    Oral Arguments, with Context

Real court arguments, crisp audio, with context. Court recordings can be difficult to follow, and many suffer from poor audio quality. This podcast enhances the audio, provides a brief introduction to each case, and explains legal concepts that may be unfamiliar to some listeners. We hope these enhancements make oral argument recordings easier to understand, more accessible, and more enjoyable to listen to. Recordings come from the courts’ own public releases; Supreme Court timing is derived locally from the Court’s official transcript and audio.

United States ex rel. Pacira BioSciences, Inc. v. QuVa Pharma, Inc. — 1st Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The First Circuit reviews the dismissal of Pacira BioSciences' qui tam False Claims Act suit. A qui tam relator sues in the United States' name. Pacira alleges that several companies induced health-care providers to seek federal reimbursement for compounded postoperative pain drugs that did not meet federal requirements. Materiality asks whether the alleged falsehood could influence payment. Continued payment despite actual knowledge can be strong evidence against materiality, but it is not automatically decisive. The appeal also raises the public-disclosure bar and Rule 9(b), which requires alleged fraud to be stated with particularity. United States ex rel. Pacira BioSciences, Inc. v. QuVa Pharma, Inc. Salmon v. DVA — Fed. Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The Federal Circuit considers whether it may review an arbitrator's rejection of Sandra Salmon's whistleblower-retaliation claim. Salmon, a Department of Veterans Affairs nurse, challenged her removal through her union's grievance procedure. The jurisdictional dispute is whether choosing arbitration left her without judicial review. If the court has jurisdiction, it will also consider whether the arbitrator used the correct whistleblower framework. Salmon v. The Second Circuit considers whether Benjamin Rich's civil-rights case against two New York City police officers should have survived summary judgment. After criminal charges against Rich were dismissed, he sued for malicious prosecution and denial of a fair trial. The appeal turns on what Detective Michael Miller knew about the key eyewitness's account, and whether probable cause nonetheless supported Rich's arrest and prosecution. Rich v. Erin Livesay v. National Credit Systems, Inc. — 7th Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The Seventh Circuit reviews summary judgment in a dispute over an apartment debt. Erin Livesay says National Credit Systems kept reporting that she owed about $5,300 after a state court ruled that she owed the landlord nothing. The district court entered judgment for National Credit Systems on Livesay's claims under the Fair Credit Reporting Act and the Fair Debt Collection Practices Act. The appeal asks whether Livesay produced enough evidence that the company's investigation was unreasonable, whether she abandoned a claim based on a settlement letter, and whether a federal court that found no concrete injury should have sent that claim back to state court. Wright v. United Services Automobile Association — 1st Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The First Circuit considers whether Massachusetts's filed-rate doctrine bars a class action under Chapter 93A, the state's consumer-protection law. The doctrine generally prevents courts from replacing rates filed with a regulator. The plaintiffs allege that the defendant insurers use military pay grade to assign customers to two subsidiaries, which they say amounts to prohibited income and occupation discrimination. The insurers say those assignments create the risk pools behind the approved rates, so classification and rates cannot be separated. The case reaches this court before final judgment after the district court denied dismissal and certified the question for immediate appeal. Wright v. Crider v. Collins — Fed. Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The Federal Circuit considers Raymond Crider's claim for a total disability rating based on individual unemployability, or TDIU, before March 5, 2021. TDIU pays at the total-disability rate when service-connected conditions prevent substantially gainful work. The Board of Veterans' Appeals denied the claim, and the Veterans Court affirmed. Crider says the Board listed tasks he could perform but failed to decide whether those abilities could support more than marginal work outside a protected setting. The Secretary says Crider is disputing factual findings that the Federal Circuit lacks power to review. Crider v. Ogunleye v. Banks — 2d Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The Second Circuit reviews whether a New York City public school could carry out a student's individualized education program, or IEP. The plan called for thirty-five class periods and nineteen hours of sixty-minute therapy and other related-service sessions each week. An impartial hearing officer, or IHO, said the schedule was impossible; a state review officer, or SRO, reversed, and the district court agreed. The parent says not every service can fit. The city says most can occur “push-in”—inside the classroom during instruction. A separate class-size issue invokes Cruz v. Banks, which requires the Committee on Special Education, or CSE, to choose the regulatory option best suited to the student. Ogunleye v. Ana Maria Melgar Vasquez v. Todd W. Blanche — 7th Cir. (Sep 10, 2026) Sep 11, 2026
    Show notes

The Seventh Circuit reviews Ana Maria Melgar Vasquez's petition for review of a Board of Immigration Appeals decision. When persecution comes from a private person, an asylum applicant must show that the home government was unable or unwilling to control the persecutor. The dispute centers on that rule, her failure to report the abuse to police, and her claim that reporting would have been futile. The judges also discuss particular social group, a protected ground, and nexus, the required link between the persecution and that ground. Ana Maria Melgar Vasquez v. Todd W. The First Circuit considers when a demand under Massachusetts Chapter 93A can be sent to an excess insurer. Chapter 93A requires a written demand at least thirty days before suit. Chapter 260 gives these claims a four-year limitations period. Chapter 176D treats an insurer's failure to make a prompt, fair settlement when liability is reasonably clear as an unfair practice. The appeal asks whether Robles's demand was effective before the primary insurer tendered its limits and when her claim accrued. Evelyn Villegas Robles v.
