They were first arrested in Romania in December 2022, accused of human trafficking, forming an organized crime group, and sexual exploitation of women.

British prosecutors brought new charges against the Tates in 2024–2025, alleging offenses between 2010 and 2017. Andrew Tate faces 42 charges, including rape, arranging or facilitating trafficking for sexual exploitation, assault causing actual bodily harm, and offenses related to indecent images of a child and extreme pornography. Tristan Tate faces 17 charges, including sexual assault, rape, and facilitating sex trafficking.

On July 18, 2026, the U.S. Marshals Service arrested the brothers on a sealed warrant issued by the UK.
