    Many have wondered if President Trump could ever be held accountable for his actions either while president or even before he held the highest office in America. It's no secret that Donald Trump is notoriously known as Teflon-Don for his savviness to evade civil or criminal liability for the many things he's been accused of, but this week we speak with a person who knows a thing or two about prosecuting Trump and his organization. Tristan Snell is the former Assistant Attorney General for New York, and successfully prosecuted Trump University which lead to a $25 million settlement; the largest settlement against the Trump family. They talk about the similarities between this case and the existing civil and criminal cases brought forth by New York AG, Letitia James, as well as the status of the January 6th commission investigation and how that might play out.

    Guest Bio:

    Tristan’s work includes successes in some of the most high-profile legal matters of the century – including the prosecution of Trump University (leading to a $25 million settlement), the Broadcom v. Qualcomm patent litigation (the largest in US history at the time, with a $1.2 billion victory for Broadcom), and landmark deals with Chase, Wells Fargo, and Walmart, among others.

    He has also started three businesses and served as a startup Product Manager, General Counsel, COO, and CEO, and he has represented dozens of startups and small to medium sized businesses, as well as early-stage venture funds, giving him a deep understanding of the special challenges facing high-growth businesses.

    Tristan graduated from Princeton University, where he was elected to Phi Beta Kappa, then received his law degree from the University of Virginia, where he was an editor of the Virginia Law Review. He later worked in the renowned intellectual property, appellate, and venture practices at WilmerHale, where he also worked on the Boumediene v. Bush team that won the first habeas writs for detainees at Guantanamo Bay. He served as a law clerk to the Hon. Eric N. Vitaliano, U.S. District Court Judge for the Eastern District of New York, and as Assistant Attorney General for the State of New York as a civil prosecutor and investigator in consumer protection.

    Tristan has appeared as a commentator on CNN and Cheddar, and as a contributing writer for CNN and the Washington Post. His work as a lawyer and founder has been featured in a wide array of media outlets, from the New Yorker to the Atlantic to Last Week Tonight with John Oliver.

    There are few people in the public sphere who can effortlessly navigate the space between faith, politics, and finance. One person that comes to mind is Jesus, second to that might be a close second. We speak with Dale Fickett, he's the President and Co-Founder of Open Trellis, which is an online community of business founders, volunteers and sponsors with a shared philosophy. A shared view about the power of the individual, and the strength in our joint efforts towards a sustainable economy. To Dale this is more than just a job, it's a passion, and one that he takes into his politics and his faith.     Mr. Fickett is a co-founder of Open Trellis, and the RVA Works initiative in Richmond, Virginia.     Fickett has previously worked in Capital Markets and Transactions Banking during his tenure with Accenture.     He has authored "Faith & Sustainable Economic Development," “Towards a More Just Economy” and co-authored both “Developmental Entrepreneurship in Sub-Saharan Africa: Assessing Financial and Social Returns” and "RVA Works - Empowering Entrepreneurs for Big Change." He served in economic advisory roles on the Governor's Social Enterprise and Impact Investing Working Group (Virginia), the U.S. Senate Small Business Productivity Award Panel, the Virginia Business Incubation Association, and the Virginia Catholic Conference.

    Fickett also serves as Chairman of the Haiti Committee - a humanitarian mission of the Catholic Church, providing microloans, education and health care in Carissade, Haiti. An entrepreneur at heart, earlier in his career he launched a venture in the retail chocolate industry. He holds an MBA magna cum laude, Villanova University, and a BSBA cum laude, LaSalle University. He is also holds a Series 65 securities license in the Commonwealth of Virginia, and serves as a Registered Investment Adviser (RIA).

    If you are a person of faith, especially a monotheistic faith, you probably have always thought of God as singular, and have even referred to God as a "He/Him", but is there another, more accurate pronoun to use? Mark Silk, Director, Leonard Greenberg Center for the Study of Religion in Public Life and Professor of Religion in Public Life, recently wrote an article called, "Why our preferred pronoun for God should be ‘they’" where he explores this topic in detail. We had a chance to chat with him and learn why his article seemed to strike a nerve among those who have commonly considered God's pronoun to be, well, less vague. We also talk about why he felt compelled to write a follow up article to his first one.

    Mark Silk graduated from Harvard College in 1972 and earned his Ph.D. in medieval history from Harvard University in 1982. After teaching at Harvard in the Department of History and Literature for three years, he became editor of the Boston Review. In 1987 he joined the staff of the Atlanta Journal-Constitution, where he worked variously as a reporter, editorial writer and columnist. In 1996 he became the first director of the Leonard E. Greenberg Center for the Study of Religion in Public Life and in 1998 founding editor of Religion in the News, a magazine published by the Center that examines how the news media handle religious subject matter. In June 2005, he was also named director of the Trinity College Program on Public Values, comprising both the Greenberg Center and a new Institute for the Study of Secularism in Society and Culture.

    Vaccine mandates, love them or hate them, they are most likely affecting you in some shape and form. But what exactly does the constitution have to say about mandates? On this episode, your political host, Will Wright, talks with Constitutional Professor Eric Berger about the constitutionality of vaccine mandates. Then they discuss a Supreme Court case that is often cited to justify mandates, Jacobson v. Massachusets, and lastly Will finally gets his chance to flex his knowledge of OSHA to the professor!
    Guest Bio:
    Professor Berger clerked for the Honorable Merrick B. Garland on the United States Court of Appeals for the District of Columbia Circuit. He then practiced in Jenner & Block's Washington, D.C. office, where he worked on litigation in several state and federal trial and appellate courts, including the United States Supreme Court. Professor Berger's matters there included cases involving lethal injection, same-sex marriage, the detention of foreign nationals at Guantanamo Bay, and internet obscenity.

    Professor Berger teaches Constitutional Law I (structure), Constitutional Law II (rights), Constitutional History, Federal Courts, First Amendment, and Statutory Interpretation. He also teaches a class for undergraduates on Legislation and Regulation. He has been voted Professor of the Year by the upperclass law students six times. He has also received the College Distinguished Teaching Award (in 2010), the Law Alumni Council Distinguished Faculty Award (in 2018), and the John H. Binning Award for Excellence (in 2019).
    Professor Berger's scholarship focuses on constitutional law. Much of his work explores judicial decision making in constitutional cases, with special attention to deference, fact finding, rhetorical strategies, and other under-theorized factors that help shape judicial opinions in constitutional cases. His article Individual Rights, Judicial Deference, and Administrative Law Norms in Constitutional Decision Making, 91 B.U. L. REV. 2029 (2011), was named the 2011 winner of the American Constitution Society's Richard D. Cudahy Writing Competition on Regulatory and Administrative Law. Professor Berger has also written extensively about lethal injection litigation.
    Professor Berger has testified in the Nebraska legislature about a variety of constitutional issues, including free speech, lethal injection, and the process for amending the U.S. Constitution. He is also the faculty advisor to the Law College's chapter of the American Constitution Society and to the Community Legal Education Project, which sends law students into Lincoln public schools to teach about the Constitution.

    Professor Berger served as Associate Dean for Faculty from 2016 to 2020.

    According to a recent study by John Hopkins University, 1 in 500 Americans have died from coronavirus since the nation’s first reported infection. Think about that for a second and after you do check how many friends you have on Facebook, Twitter, etc and see what that would equate to for you. If you knew that you could save their life, would you? This podcast was recorded with that one person in mind.
    We talk with Dr. Clay Marsh, the Coronavirus Response Coordinator for West Virginia. This state has the lowest vaccination record in the country, and his job is to find ways to change that and help West Virginia return back to normal. Our conversation is directly geared towards those who are unvaccinated. There is no talk of politics, or judgement for those who choose to remain unvaccinated, just straight talk out of the mouth of an expert. We discuss the following:

    Clay Marsh, MD, is West Virginia University’s chief health officer, and serves as a member of President E. Gordon Gee’s leadership team. As WVU’s vice president for health sciences, he oversees five health sciences schools and three health campuses, and serves on the governing boards that determine policy and priorities for WVU Medicine and its component organizations. In addition, as executive dean, he is the leader of the WVU School of Medicine.
    In his role as WVU’s health leader, he has mobilized resources across the University to help WVU Medicine become the leading employer in the state and to build signature programs of excellence in the areas of heart and vascular care, cancer prevention and treatment, women's and children’s health, trauma and critical care, and neurological health and disease. He also has focused resources on areas of emphasis, including opioid addiction, diabetes, and obesity.
    As part of WVU’s efforts to address the opioid crisis in West Virginia and the nation, he organized a Substance Abuse Task Force to coordinate and strengthen the activities of the University’s patient care enterprise, research and teaching faculty, and administration in this area. He was a participant in the White House Symposium on the development of centers of academic excellence in addiction medicine and has participated in policy discussions with state and national leaders in education, research and public policy to advance these efforts.

    Guest Bio:
    Prof. Pigliucci has a PhD in Evolutionary Biology from the University of Connecticut and a PhD in Philosophy from the University of Tennessee. He has done post-doctoral research in evolutionary ecology at Brown University and is currently K.D. Irani Professor of Philosophy at City College and Professor of Philosophy at the Graduate Center of the City University of New York. His research interests include the philosophy of biology, the relationship between science and philosophy, and the nature of pseudoscience.

    In the second of our two part series, we speak with Olivia Troye, the Director of the Republican Accountability Project, and Former White House Homeland Security, Counterterrorism & Covid Advisor to VP Mike Pence about her personal experience during and after the attacks on September 11th, 2001. As we discussed in the episode, this unique and memorable day is engrained in the minds and hearts of every American whether you were born on that day or not. Furthermore these attacks have shaped the way Americans do things from taking a flight to the amount of privacy or civil liberties they may be forfeiting in the name of national defense.
    The discussion then turns to Afghanistan and the countless number of lives and money that has been expended and why it's too early to tell if this pull out will be remembered as a good decision or not by the Biden Administration. The conversation ends with some fun facts that Will and Josh learn about the character that Olivia is portrayed as in the TV show, "24"
