    Episode 370: No Monarchy Oct 07, 2020
    Show notes

Less than two weeks after the Framers signed the Constitution in 1787, Pennsylvanian Tench Coxe published a series of essays in defense of the new document. The first was aimed at critics of the new office of president. They thought it would create an elected monarchy (they were right) but Coxe thought otherwise. In light of the election year, it's worth dusting off Coxe's essay in order to compare his presidency with that of the modern era.

Episode 369: To Divide or Not To Divide Oct 02, 2020
    Show notes

Americans want less divided government. A new Gallup poll shows that more Americans support one party control of the federal government than at any time in recent history. Why? Power. This is the clear result of Lincolnian nationalism. It needs a correction.

    Episode 368: Trump v. Biden Round 1 Sep 30, 2020
    Show notes

I watched the "debate" so you didn't have it. No one who did watch it came away thinking that it was either man's best performance, but I thought it better to focus on the stupidity of the entire process. Welcome to how the presidency screwed up America.

Episode 367: Trump's Effort to Save History Sep 28, 2020
    Show notes

As I've said on this show, who knew that the 2020 presidential election would be a referendum on American history? This is a logical extension of the culture war that Pat Buchanan warned about in the 1990s (and that began in the 1960s) and has fully reached the executive office. Trump has consistently insisted on a reconciliationist message, one that does not fit with the SJW/PC culture prevalent in the American left. I discuss Trump's recent shots at this new history in this episode of The Brion McClanahan Show.

Episode 366: Best SCOTUS Justices? Sep 24, 2020
    Show notes

I have been asked several times: Who are the best justices in Supreme Court history? There haven't been many to write home about, but I give you a few that deserve our respect in this episode of The Brion McClanahan Show.

    Episode 365: Originalists and Anti-Federalists Sep 23, 2020
    Show notes

What is "originalism" and what does it have to do with the "Anti-Federalists"? More importantly, if we believe in originalism, does that immediately rule out judicial activism? How does this affect the Supreme Court and federal court system? I discuss all of these issues in this episode of The Brion McClanahan Show.

Episode 364: Hylton, Cohens, and a Slaughterhouse Sep 22, 2020
    Show notes

A listener asked me to discuss a few landmark Supreme Court cases and how they affected the United States. Great idea during SCOTUS week. That led me to one in the 18th century, one in the antebellum 19th century, and one during Reconstruction. I cover all three in my American Constitutions course at McClanahan Academy. Episode 363: Notorious RBG Sep 21, 2020
    Show notes

In case you are living under a rock, Ruth Bader Ginsburg died over the weekend. The left has gone nuts, as expected, and her death has created a supposed "constitutional crisis." Not so. It should also never be so. Ginsburg was a disaster for the Constitution, but her death also highlights why the Supreme Court is so dangerous. I explain in this episode of The Brion McClanahan Show.

    Episode 362: Pennsylvania Smackdown Sep 19, 2020
    Show notes

A federal judge declared the Draconian lock downs in Pennsylvania to be unconstitutional. This is a great win for liberty, right? Yes and no. Anyone with a brain knew that these laws were problematic legally according to the PA Constitution. But that is not what the federal judge decided. The laws were unconstitutional because they violated the 1st and 14th Amendments to the US Constitution. That is where the issue gets murky. Do we want our federal overlords knocking down State laws? No, and I explain in this episode of The Brion McClanahan Show.

Episode 361: Three New Yorks? Sep 16, 2020
    Show notes

Some New York legislators want to decentralize New York. Instead of letting New York City run the State, these independent thinking New Yorkers want to divide the State into three regional governments. The Governor would have little power and New York City would be reduced to ruining its own territory instead of the entire State. This is an interesting idea and one that deserved a discussion.
