On the evening of May 29, 2021, Luis Casado shot and killed a man on a sidewalk outside a bar in St. Augustine FL, after being subject by that man to a barehanded attack.
Following a four-day self-defense immunity hearing held in mid-November 2022, on December 30, 2022, a Florida court granted Casado immunity from prosecution for that killing, ruling that the State had failed to disprove self-defense by clear and convincing evidence.

This morning New Mexico District Attorney Mary Carmack-Altwies announced that actor Alec Baldwin would be charged with two counts of manslaughter in the October 21, 2021 shooting death of cinematographer Halyna Hutchins as the two worked together on the set of the low-budget movie “Rust.”
This decision to charge Baldwin with manslaughter comes a mere 13 months after my own legal analysis of the shooting, suggesting manslaughter, published at Legal Insurrection the day after the shooting.
That piece was quickly followed up by a much more detailed legal analysis concluding manslaughter was likely the appropriate charge in this case, published here just three days later.
I’ve written numerous follow-up pieces on Baldwin’s shooting of Hutchins (all of which can be found collected here -- https://lawofselfdefense.com/baldwin), but nothing during the 13 months since that event has changed my fundamental conclusion that a proper application of New Mexico law to the apparent facts in this case leads to anything but an act of reckless (involuntary) manslaughter on the part of Baldwin—ultimately the charge announced today by DA Carmack-Altwies.
Here I’ll quickly hit the high points of my previous analysis, so we’re all on the same page in terms of the legal merits of this charge of manslaughter. (This is drawn from the October 25, 2021 post linked above.)

The entire immunity hearing was televised, providing us with an unusual opportunity to observe an actual self-defense immunity hearing in the wild, so to speak. Not one to let such an opportunity pass, I'm going to cover each day of that self-defense immunity hearing in a series of four shows, starting today with the first day of the hearing.
Today is the fourth and last day of this self-defense immunity hearing, during which we'll hear from the final defense witness (a psychologist), two State rebuttal witnesses (an optometrist and a use-of-force expert), and then close with each side's argument of its position (the defense for a grant of immunity to prosecution, the State against, of course).

The result of the four-day immunity hearing was a grant of immunity by the hearing judge, freeing Casado of criminal liability for this killing, and preventing the prosecution from bringing him to a costly, time-consuming, and risky trial.
