waiver he signed never blocked a challenge to whether the plea itself was valid, which is the entire basis for this filing. The Goncalves family answered within hours, dismantling the petition point by point.
There was never a trial, never a cross-examination, and no motive was ever put on the record. We go through the filing, the phone call, and the sentence that may undo both. None of this gets decided by a headline. A judge in Ada County reads it next.

What d4vd Filmed Himself Doing Before Celeste Died Aug 01, 2026
    Show notes

There's a music video where d4vd drags a body across the floor and loads it into a car. Prosecutors now allege he did the same thing his character did, to a fourteen-year-old girl, and that overlap is the thread running through everything else in this case.
Before the fame, David Burke was a homeschooled teenager recording songs on an iPhone in his sister's closet, building an audience inside Fortnite lobbies. Prosecutors say that's also where he met Celeste Rivas Hernandez, years before either of them were adults, and the relationship kept going while no adult around either of them intervened.
At seventeen, signed to Darkroom and Interscope, Burke created an alter ego called Itami, pain in Japanese, an agent of chaos wearing a blindfold, a concept he traced to a manga about a detective whose alter ego commits the murders he then has to solve. He compared it to Tyler Durden. The videos put a bloody knife and a severed arm on screen.
Then the forensic testimony from the preliminary hearing. A trace analyst matched cuts on a garage pool to fragments on Celeste's clothing. DNA tied the Tesla and the home to her. A criminalist described blood scrubbed from the garage floor, steps from containers of fake blood. Cell tower records tracked Burke's Tesla to Santa Barbara County three separate times after she allegedly died.
Celeste went to Burke's Hollywood Hills home on April 23, 2025. She was fourteen. Her remains were found in his Tesla months later. Burke has pleaded not guilty to first-degree murder, illegal acts involving a minor, and mutilation of human remains. We go through the persona, the industry that profited from it, and the physical evidence now on the record.

What Lindsay Clancy Had Scheduled The Day Before Aug 01, 2026
    Show notes

Two opening statements, one courtroom, and a medical record that doesn't match either version cleanly. This is what jurors in the Lindsay Clancy trial heard on day one at Plymouth Superior Court, broken down clip by clip from both sides.
The prosecution's theory rests on a clock. A takeout order. A pharmacy stop. A phone call that lasted fourteen seconds. ADA Shanan Buckingham is arguing that this level of organization proves Lindsay Clancy knew what she was doing. The research on postpartum psychosis tells a more complicated story about whether a mind in crisis can still function and plan, and this episode goes through what that research actually says.
Then Kevin Reddington's defense opening, built around three claims the prosecution needs to hold together at once, that Lindsay Clancy faked being sick, faked a suicide attempt that left her paralyzed with a burst spinal fracture and every rib broken, and invented hearing voices. Reddington read the prescription chart into the record, thirteen medications across five providers in four months, and had Patrick Clancy testify that his wife told him about intrusive thoughts and suicidal ideation months before their children died.
There's also the detail sitting quietly in the middle of it all: an appointment on the calendar for the day before the deaths that the prosecution's opening never brought up. And a one-word choice, superficial, used to describe injuries that left her unable to walk. We also cover the Massachusetts legal standard from 1967 that could decide whether this ends in prison or a locked psychiatric facility. None of it gets resolved in an opening statement, and the trial is only getting started.

Nolan Wells' Pathologist Couldn't Rule Out WHAT?! Aug 01, 2026
    Show notes

An eighteen-year-old goes to a boat party on Horn Island for the Fourth of July. Two days later, a park ranger finds his body. The state calls it settled. His family's own pathologist won't sign off on that, and Ben Crump made the reason public at the NAACP National Convention: the second autopsy on Nolan Wells lists the cause and manner of death as undetermined, and non-accidental factors could not be ruled out.
The first autopsy, the one the state performed, retained his throat. The trachea, the hyoid bone, the laryngeal cartilage, the parts a pathologist checks specifically when compression might be involved. Whatever the state found in those structures has stayed with the state, and nobody outside a small circle of officials knows what it says.
Meanwhile, there's a viral clip everyone assumed showed Nolan in his last recorded moments, and one of the men who was physically in the water that day is now telling investigators that voice belongs to him. He said it in a statement before he ever said it out loud to a camera, which changes how you have to read everything that came after.
We lay out everything that's actually been released in this case against everything still sealed, including a Mississippi statute about autopsy access that almost nobody has mentioned on air. The district attorney has referred the case to a grand jury, which means subpoena power the sheriff never had, sworn testimony from everyone who was on that island, and phone records that don't get to be rewritten later. Retired FBI Special Agent Jennifer Coffindaffer explains what that phone evidence is likely to show and why Rasheem Carter's case, and Rankin County's history, matter to how this one plays out. None of this resolves on its own, and the grand jury is only getting started.

What Lindsay Clancy Warned Her Doctors She Was Aug 01, 2026
    Show notes

A jury is now seated in Plymouth Superior Court to decide something nobody fully agrees on: whether Lindsay Clancy was criminally responsible when her three children died. Eight days before it happened, she told her doctors what was going on inside her mind, and the record of what she said is now part of the case both sides are building.
The prosecution isn't disputing that she killed Cora, Dawson, and Callan Clancy. ADA Jennifer Sprague argues she mapped her husband's errand route on Apple Maps, calculated the window, and used exercise bands deliberately. To the Commonwealth, that's a woman who knew precisely what she was doing.
The defense doesn't dispute the deaths either. Kevin Reddington is arguing postpartum psychosis, backed by a medical record showing thirteen psychiatric medications in four months, an ER visit, a McLean Hospital admission, and a husband who told doctors she'd turned into a zombie. The court denied a motion to split the trial into two phases.
Then there's the whiteboard. Intubated and unable to speak after it was over, Lindsay Clancy wrote one question, and it's a detail that cuts straight to what this whole trial is trying to determine.
Patrick Clancy is on both witness lists, called first by the prosecution and expected to testify for the defense as well. He's filed a malpractice suit against her doctors and told a reporter he wasn't married to a monster. We also walk through the Andrea Yates case, where a first jury convicted and a second jury acquitted on strikingly similar facts, and what that means for a Massachusetts jury operating under an even higher legal bar. Two juries have looked at nearly identical facts before and split completely. This jury still has to choose.

Why Celeste's Parents Can't Explain The London Form Aug 01, 2026
    Show notes

Celeste Rivas Hernandez's parents signed a notarized document authorizing their daughter to travel to London for a week with d4vd. No family member accompanied her. She was thirteen or fourteen at the time. Defense attorney Blair Berk presented that form during the final day of the preliminary hearing — and it directly contradicts her father's public statement that he never had any contact with Burke.

The hearing ended with Judge Olmedo ruling there's enough evidence for trial on every count, including first-degree murder with special circumstances. The DA is weighing the death penalty. But the testimony that lingers is about the adults in Celeste's orbit — parents who took her phone away and called police, then signed permission slips for international travel with the man deputies had already told them was involved with their daughter.

Burke has pleaded not guilty. Celeste was fourteen years old when prosecutors allege she was killed.
