The Environmental Protection Agency (EPA) recently finalized the Biden administration's new tax on methane emissions from oil and gas operations, raising important questions for royalty owners about potential impacts on their royalty payments in the form of additional post-production deductions. Natural gas currently trades at a massive discount to crude oil based on its energy content. While oil has been hovering at around $70 per barrel, natural gas trades at just over $3 per thousand cubic feet (mcf). We talk about how this pricing disconnect is creating opportunities as two major new demand sources emerge: AI data centers requiring reliable power and innovative gas-to-liquid technologies that can convert natural gas directly into gasoline and other fuels.

MRP 263: What You Should Know About Fixed vs Floating NPRIs Oct 17, 2024

When you grant a portion of your royalty right to someone without granting any of the other rights, you are granting what is called a Non-Participating Royalty Interest (NPRI). It does not “participate” in the ability to receive bonus payment or delay rentals, or the executive rights. A Non-Participating Royalty Interest or NPRI allows the owner to receive a portion of the royalty payments from any oil and gas that is sold but does not give them the right to lease the associated mineral rights. In this episode, we dive into the world of NPRI's and the difference between "floating" and "fixed" NPRI's and what you need to know if you own an NPRI or if you own mineral rights that are burdened by an NPRI.

Currently, the United States is experiencing a natural gas boom. We have so much gas that in some areas, prices have even gone negative. This oversupply has led to wasteful practices like flaring, where excess gas is burned off at well sites. Did you know that based on energy content alone, natural gas should be priced at about one-sixth the price of oil. However, gas is currently trading much lower than this ratio would suggest. This price disparity creates an opportunity for innovative solutions. We talk about how an amazing technology that has been around for over 100 years is being piloted in the Permian Basin to convert excess natural gas to valuable products like gasoline.

MRP 179: What Are Blanchard Royalties? Nov 17, 2022

Each state is different in the way that certain aspects of royalty payments are handled. One of the more unique situations exists in Oklahoma with the concept of Blanchard Royalty Interests.

Blanchard Interests refer to the way that royalty owners were to be paid by the various Working Interest owners in a well when each working interest owner entered into a separate gas sale contract for their proportionate share of gas produced and sold.

The term Blanchard interest stems from the landmark Oklahoma Supreme Court case from 1963 between Shell Oil Company and the Oklahoma Corporation commission, often referred to as the “Blanchard Decision.”

MRP 150: Colorado's New Financial Assurance Rules with Neil Ray Apr 21, 2022

In this episode, Justin and I interview Neil Ray with CAMRO. We discuss the new Colorado Oil and Gas Financial Assurance regulations that just went into effect. If you're not familiar with what financial assurance is, it is the process of operators putting up money to ensure that the state isn't left footing the bill for plugging and abandoning wells in case the company goes out of business. This is just one part of the overarching changes to the way that oil and gas is regulated in the state of Colorado.

This topic is important because even if you don't have minerals in the state, other progressive states could adopt similar measures. These new financial assurance rules may make it difficult for small producers to meet the requirements which is important because according to the IPAA, there are about 9,000 independent oil and natural gas producers in the US. These are the small mom and pop operators that employ an average of just 12 people. These companies produce 83 percent of America's oil and 90 percent of America's natural gas.

Beth recently wrote in and gave an excellent suggestion on a topic that I realized we hadn’t covered in a single episode. She wrote asking for “advice on managing mineral rights from far away, particularly what services I can expect from an attorney, what might be better handled by an independent engineer or landman, or what I'll have to do myself."

This is a very common situation where you may own mineral rights or royalty interests in another state and you need to research your interests either through the county courthouse or the state oil and gas commission or you may need the services of a professional in that state but you may not be able to meet with them in person.

MRP 109: NARO Board Member and Landman Katy Alven Jun 10, 2021

In this interview, NARO Board Member and Landman Katy Alven shares her experiences working in the oil & gas industry and most recently managing the land department of a mineral acquisition company. We also discuss Katy's involvement with NARO and how NARO has helped her learn about how to manager her mineral rights.

Katy Alven is a landman, mineral owner, and has been active in the oil and gas industry since 2007. She is head of the Land Department at Mekusukey Oil Company, LLC in Wewoka, Oklahoma. She is responsible for Mekusukey’s ongoing mineral acquisition program and management of Mekusukey’s inventory of approximately 110,000 net mineral acres across 26 states. Additionally, in 2016, Katy founded Mustang Minerals, LLC and currently owns and manages approximately 900 net mineral acres across 13 states.

In 2006, Katy graduated from Southern Methodist University in Dallas with a BA in English and later obtained an MBA from the University of Central Oklahoma in Edmond (2012) and a Master of Legal Studies in Energy from Oklahoma City University (2014).

Katy is a Certified Mineral Manager and Registered Professional Landman. She was elected to the Oklahoma NARO Board in 2018 and is the current OK-NARO Secretary. She was elected to the National NARO Board in 2021. In addition to NARO, she is a member of the American Association of Professional Landmen, Oklahoma City Association of Professional Landmen, and Texas Independent Producers & Royalty Owners Association.

I'm very excited about our conversation with our guest this week. Justin and I spoke with Jack Fleet, the Executive Director of the National Association of Royalty Owners, Inc. (NARO).

In his role as Executive Director, Jack works as an advocate for mineral and royalty owners like you and I at the at both the state and national level, giving testimony on the impact of legislation being considered.

Additionally, he supports all of the state and regional chapters of NARO. He has been involved at all levels of NARO from serving as Interim Executive Director in 2020, and is a past president of the NARO National board and a past president of the NARO Texas Chapter. He has also served on the Oklahoma NARO, NARO Foundation, and NARO National Boards in various capacities and has delivered several presentations on mineral and royalty management at NARO events.

He is also a member of the AAPL and is a professional level Certified Mineral Manager (CMM) with NARO and has taught several CMM review classes.

Many of you may recognize today's guest from the Mineral Rights Forum and her involvement with the National Association of Royalty Owners (NARO). I'm referring to Martha Barnes who is an amazing person that has generously helped hundreds if not thousands of people on the forum and through her work with NARO.

In this episode, Martha shares some amazing tips for all mineral owners, whether you are just starting out or are a seasoned professional. And despite the fact that she is an experienced geologist and oil and gas industry vet, when it came time to take over the management of her families mineral rights, she realized that there was still a lot to learn. Martha Creager Barnes is an owner and managing partner at Santa Clara Minerals, LLC which manages mineral rights for private mineral owners. Prior to starting SCM, she was an exploration and production geologist for Marathon Oil Company for nearly 29 years. Martha grew up in New Mexico and is a third-generation geologist and a fourth-generation mineral owner. She has a BA in Geology and Managerial Studies from Rice University, a MS in Geology from the University of South Carolina and is a Registered Geologist with the Texas Board of Professional Geoscientists (TBPG) and a Certified Geologist with the American Association of Petroleum Geoscientists (AAPG). She is a Certified Minerals Manager with the National Association of Royalty Owners (NARO) and currently serves as a Director on the OK NARO Board and the US NARO Board. She is a member of AAPG, HGS, and AAPL.

CO2 sequestration or carbon capture and sequestration (CCS) is the process of capturing CO2 from the atmosphere or before it reaches the atmosphere and injecting it underground or capturing it using biological methods. Enhanced Oil Recovery is the process of injecting fluids like CO2 into the reservoir to increase production. In this episode we talk about the intersection between carbon capture and EOR and the benefits to mineral owners.

Sometimes oil and gas wells or leases are sold to another company and if you have a royalty interest in the wells, you end up getting royalty checks from the new operator once the sale goes through. This is a time in royalty ownership where you need to be on top of your game to make sure the transition goes smoothly so you get paid what you deserve.

MRP 96: Texas Relinquishment Act Lands Mar 11, 2021

Did you know that for some lands in Texas that were sold between 1895, the state owns the minerals under those lands but the surface owner has the right to lease these lands and in return, they receive ½ of the bonus, royalty and other consideration paid by the lessee in lieu of surface damages?

MRP 94: Leasing Land for a Solar Farm Feb 24, 2021

In part two of our renewable energy series, we talk about leasing your surface rights for solar power development (aka a solar farm). From the terms to think about, going lease rates for solar developments, what would be installed on your property, and the actual carbon footprint of solar vs. natural gas power plants, we break it all down for you.

Even if you don't own large amounts of surface rights to lease for a solar development, this episode has something for you. As mineral owners, it is important to be aware of how surface uses like a solar farm could impair the ability to use the surface to drill an oil and gas well. When certain provisions need to be made in order to balance the often competing priorities of surface vs. mineral rights, the Accommodation Doctrine comes into play. In fact, we discuss a recent court case in Texas that highlights this potential conflict.

MRP 93: The Pros and Cons of Wind Energy and Leasing Land for a Wind Farm Feb 18, 2021

In this episode, we discuss some of the considerations if you are approached to lease your land for a wind farm and some of the pros and cons associated with wind energy. Little did we know how soon after recording this episode we'd be faced with an energy crisis and rolling blackouts in Texas due to record low temps and widespread snow and ice storms freezing all types of energy production in the state. From preventable problems with natural gas power plants to half of the Texas' renewable power offline due to frozen wind turbines and snow covered solar panels, this highlights the need to be measured in our approach to a low carbon energy future.

Our thoughts go out to those in Texas currently faced with the current energy crisis. Once we all thaw out, this episode has a lot to think about as it relates to wind energy and how we make a smart transition to a low carbon future. MRP 76: Leasing Mineral Rights for Mining Potash and Other Critical Minerals Oct 21, 2020

When you read about the coming transition to renewable energy, critical minerals may not be the first thing that comes to mind. That said, these minerals are critical (pun intended) for the "renewable" energy infrastructure being touted by some politicians. From solar panels and wind turbines to electric vehicles and the large quantities of batteries that make these technologies usable, minerals like lithium and cobalt are required. In fact, the World Bank predicts a 500% increase in the production of these critical minerals by 2050 to meet growing demand.

Growing the food required to feed the growing global population uses a lot of fertilizer, and potash is a naturally occurring ingredient in fertilizer.

Like oil & gas, for a company to be able to mine for potash or other critical minerals on privately owned land, they must obtain a lease from the mineral owner beforehand.

In this episode we talk about what Potash is, where it is located, things to think about before signing a mining lease to mine potash or other critical minerals.

MRP 73: Alex Epstein and The Moral Case for Fossil Fuels Sep 30, 2020

The 2020 presidential election is looking to have a big impact on energy policy in the United States.

When it comes to energy and the environment and being able to understand both the positive and negative effects, it is important to look at the data in an objective manner. And this is exactly where this week's guest comes in.

Alex Epstein is a philosopher who argues that “human flourishing” should be the guiding principle of industrial and environmental progress.

He founded the Center for Industrial Progress in 2011 to offer a positive, pro-human alternative to the Green movement.

Alex is the author of The Moral Case for Fossil Fuels, a New York Times bestseller who argues that if we look at the big picture, human flourishing requires that we use MORE fossil fuels not less. The book has been widely praised as the most persuasive argument ever made for our continuing use of fossil fuels.

Most recently, Alex created the website EnergyTalkingPoints.com to provide true, powerful, and succinct talking points on this year's most important energy, environmental, and climate issues.

MRP 65: Behind the Scenes on a Drilling Rig and Why Quality Matters Jul 29, 2020

I'm really excited about this week's episode because we have two really interesting guests lined up for you. Kyle Chambers and Joey Falbo with Texas Quality Assurance LLC join Justin and I to teach us about quality management and why everyone needs to know what it is. In fact, Kyle and his wife Darci host a podcast called the #QualityMatters Podcast where they talk all about quality management and ways to make your life easier at work and at home.

This was a really interesting conversation as we dive deep into how quality management is really important when drilling a well. Joey tells a few stories from his experience working in the field around things like inspecting drilling equipment and why this is so critical in making sure a wells is drilled safely and on-time.

This is important to us as mineral owners because if the operator has an equipment failure that causes them to have to plug the well and it may never get repaired and completed. If the well never produces oil and gas, we don't get paid royalties.

This week Justin Williams and I speak with Liana Jones, an attorney with Lear & Lear, PLLC, to help us understand the ins and outs of title opinions. We discuss everything you need to know about title opinions including, the role of the title attorney, why operators need title opinions, the types of title opinions that are relevant to oil and gas, why royalty interests are put in suspense by an operator and why this is not necessarily a bad thing, and we also talk about some issues that can come up with title opinions and what you need to know as a mineral interest or royalty owner.

Ms. Jones' background is in natural resource law and transactional practice, with an emphasis on oil and gas title. Her primary interest pertains to public lands and complex title issues. In her spare time she enjoys outdoor recreational activities to include backpacking, cycling, skiing, and snowboarding. Her practice includes natural resources and public lands law with emphasis on mineral law, oil and gas law and litigation; complex title examinations; administrative hearings and appeals; public land law; and timber and logging law.

MRP 59: Alternate Valuation Dates with Rob Prentice Jun 11, 2020

One way to make the most of our minerals and royalties is to make sure that we are making the right decisions to minimize tax liability. I’m not talking about skipping out on your taxes but by making sure that you are taking the right deductions and credits or by leveraging an alternate date when valuing your property for estate tax purposes. And that is what we are going to talk about today - using the alternate valuation date when it comes to estate taxes. To cover this sometimes overlooked concept, I brought back Rob Prentice with Turrett LLC. As you may remember, Rob appeared on Episode 32 of the Mineral Rights Podcast to talk about IRS mineral valuations for the purposes of setting a step-up in cost basis.

MRP 57: What to do When Your Wells Get Shut-in May 20, 2020

Today Justin and I talk about reasons that operators may shut-in producing wells. From low oil prices to preventing issues like frac interference (we explain what this is and why this is a concern), this is topic that affects all royalty owners at some time. We also talk about some of the things to know about the shut-in royalty clause in most oil and gas leases.

We recorded this episode in December 2019 before the crash in crude oil prices. That said, these concepts are relevant regardless of the reason for shutting in production. In fact, this topic may be even more relevant today with the current price environment of $20-30/bbl for WTI crude oil, given many operators have shut-in production that is not economic to produce at these prices.

Also, in case you missed it, we also covered shut-in royalty payments in our recent conversation with Spencer Cox who is an attorney with Burns Charest, LLP. You can find that discussion in Episode 53 of the Mineral Rights Podcast. MRP 54: Using a 1031 Exchange to Defer Capital Gains Tax Apr 29, 2020

Matt and Justin speak with Bob Howard and Taylor Leander from Resource Royalty, LLC about 1031 Exchanges and how mineral interests can fit into this strategy. As you may know, a 1031 Exchange is defined under section 1031 of the IRS Code and it allows an investor to defer paying capital gains tax on certain types of investment properties when they are sold as long as certain conditions are met. This episode was recorded before the impacts of COVID-19 and before the price of crude oil tanked in early March. This topic may be even more important in helping to maximize the return on an investment, especially considering the challenging market conditions we are faced with in 2020.

MRP 50: How Natural Gas and NGLs are Priced Apr 02, 2020

I hope that you are well in these extremely challenging and uncertain times. With the volatility in the financial markets, it is hard to keep track of the price of oil and gas. We recorded this episode in January of 2020 before the current crisis but I think this content is even more relevant today.

Given the extreme drop in oil and natural gas prices, it is even more important to keep tabs on your royalty checks to make sure you are getting paid what you deserve. Specifically, it is a good practice to double check the volumes that are reported on your check stubs and to understand the price that was paid for a given month. To help you with this we answer a listener question about how natural gas prices are determined and things you need to know in order to be able to reconcile the price paid for natural gas, NGLs, and crude oil.

MRP 8: Forced Pooling - What Are Your Options? Sep 12, 2018

In Episode 8, we talk about forced pooling and expand on the concept of non-operated Working Interests as covered in Episode 7. We highlight the typical options that a mineral owner is faced with when they receive a forced pooling notice and election letter in the mail. This includes:

- Participating in the well (covered in more detail in Episode 7)

- Leasing

- Making an affirmative election to "non-consent" to the well

- Getting Forced Pooled

Examples discussed are specific to Colorado but many states have similar requirements. Check with your state's oil and gas commission for more information.
