Real Life Real Crime | The Texas Tower Shooter: Charles Whitman's Deadly Descent Into Madness Aug 01, 2026
    Show notes

On August 1, 1966, Charles Whitman climbed the observation deck of the University of Texas Tower and opened fire, forever changing American history. During the next 96 minutes, sixteen people were killed, dozens more were wounded, and law enforcement was forced to confront a type of mass violence the country had never experienced before.

In this episode, Cyndi Overton takes a deep dive into one of the most infamous mass shootings in American history—not just the events of that tragic day, but the life that led up to it. From Whitman's abusive childhood and extraordinary intelligence to his military career, deteriorating mental health, and desperate attempts to seek psychiatric help, this episode examines the psychological, environmental, and neurological factors that may have contributed to the tragedy.

Cyndi also explores the discovery of Whitman's brain tumor following his death, how the case transformed law enforcement through the development of modern SWAT teams and active shooter response protocols, and the lasting impact the case had on psychiatry's understanding of violence, threat assessment, and mental illness.

Most importantly, this episode honors the victims whose lives were forever changed on August 1, 1966, reminding us that behind every headline are families, dreams, and futures that were stolen far too soon.

Real Life Real Crime | Justice for Hailey Part 2: Thomas Davenport Destroys the Double Jeopardy Myth Jul 27, 2026

    IMPORTANT RESOURCE

    Prosecuting Attorneys Qualifications Commission (PAQC)

The Prosecuting Attorneys Qualifications Commission (PAQC) is the oversight body discussed during this episode regarding complaints involving prosecutorial conduct.

    Website: https://paqcga.gov/

Woody announces that this Commission will be part of the upcoming nationwide call to action for Justice for Hailey.

The fight for Justice for Hailey continues.

Following last episode's interview with attorney and law professor Thomas Davenport, Woody Overton devotes this entire episode to reading Davenport's complete peer-reviewed legal memorandum addressing the Cobb County District Attorney's claim that prosecuting Brooks Cleary for homicide would violate the Double Jeopardy Clause.

    Throughout the memorandum, Davenport analyzes:

    • The constitutional protections provided by the Fifth Amendment.
    • The legal standards established under the Blockburger "same elements" test.
    • Georgia homicide statutes, including murder, voluntary manslaughter, and involuntary manslaughter.
    • Brooks Cleary's previous convictions for concealing a death, interference with government property, and making false statements.
    • Why those convictions are legally distinct from homicide.
    • Why a future homicide prosecution would not constitute double jeopardy.
    • Why a criminal defendant—not a prosecutor—raises a double jeopardy defense.

Woody also revisits the independent scientific findings completed by forensic expert Scott Roder, who concluded Hailey could not have died by suicide, and argues that both the scientific evidence and legal research now support moving forward with homicide charges.

The episode concludes with Woody announcing tomorrow's dedicated Justice for Hailey Call to Action, encouraging listeners to contact appropriate officials and continue advocating for accountability. He also provides an update on the What Happened to Madison? case, thanking listeners for their continued support and explaining how public awareness has contributed to recent developments.

Real Life Real Crime | Justice for Hailey: Thomas Davenport Destroys the Double Jeopardy Myth Jul 25, 2026
    Show notes

    Prosecuting Attorneys Qualifications Commission (PAQC)

The Prosecuting Attorneys Qualifications Commission (PAQC) is the independent oversight commission for district attorneys and solicitors-general in the State of Georgia.

    Website: https://paqcga.gov/

As discussed by attorney Thomas Davenport, listeners who wish to learn more about the Commission or its complaint process can visit the official PAQC website.

The pursuit of Justice for Hailey reaches a critical turning point.

In this special episode, Woody Overton sits down with attorney, law professor, and constitutional law expert Thomas Davenport to address one question that has frustrated Hailey's family and supporters for years:

Can Brooks Cleary still be prosecuted for homicide?

    Davenport says yes.

After Woody approached him about the Cobb County District Attorney's assertion that prosecuting Cleary would violate double jeopardy protections, Davenport immersed himself in Georgia law, federal constitutional law, homicide statutes, and decades of court decisions. The result is a comprehensive legal memorandum concluding that double jeopardy does not prevent a homicide prosecution in Hailey's case.

Wanting to ensure his conclusions were sound, Davenport submitted the memorandum for confidential peer review by prosecutors, defense attorneys, judges, and law professors from across the United States. According to Davenport, not one reviewer disagreed with his legal analysis.

Throughout the episode, Woody and Thomas explain:

    • Why Brooks Cleary's previous convictions are legally separate from homicide.

    • What double jeopardy actually means under the United States Constitution.

    • Why prosecutors generally do not raise constitutional defenses on behalf of criminal defendants before charges are filed.

    • The purpose of the Prosecuting Attorneys Qualifications Commission (PAQC) and why listeners should know about it.

    • Why Hailey's family deserves the opportunity to have a jury hear the evidence.

Woody also announces that this episode is the beginning of a multi-part series. The next installment will feature Thomas Davenport's complete legal memorandum followed by a nationwide call to action encouraging listeners to advocate for Justice for Hailey.

This matches the comprehensive RLRC format we've been using. One thing I would change from my earlier version is the title—I think "Justice for Hailey: Why Double Jeopardy Doesn't Apply" is stronger and more searchable than the version I initially suggested.
