Why Should I pay for that? I'm not at fault! Apr 01, 2025
    Show notes

    Understanding the Payment Process

When the other driver is at fault, many wonder why their own insurance company or health insurance ends up paying for medical bills and damages. In Maryland, although the at-fault party’s insurer is responsible for settling the claim, your insurance still covers immediate medical expenses and other costs as part of your coverage. This system ensures you’re protected right away, even before the at-fault driver’s funds are recovered.

How Insurance Works in Your Favor

Your insurance policy, including personal injury protection, is designed to pay your medical bills and related expenses promptly—so you don’t face financial hardship while waiting for the full claim to settle. Importantly, the amounts paid by your insurance are not deducted from your eventual settlement, meaning you receive the full compensation for your losses as determined by Maryland law.

    Know Your Rights and Responsibilities

Even though it seems counterintuitive to have your insurance cover costs when someone else is at fault, this arrangement is a crucial safety net. It prevents delays in care and financial strain. By understanding that your insurer’s payments are a preemptive measure—and not a loss on your claim—you can confidently manage your recovery process without worry.

Are all your vehicles fully insured? Mar 25, 2025
    Show notes

    Check Your Extra Vehicles

Your primary car might be covered with a comprehensive policy, but what about those fun or recreational vehicles—classic cars, motorcycles, RVs? Often, these secondary vehicles come with lower coverage levels that may leave you vulnerable in an accident.

    Match Your Coverage Levels

It’s essential to compare the coverage on your extra vehicles with that of your daily driver. Insurance companies sometimes offer lower rates on non-primary vehicles by reducing the level of protection. Reviewing your policies can ensure that you’re not underinsured when it matters most.

    Review Your Declarations

Before hitting the road on a weekend adventure, take a moment to check your declarations page. Make sure that the coverage limits on all your vehicles align with your needs. This simple step can save you from costly surprises during a claim.

Case Value Impact from Drinking, Drugs, or Distraction? Mar 18, 2025
    Show notes

    Case Value Basics

In this episode, Bowers Law tackles one of the most common questions: does evidence of drinking, drug use, or distracted driving by the other party boost your case value? In Maryland, regardless of the other driver’s impaired condition, your settlement is determined solely by the extent of your injuries and damages.

    The Maryland Rule

Maryland’s strict liability standard means that if the other driver is found 100% at fault—even if impaired—their condition does not translate into extra compensation. Instead, the focus remains on the actual harm you suffered. Bowers Law explains that even factors like intoxication or distraction typically have little to no impact on the monetary value of your injury claim here in Maryland.

Time Changes: Do we become more accident prone? Mar 11, 2025
    Show notes

The Impact of Losing an Hour

Every year, when we spring forward, we lose that crucial hour of sleep. Although it may seem insignificant, this loss can throw off our internal clocks and affect our alertness on the road. Studies suggest that the week following a time change can see a 6–10% increase in accidents due to the sudden shift in sleep patterns.

Accidents and Fatigue: What the Numbers Say

Research indicates that fatigue-related factors, such as drowsiness, contribute to a significant portion of auto accidents—even fatal ones. For example, some studies report that up to 18% of fatal crashes are linked to drivers being drowsy. This data highlights why extra caution is essential during the days after the clock change.

Tips to Stay Safe During Time Changes

To counteract the effects of lost sleep, prioritize getting extra rest and consider adjusting your schedule. Allow additional travel time, maintain a safe following distance, and be extra vigilant—your reaction time may be compromised when you’re not fully rested.

What Do I Do With My Settlement Check? Mar 04, 2025
    Show notes

    Handling Your Settlement Funds

When you receive a large settlement check, the first step is to safeguard it properly. Rather than trying to cash it immediately at a check-cashing place—which can incur hefty fees—deposit the check into a secure bank account. This prevents any risk of loss or unauthorized cash withdrawals.

    Planning for Cash Withdrawals

If you prefer accessing cash, contact your bank ahead of time. Large sums aren’t typically available on hand, so informing your bank in advance allows them to arrange the necessary funds. This step ensures you avoid delays or surprises when you need to withdraw money from your settlement.

    Consider Structured Settlement Options

While your settlement check is tax-free, maximizing its potential might involve exploring structured settlement options. These arrangements can help grow your funds tax-efficiently over time. For detailed advice on this, check out our previous episode on structured settlements, or speak with a trusted financial advisor.

How Can I Speed Up My Accident Settlement? Feb 25, 2025
    Show notes

    Insurance Timeline Challenges

When it comes to accident settlements, there’s no one-size-fits-all timeline. Bowers Law explains that the process begins with your medical treatment—only when your injuries are stabilized can your claim move forward. Insurance companies often wait until all related medical bills and records are in before making an offer.

    Factors Influencing Settlement Speed

Every accident is unique. The duration of your settlement depends on several factors such as the extent of your injuries, the complexity of your medical care, and the responsiveness of your insurance company. Delays may occur if additional documentation or negotiations are needed, but with proactive communication, the process can often be expedited.

    Optimize Your Settlement Process

To potentially speed up your settlement, Bowers Law advises clients to contact us as early as possible. Providing comprehensive information and timely updates allows our team to negotiate more effectively with your insurer, ensuring you receive the full compensation you deserve—without unnecessary delays.

Wind Damage: Who Pays for What? Feb 17, 2025
    Show notes

    Dealing with Wind-Related Damage

Strong winds can wreak havoc—uprooting trees, damaging roofs, and even affecting vehicles. In this episode, Bowers Law explains the steps you should take when wind damage occurs, whether the damage originates on your property or spills over from a neighbor’s yard.

    Understanding Your Insurance Claims

When wind damage strikes, your homeowners insurance is your first line of defense. Even if the incident is caused by a neighbor’s tree, you typically must file a claim under your own policy. Bowers Law advises obtaining a professional estimate to determine if the damage exceeds your deductible before filing a claim.

    Avoiding Unnecessary Claims

Knowing your deductible is crucial. If repair costs are below your deductible, it might be best to handle the repairs on your own to avoid unnecessary claims and potential premium increases. This proactive approach can save you money and hassle in the long run.

New Benefits, New Costs - FAMLI Info and Preview with Glenn Arrington Feb 10, 2025
    Show notes

    Understanding the New FAMLI Requirements

Maryland employers and employees, get ready for significant changes coming this summer. As part of the Time to Care Act of 2022, new Family and Medical Leave insurance requirements will soon take effect. This program is designed to offer partial wage replacement for workers taking leave to care for a new baby, a loved one, or to manage serious health conditions or disabilities.

How It Works for Employers and Employees

Under the new law, employers with at least one W2 employee must begin withholding 0.45% of each employee’s income starting July 1. For larger businesses with 15 or more employees, the employer is required to match this contribution. These funds will be deposited into the State Insurance Fund for one year, after which eligible employees can receive up to 12 weeks of benefits—up to $1,000 per week.

    Expert Insight from Glenn Arrington

Special guest Glenn Arrington, an insurance broker with Group Benefit Strategies, joins Bowers Law to break down your options. Glenn discusses whether employers should self-fund this benefit or opt for private insurance solutions. He also highlights the importance of early preparation and even invites local business owners to attend an upcoming hybrid event hosted by the Cecil County Chamber of Commerce for more in-depth guidance.

What Happens when You cause an Accident? Jan 20, 2025
    Show notes

    Understanding Your Liability

If you’re the at-fault driver, protecting yourself legally and financially is paramount. In this episode, Bowers Law explains that when you cause an accident—even if injuries are minimal—your insurance company immediately steps in to defend you and manage any claims from the other party.

    The Insurance Process Explained

Your insurer’s primary duty is to protect you. They will assign an attorney, handle any claims brought by the other driver, and cover expenses up to your policy limits. It’s crucial to cooperate fully with your insurance company, as this commitment is part of your contractual agreement and helps safeguard your interests.

    Protecting Your Own Interests

In addition to defending you against third-party claims, your personal injury protection (PIP) coverage plays a vital role if you’re injured. This coverage reimburses you for medical expenses, lost wages, and other related costs—ensuring you’re not left financially burdened by the aftermath of an accident.
