College Players Finally Get Paid Maybe - Thanks to Ed O’Bannon and Gavin Newsom– Ep 99 Oct 23, 2019

Today the guys are discussing the recent bill signed by Gavin Newsom that allows college athletes to start making money from sponsorship opportunities. They break down the pro’s and con’s of this move and discuss the insane amount of revenue that Universities make from NCAA sports and how well paid their coaches are. Also, Matt and Tony dive into some of the history of college athletes getting treated poorly and how video game giant EA Sports was using student athletes in it's games without compensation.

Legally Insane - Can Trump Hide His Tax Returns - Episode 98 Oct 08, 2019

In this episode Matt and Tony get into the latest Trump legal fiasco. An NY Judge ruled that he cannot use the DOJ guideline to hide his tax returns. In a quite blistering ruling, the Judge basically called it an outrage to justice. It will be in front of the 2nd circuit soon. It made the guys decide to a deep dive into the IRS website to find out what other frivolous arguments people are using to get out of paying their taxes. Nobody did it better than the legendary Wesley Snipes, well except for the fact that he got 3 years. They also award the Legally-In-Shame of the week to Dominos Pizza who denied a blind man access to their website. The Supreme court ruled they had to make it ADA compliant so he too could get wasted and share in the grossness.

It Begins - The Impeachment Inquiry of Donald Trump – Ep 97 Sep 27, 2019

On today’s show the guys are talking about the recent move by Nancy Pelosi to move forward with the impeachment of Donald Trump, because of his involvement with the Ukraine. The House of Representatives are in charge of setting up the impeachment, but the Senate holds the trial. Today, Matt and Tony break down why the Senate might pump the breaks if this impeachment goes to trial. They also discuss the history of Andrew Johnson’s impeachment and Hunter Biden’s shady behavior.

Employer Liability- French Man's Affair Considered Within The Scope of Employment – Ep 96 Sep 19, 2019

When is an employer held liable for an employee’s actions? It depends on the scope of work, or employment. The legal scope of employment is the range of activities that an employee is reasonably expected to do as part of his or her job. Within this range of activities, the employer may be held liable for the employee's actions when a third party is injured by the employee's conduct. Today Matt and Tony examine a recent French case involving scope of employment as well as several other funny US cases.

Climate Laws - Do We Have Fundamental Right to Breathe Clean Air – Ep 95 Sep 13, 2019

Climate change is an on-going debate in this country. Recently a group of teens filed a lawsuit against the US government - Juliana vs. The US. These teens are saying that they have a right to a stable climate and that the trump administration is destroying the environment. This lawsuit caused the guys to dig into the history of climate laws in the US. In this episode they discuss the environmental regulations Trump has removed, the air quality in LA and NYC in the 1970’s, nuclear energy and more.

Author, Activist and 2020 Democratic candidate Marianne Williamson is the topic of discussion today. She’s the founder of Project Angel Food and the co-founder of the Peace Alliance. While she’s certainly done a lot of good in the world, she’s a bit of an oddball. That’s what Matt and Tony are going to be diving into today. Specifically the metaphysical bookstore she ran in the early 80’s, her “Orwellian” stance on vaccines and how “nothing occurs outside our minds”.

Hedge Fund Manager, Jeffrey Epstein has been arrested for allegedly sex trafficking minors. This is on the heels of him pleading guilty to soliciting prostitution involving a minor in 2008. The Curious Michelle Carter Case - Can Texting Your Boyfriend Be Manslaughter? - Ep 90 Jul 18, 2019

I Love You, Now Die: The Commonwealth vs. Michelle Carter is a documentary about the death of Conrad Roy. Conrad and Michelle had fallen in love and shared thousands of text messages over the span of two years, but only met in real life about five times. On July 13th, 2014 Conrad was found dead in his car. When investigators discovered the text messages between these two lovers, it was uncovered that Carter had encouraged Roy to kill himself. Carter has since been arrested for involuntary manslaughter.

Matt and Tony both watched the documentary and in today’s episode give their opinions about the case, the deranged Michelle Carter and uncover the legal controversy of text messages within lawsuits.

The Curious Case of Eddie Gallagher's Court Martial - Did Trump Interfere in A Murder Case – Ep 89 Jul 11, 2019

Navy SEAL Eddie Gallagher was found not guilty of murder in his recent war crimes case. The case was centered on him killing an ISIS militant who lay helpless, already wounded and being treated by a medic. The case was spoiled when the medic who was already granted immunity from the Military claimed he killed the ISIS militant. The 2020 Democratic debate has come and gone, but the interaction between Kamala Harris and Joe Biden is still in the news. Kamala Harris accused Joe Biden of supporting segregationist senators and opposing bussing. Desegregation Bussing is the practice of transporting students to schools in different neighborhoods in an effort to address racial segregation. Biden has since denied opposing bussing overall. In today’s episode Matt and Tony are going to be discussing the recent situation with immigrants being detained at the boarder. Children are being separated from their families and are being kept without things like toothpaste, soap and blankets to sleep with. There’s currently an estimated 52,000 people being detained at the boarder and there’s really no clear-cut solution on what to do with these people and how to provide with them adequate human necessities and living conditions.

The Central Park Five - Was Trump The Cause of Their Jailing – Ep 85 Jun 13, 2019

The Central Park jogger case was a criminal case based on the assault and rape of Trisha Meili, a white woman who was jogging in the park the night of April 19th, 1989. Four African American teenagers and one Hispanic teenager that were in the park that night were accused of the crime. The prosecution based their case on the alleged coerced testimony of the teenage boys. The 5 boys were convicted and received sentences ranging from 5-15 years. During the trial Donald Trump wrote and article calling for the death penalty, for criminals who commit these types of crimes. Today Matt and Tony are going to be breaking down the case and analyzing Trump’s influence on the effect of the outcome of the case.

Red Flag Laws - Maybe We Can Do Something About Gun Violence – Ep 84 Jun 07, 2019

Today the guys are re-touching on Gun Control. While it might not seem like anything is being done to protect people from irresponsible gun users, there have actually been several policies put in place in the last couple years, by State Governments. Facebook Trying to Avoid Liability - Are they Publisher or a Platform Under the Law - Episode 80 May 11, 2019

Tony and Matt are back from touring and coming in hot. This week they explore whether Facebook, twitter and the various other social media juggernauts are controlling our flow of information without taking any responsibility or liability for it. We go all the way back to the beginning of the internet and discuss the old Prodigy case, remember them. The courts agreed that even though they were a platform they could take down obscene content to protect from the late 90s rash of pedofiles sneaking into chat rooms! Congress passed Section 230 of the Communications Decency act to allow for this type of oversight but it seems Zuckerberg, Dorsey and co. have decided to overreach and ban anyone who disagrees with them. For once Tony and Matt find themselves in agreement with Donnie Jr. and co who feel that Facebook is trying to have it both ways. If you're a platform, you generally must remain content neutral. If you're a publisher, you can take ownership over who gets to speak on your site, but you open yourself up to all kinds of liability that Congress shielded platforms from. Facebook is trying to have it both ways but it seems like the public and Congress is fed up. We're eager to see how this plays out in the courts and in the legislature. Mayor Pete Buttigieg’s Bid For The White House – Ep 75 Mar 25, 2019

Today’s episode is about the Calexit movement. Calexit is the term used to describe breaking California up into different sections based on geography. While not a new movement, the idea of isolation has gotten stronger because of Trumps presidency. Some people supporting the movement want California to become it’s own country, while others want to split it in half or even thirds. While CA does have the 5th largest economy in the world and a liberal free spirited attitude, splitting off from the US or getting chopped up into different states is not that simple. They discuss their origin and how they were originally targeted at minorities, to keep them from voting. The Takeaway – It’s clear that a lot of new voter ID laws are intended to suppress minority votes. The flipside is we need to get ID’s for everybody. This would help with getting rid of voter fraud.

[10:30] – Allegedly, Kavanaugh and Blasey were at a party in high school. Kavanaugh and a friend of his took Blasey into a room. The three began romping around on the bed. Kavanaugh put his hand over Blasey’s mouth as if he was going to do something terrible to her.

[15:04] – The amount of time that has passed since this alleged assault is not working in the Dem’s favor.

MGM Suing Victims of Mass Shooting - Episode 48

The MGM Casino is suing the victims of the Las Vegas Mass Shooting that happening during the Route 91 Harvest Music Festival. This lawsuit is being filed under the provisions of “The Safety Act”. As of July 2018 the MGM has sued over 1900 victims/families of victims of the mass shooting. Essentially the MGM knows it’s going to be sued by these victims for their suffering, so they’re counter suing to get a judge to rule that they have no liability for the shooter. Matt and Tony jump into this topic with the upmost disgust for this loophole.

Highlights:

[06:00] – The MGM offered to make a $500 charitable donation in the name of each person who accepts legal notice of the lawsuit and does not try and sue the MGM.
[09:10] – After 911 the Federal Gov’t set up a law called “The Safety Act” The Safety Act protects parties for claims resulting from acts of terrorism.
[11:40] – The CSC Corporation was hired by the MGM to perform security for the music festival. The MGM is using this to say they went to great lengths to ensure concertgoers safety.
[18:08] – Authorities found ammonium nitrate and 1600 rounds of ammunition in the killer Stephen Paddocks car.

The Takeaway – We’re in an insane gun culture we need to come together on a reasonable comprise.

[09:55] – John McCain was the son and grandson of military royalty. His father and grandfather were both 4 star generals in the Navy.
[10:35] – He didn’t take life seriously in his youth and during his time in the Navy he crashed two planes. He was considered a terrible pilot.
[12:00] – McCain may have been responsible for The USS Forresstal Fire in 1967.
[18:01 – Also in 1967 McCain’s plane was shot down over Hanoi. He was stabbed in the groin and the leg and was captured by the Vietnamese. He spent 5 years as a Prisoner of War and was beaten and starved regularly.
[21:22] – The camp that McCain was held prisoner in was called deemed “The Hanoi Hilton”.
[23:28] – The Vietnamese offered to let him ago but he refused. To honor his word to the military he refused to leave because there were other US Soldiers who were captured before him that didn’t have the opportunity to be free.
[32:33] – McCain was part of The Keating Five.
[37:35] – He talked George Bush out of enhancing interrogation and torture techniques during the Iraq War.

Today Matt and Tony jump into a hot topic that’s been circulating in the news recently; the printing of 3D guns. The 3D gun known as the “Liberator” was created by radical Cody Wilson. Cody Wilson is a self proclaimed “Crypto Anarchist” and the founder of Defense Distributed. In 2013 Cody posted the blueprints to make these digital weapons. Within days of posting, the US Department of State demanded they be removed from the Internet. Just this past week, the ban on releasing the blueprints to build these guns was overturned.

Highlights:

[05:34] – The files to build the 3D gun were originally released on the website Defense Distributed. The file is only of use if you have a 3D printer.
[07:50] – The Undetectable Fire Arms Act of 1988 banned any firearm that is not detectable from a walk-through metal detector. Glock’s in the mid 80s were made from a lightweight polymer. You could bend them into different shapes, making them undetectable.
[14:55] – Cody Wilson was listed as the 14th most dangerous person in the world.
[15:40] – The 3D gun the “Liberator” is named after The Liberator guns in World War 2 that were known as single shooter guns.
[20:04] – 10,000 people have downloaded the blueprints to make this gun.

Apparently, two Congressman named Smoot and Hawley had the idea to take a thriving economy with low unemployment and start applying tariff's. The problem is like Pringles, once you pop you can't stop. Every business wanted a piece of the action and in a matter of time there were 20,000 goods with tariffs, which started a global trade war that took decades to climb out of. Are we on the same path now? Only time will tell. We do know that Smoot and Hawley did NOT get re-elected. We also address why in the heck Trump has this unilateral power. It turns out there was a big trial where many of the players careers were on the line. Craziness ensued: Player confessions were literally stolen from the courtroom. Hard to say when you have a jury so biased that they "carried players on their shoulders in celebration" after the verdict was announced! [07:40] – In 1970 Nixon signed into law the “Bank Secrecy Act” which was used to protect against money laundering. It required financial institutions to keep records of cash in any amount over $10,000.
[10:10] – There are 3 steps to money laundering. The first step is putting the cash into the financial system. The second is camouflaging that money and the third stage is acquiring wealth by selling the asset.
[18:53] – Casino players buy chips without any paper work and then launder the money as casino winnings.
[20:30] – The Panama Papers was a massive document leak that exposed tax evasion on a global scale.
[25:50] – A junket is an agent who will give you casino chips for your cash, for a 20% fee.
[30:00] – A smurf avoids the government by breaking up a transaction involving a large amount of cash into smaller transactions below the reporting threshold.

The Takeaway – The penalty for money laundering is often just a fee, which is significantly smaller then the amount of money laundered. The US seems to turn a blind eye to money laundering laws.

Trumps in the news again. Matt pulls up a story about Tumps effort to pardon the boxer, Jack Johnson. Championship Boxer, Jack Johnson was prosecuted under the Mann Act in 1912. The Mann Act was created to further regulate interstate and foreign commerce by prohibiting the transportation therein for immoral purposes of women and girls. Will Trump Pardon, Johnson?

Highlights:

[06:56] – The Mann Acts original intent was to address prostitution. But eventually became focused on many broad behaviors considered “immoral”.
[08:52] – Paranoia and American White Girls being forced into slavery.
[11:52] – Boxer, Jack Johnson was prosecuted and convicted for transporting women across state lines for “immoral purposes” as a result of his relationship with a female white women, Betty Shriver.
[15:56] – Jack Johnson fled the country fighting in different parts of the world before surrendering to US officials at the Tijuana boarder.
[21:58] – In 1986 they changed the part of the law that read “for immoral purposes” to “any sexual activity for which any person can be charged with a criminal offense”.

The Takeaway: The Mann Act is a stupid law, which has recently been tightened up. But, back in the day it was used for just about everything between a man and a women.

Today’s agenda is RICO; The Racketeer Influenced and Corrupt Organizations Act. Enacted by President Nixon, the Rico Act has been responsible for bringing down and trying to bring down The Hells Angeles, The Catholic Church, The Key West PD, Donald Trump and many more.

Highlights:

[04:05] – Rico (The Racketeer Influenced and Corrupt Organizations Act) was passed in 1970 to pursue the mafia. The idea was to tie all their crimes together in one case.
[08:44] – The Rico Act was used to go after the Hells Angels for their various crimes. This culminated with prosecutors giving immunity to certain members, for ratting on their own gang mates.
[13:48] – Robert Muller, the district attorney at the time, ended up dropping the Hells Angeles case.
[15:26] – The government has tried to take down the Catholic Church for Pedophilia, under the Rico Act.
[18:08] – In the 1980’s The Key West Police Department was deemed a Criminal Enterprise and was running a cocaine racket.
[24:42] –Trump was sued under RICO for not delivering on his Trump University Promise.

The Takeaway:

The RICO Act focuses specifically on racketeering, and it allows the leaders of a syndicate to be tried for the crimes which they ordered others to do or assisted them in doing, closing a perceived loophole that allowed a person who instructed someone else to, for example, murder, to be exempt from the trial because they did not actually commit the crime personally.

[03:58] – Last week, Kentucky residents voted and shut down a bill that was aimed protecting 16 year olds from getting married.
[09:20] – Over 200,000 children under the age of 18 were married in the last 18 years.
[10:42] – The legal Federal age for marriage is 18 but most states allow 16 or 17 year olds, with parental consent.
[11:24] – Tennessee has no minimum legal age for marriage. In 2001 courts allowed 3 ten-year girls to be married.
[14:24] – Afghanistan has stricter marriage laws than a lot of US states.
[20:56] – Sherry Johnson of Florida was raped, pregnant and married by 11. She’s now fighting to end child marriage in America.
[26:08] – In New Jersey 2,000 minors have been married in the past 15 years.
[33:31] – The youngest person ever to get married was 10 years old, in Tennessee.
[35:50] – The people that wind up in these marriages are more likely to drop out of high school and live in poverty. 100% live in sadness.

Horrible Supreme Court Justices- The Four Horsemen vs FDR - Episode 22 Feb 27, 2018

Most people don’t think about the origins of certain laws. At some point in history somebody had to be first. Somebody had to screw up! In this episode we’re going to take you back to The Great Depression and discuss Franklin Delano Roosevelt’s “New Deal” and the worst Supreme Court Justice of all time.

Highlights:

[01:08] – The Great Depression started on October 29th, 1929, under President Hoover. The stock market crashed and the nations money supply diminished.
[02:33] – FDR came into office after Hoover and started “The New Deal”. This was a series of experimental programs and projects aimed at reform and relief.
[06:30] – By 1933 FDR had ended prohibition and signed a number of bills into action.
[09:50] – On August 14th 1935 FDR signed the Social Security Act, which was an insurance program designed to pay workers a continuous income after retirement at the age of 65.
[14:24] – By the late 1930’s the Supreme Court was filled with conservative judges who began striking down some of Roosevelt’s programs. So, in 1937 FDR announced a plan to add liberal justices to the court to neutralize the conservatives. This was called “The Court Packing Scheme”.
[22:33] – FDR issued an executive order confiscating all gold coins and bullion.
[29:33] – The minimum wage was $12.44 a week in 1937.
[31:18] – James Clark McReynolds, one of the worst Supreme Court Justices of all time.
[45:48] – In 1941 the US recovered from the recession because of Pearl Harbor, not the new deal.

Speaking of which, Matt enjoys spending so much time with Tony that sometimes he wishes there was 2 of him. Let’s clone Tony!

Highlights:

[03:32] – 1952 scientists demonstrated they could remove the nucleus from a Frogs egg, replace it with the nucleus of an embryonic frog cell and get the egg to develop into a tadpole.
[05:55] – In 1986 a sheep was cloned by a nuclear transfer from embryonic cells.
[06:46] – In 1998 50 mice were cloned, 2000 pigs and goats and in 2001 scientists cloned a 6 celled human embryo and 5 bulls.
[09:07] – In 2002 a huge advancement happened and a company called “Clonade” out of Japan, claimed they managed to produce the first human clone. A girl named Eve. A year later they claimed to have cloned the first baby boy. None of this was ever confirmed.
[12:22] – A couple weeks ago, in early 2018 the first primates were cloned.
[14:43] – Cloning isn’t illegal under federal law
[18:33] – In 2011 a dentist named Michael Zuk bought part of John Lennon’s Molar Tooth in an auction. His goal is to clone lennon.
[25:20] – Cloning state laws: 17 states have banned cloning humans, in 33 it’s legal.
[29:33] – The American Quarter Horse Association is in the middle of a 3-year-old lawsuit, regarding cloned horses. They don’t want cloned racehorse’s competing.
[34:49] – There are 70 countries that have banned human cloning; the USA isn’t one of them.

The Takeaway – The law unsettled and lots of developments are taking place in the cloning world. The first primate was just cloned and it looks like the door is swinging open for the cloning of organs and other human anatomy for the advancement of the human species.

California Eugenics Law - Episode 20 Feb 13, 2018

Tony kicks off the show congratulating Matt on his recent marriage. The guys then start off discussing Eugenics laws. Eugenics is the study of genetics superiority. California was on the forefront of Americas Eugenics movement and supported many heinous acts.

Highlights:

[03:23] – Eugenics is the pseudo science aimed at improving the human race
[04:22] – In 1909 CA adopted these laws and began experiments
[05:10] – Leo Stanley, chief surgeon at San Quentin prison, began some horrific experiments to “rejuvenate masculinity” One of these experiments included replacing guys balls with animals balls to have his masculinity renewed
[12:50] – Carnegie family, the Rockefellers and the Harmon railroad fortune, funded the eugenics movement. Kellogg founded the race betterment foundation.
[15:03] – States began passing laws that prevented epileptic, feeble minded and people deemed imbeciles from marrying
[15:15] – 1927 Buck vs Bell
[19:05] – State fairs held “Better Baby Contests”
[21:57] – By 1933 CA was producing literature about eugenics and sterilization and began sending it to the Germans. Hitler realized California was going what he wanted to do
[23:59] – In 1934 there were Nazi Scientific Exhibits at the LA County Museum
[24:43] – In 1978 the US passed the Federal Sterilization Regulation which prohibited a lot of sterilization practices

OJ Revisited - "if" HE DID IT - Episode 19 Feb 06, 2018

Matt starts the show by talking about one of the biggest and most publicized court cases of all time, The OJ Simpson trial. They make a few jokes about the recent mini series that aired, his book, and then delve into some interesting facts about OJ, his lawyers and the jury.

[04:01] – June 12th 1994 the world watched the high speed chase across LA
[05:38] – OJ assembles a “Dream Team” of lawyers to defend him for allegedly killing his wife
[09:21] – While being held in jail during his trial he sold his NFL merchandise/trading cards and other items to pay his lawyers
[15:31] – OJ made 3 million dollars while in prison by signing his memorabilia and selling it
[16:15] – The OJ jury was sequestered for 8.5 months
[21:51] – DNA evidence was still new technology that not many understood it. Police mishandled a lot of the blood samples.
[27:27] – OJ went to Nicole’s funeral and kissed her dead body in the open casket
[33:31] – OJ did get convicted in the civil trial

DUI Laws - Breathalyzer and Other Even More Inaccurate Tests - Episode 18 Jan 30, 2018

Matt and Tony kick off the show reflecting on a recent night of drinking together. Tony tells the audience how that night he had a little too much to drink and got nabbed at a checkpoint while riding his Vespa home. The guys joke around it a little, while trying to not make light of the situation. They then Segway into DUI laws and the history surrounding them.

[03:09] – 1910 New York became the first state to adopt drunk driving laws
[04:52] – In the 1930s committees were tasked with making roads safer. The American Medical Association began studying what was causing the rise in accidents. They set the original BAC (Blood Alcohol Content) at .15. They had to draw actual blood to get the reading
[11:12] – In 1938 Dr. Rolla Harger created the first blood alcoholmeasuring device that used a breath sample. One blew into a balloon to get the reading
[18:05] – In 1975 field sobriety tests were created. This was a set of tests administered on the road. Things like standing on one leg, following a pen with your eyes, etc…
[21:54] – In 1967 Ohio began to issue special license plates for DUI offenders
[29:54] – Myths on how to beat the breathalyzer
[36:31] – In 2016 over 10,000 people died in drunk driving accidents
[38:16] – 1.8 million drivers were arrested in 2015 for DUI

Fake Service Dog Scam and the ADA - Episode 17 Jan 23, 2018

Matt and Tony start the show discussing something they have a mutual appreciation for, animals. They begin riffing on service animals and how now a day’s people take them EVERYWHERE, especially in Los Angeles. They delve into some of the rules and regulations of service animals and the different types of service animals. They joke about the lengths people have gone to, to validate their “service” animal.

[3:21] – What makes a dog a service dog and what venues are service dogs allowed in?
[04:26] – The history of the first “assistance” dog began in 1929 with the establishment of the first guide dog school called “Seeing Eye” This was for the blind
[06:15] – It wasn’t until the 1970s that people began getting service dogs for other disabilities. Bonnie Bergan started the push for this and created Canine companions for independence.
[06:50] – The ADA (Americans with Disabilities Act) defines a service animal as any guide dog, signal dog or other dog that is trained to provide assistance to someone who is disabled
[08:24] – Emotional support dogs are different from service dogs. They’re just meant to provide emotional comfort. In order to get one you need a letter from a mental health professional
[14:09] – According to the Air Carrier Access Act, emotional support animals can fly with you
[15:36] – You can have other animals for emotional support, but only dogs can be service animals
[21:20] – Dolphin Therapy Research Centers for kids with Autism

They reference the infamous lawsuit against McDonalds where Stella Liebeck sued McDonalds for spilling a McDonalds coffee in her lap, which severely burned her. The media called it a frivolous lawsuit. The guys delve into the particulars of this lawsuit and breakdown how Product Liability Lawsuits work. Jokes are told and laughs are had as the guys bring up examples of some similar and hilarious lawsuits from throughout history.

Product Liability refers to a manufacturer or seller being held liable for placing a defective product into the hands of a consumer. Responsibility for a product defect that causes injury lies with all sellers of the product who are in the distribution chain.

Stella Liebeck had 3rd degree burns on 6% of her body from spilling the #mcdonalds coffee
The coffee Stella was served was 180 degrees, which is ridiculously hot
Stellas hospital bills were $10,000. She wrote a letter to McDonalds asking them to pay for her bills, the paid her $800. It was then that she sued.
They ended up settling out of court and Stella was awarded $640,000.
