Today we take a look at a case in which a man is walking with his wife and tiny child in one of the most expensive and exclusive urban neighborhoods in America—Beverly Hills—when he’s suddenly set upon by a crazed homeless person with a knife, and gets stabbed.

Fortunately for the father and his family, he too brought a knife, and he ended up winning that physical fight—and rather permanently. He also seems to have made solid self-defense decisions, and under circumstances, that will make him hard to convict and thus an unattractive target for prosecution, and so he’s well-positioned to win the legal fight, as well.

So, let’s dive into the facts and video of this crazy event, and see what practical lessons we can draw to make ourselves both hard to kill and hard to convict.

A Florida man is helpfully teaching his girlfriend how to handle firearms when—OOPS!—the AR-style rifle he’s handling fires a round through her head, with predictably fatal results.

No one investigating this shooting believes the shooting was intentional, and the man appears genuinely remorseful about his girlfriend’s death, which he describes as the result of an “accidental discharge.”

Might Alec Baldwin Be Re-Tried? Yes! SHOULD he be? YES!! Sep 19, 2024

Halyna Hutchins on the movie set of “Rust” was dismissed with prejudice by trial Judge Mary Marlowe Sommer. The “prejudice” part of that means that the prosecution is prohibited from re-trying Baldwin on these manslaughter charges.
Last week special prosecutor Kari Morrissey filed a motion to reconsider this dismissal with prejudice with Judge Sommer—and that’s what we’ll be taking a look at in today’s show.
The basis for the dismissal with prejudice was a purported Brady violation by the prosecution. Brady is a US Supreme Court case that requires the prosecution to turn over exculpatory evidence to the defense.
My immediate objection to this particular dismissal with prejudice on the basis of this purported Brady violation premised on this “Thell Reed” ammo was that the particular source of the live round is immaterial to the manslaughter charge against Baldwin.
In other words, where the Baldwin live round came from—whether from Gutierrez’ father Thell Reed or from props supplier Seth Kenney or from a local Walmart was entirely irrelevant to the theory of Baldwin’s criminal liability for manslaughter.
With that context, let’s dive into today’s show.

Did Deputy “Execute” Airman Roger Fortson, or Is That Defamation Sep 18, 2024

Intentionally and falsely characterizing someone of having committed a crime is generally defamation per se, meaning that the person wrongfully accused is presumptively entitled to monetary damages. Even worse, when this kind of unmerited and gratuitous reputation destruction is done for reasons of personal profit—a few more YouTube bucks, for example--it would seem particularly contemptible behavior.
Today we explore the question of whether explicitly labeling former Deputy Eddie Duran’s shooting of Airman Roger Fortson as having “executed Fortson for exercising his Constitutional rights” might qualify as precisely this kind of defamation per se.
This question is, of course, prompted by the repeated publication of Attorney William Kirk, on his YouTube channel Washington Gun Law (WGL) of the explicit claim that Duran executed Fortson merely because he was exercising his Constitutional rights.

Fast Food Tables Turned When Robber Sticking Up Restaurant Shot By Someone At Drive-Thru Window Sep 18, 2024

Police have identified the man who was shot by a drive-thru customer while he was in the process of committing an armed robbery at a restaurant in Santa Ana on Saturday. Steve Rodriguez, 60, entered the Cozy Corner restaurant at 426 N. Harbor Boulevard at around 12:45 a.m. with a black revolver in hand, police say.
Security camera footage shows the masked robbery suspect enter the restaurant, throw a bag in the direction of one of the restaurant employees and demand money.
Police say a drive-thru customer in a silver Honda Accord was stopped in the drive-thru lane by the window while the robbery was happening.
Before Rodriguez managed to flee the restaurant, police say one of the people in the Honda shot him twice in the upper torso.

Pro-Israel Protestor Shoots Gaza Supporter Who Charges, Tackles Him: Self-Defense? Sep 17, 2024

A man with strong feelings that the military actions of Israel in Gaza amount to genocide decides to charge across a busy street and tackle a man participating with others in a pro-Israel protest—and ends up shot in the abdomen by the man he attacked.
Now the shooter, Scott Hayes, has been charged with assault and battery with a dangerous weapon and is looking at 10 years in prison.
(UPDATE: In the video I discuss that Hayes had also been charged with a civil rights violation good for 10 years in prison—that civil rights charge has been dropped since I recorded this video.)
It's being reported that Hayes has been granted bail in the amount of $5,000, with a variety of conditions including GPS monitoring, but this will at least allow him to go to work and such.
Presumably Hayes will attempt to justify his shooting as lawful self-defense. How viable is that defense, and how vulnerable is it to attack by the prosecution? That’s what we’ll be discussing today.

TYREEK HILL VIDEO: Police Demonized Over Non-Compliance, AGAIN! Sep 11, 2024

NFL wide receiver Tyreek Hill is clocked speeding by police and pulled over. Once stopped police see he’s also not wearing his seatbelt. That’s two driving infractions right there—but that’s not enough for Hill.
Hill also decides to be unlawfully non-compliant with lawful orders given by the police for purposes of safety, to the point where the police must compel compliance by dragging him from his car, detaining him, cuffing him, and sitting him down on the sidewalk.
The bad actor in all this? I’d say that’s Tyreek Hill—but of course, a large swath of the internet disagrees with me, as usual.

“Go Ahead, Make My Day” Is NOT Lawful Self-Defense Sep 09, 2024

Today we’re going to take a look at a video of a fatal shooting out of Cincinnati OH that many on the internets are characterizing as obvious self-defense, but where state prosecutors have charged as murder—and the prosecutors here are probably right, on the legal merits.
The reason this killing is likely unlawful rests on the element Innocence, one of the elements required for a valid claim of self-defense. Innocence requires that the person claiming self-defense was not the initial aggressor in the fight—obviously--and, ALSO, that they did not provoke the OTHER person into being the initial aggressor in order to have an excuse to kill them and claim it was self-defense.
And THAT’s the problem in this shooting. Let’s go take a look at the video, and discuss what makes this killing likely a crime.

Cop Shoots Family Dog in Iowa! Lawful? Like It or Not, Yes! Aug 31, 2024

A Davenport, Iowa police officer shoots dead a 2-year-old Labrador in front of the dog’s family—including the mother, young child, and a young cousin. The officer was never bit, or even so much as scratched, by the dog.
Did the officer simply EXECUTE this poor dog? Could there be ANY legal justification for this officer’s use of deadly force to kill a family pet?
The legal answer, like it or not, is that YES, this shooting of the dog was legally justified.

Police Shoot Fleeing Malachi Williams in the BACK! Lawful? YES! Aug 29, 2024

A white police officer shoots a fleeing black suspect—Malachi Williams--in the back, at a moment where the suspect presents no immediate threat to the officer.
Worse, the officer’s body worn camera footage shows no apparent indication that the suspect was armed.
Is this police shooting of a fleeing, apparently unarmed, black suspect in the back yet another example of police systemic racism and excessive force?

You Choose: Actual Lawyering Lawyer or Internet Popular Lawyer? Aug 27, 2024

Today's LIVE show is in response to the video posted on August 25 by the channel "Washington Gun Law" (Attorney William Kirk) regarding the shooting death of Roger Fortson by a Florida deputy back in May.
The deputy was responding to reports of an apparently violent domestic violence complaint when Fortson responded to the door knock with a gun in hand--at which point the deputy shot Fortson.
Kirk had previously concluded that the shooting of Fortson was an outright execution for Fortson having merely exercised his Second Amendment rights.
I critiqued Kirk's conclusion that the Fortson shooting was an outright execution on the basis that (despite claiming to be a criminal defense attorney providing legal analysis) he never made a single reference to any relevant Florida use-of-force law whatever, nor entertained any legal argument that might favor the deputy who shot Fortson.
It is frankly unimaginable to me that a criminal defense attorney can offer a legal analysis to the public on a use-of-event of high public interest and controversy without even once considering the likely defendant's legal defenses.
In my own critique I made actual use of the relevant Florida law that, combined with the facts available, provides a sound foundation for the legal conclusion that the deputy's shooting of Fortson was lawful, if awful.
The Kirk video we'll be taking a look at today is apparently in part a response to my critique.

SHOCKING New Duty-to-Retreat Law! The DISSENT! Aug 05, 2024

Last week the Minnesota Supreme Court filed its ruling in the case of State v. Blevins, a case in which the defendant pulled out a machete on a train platform and brandished it at several people.

Today we read the DISSENT of that ruling.

The defendant was charged with felony assault, and raised the legal defense of self-defense. At a bench trial the judge ruled that the defendant's conduct could not qualify as self-defense because he failed to satisfy Minnesota's generalized legal duty to retreat in the context of self-defense.

Minnesota is, indeed, one of the small minority of states (eleven) that impose a generalized legal duty to retreat before deadly force can be used in self-defense--but never before has this duty been expanded to include the mere threat of deadly force, as opposed to the actual use of deadly force.

Sonya Massey Shooting: Awful but Lawful Self-Defense Aug 01, 2024

LIVE! Sonya Massey Shooting: Legal Analysis Q&A Jul 26, 2024

On Wednesday I published the video of my legal analysis of the Sonya Massey shooting. Massey was shot and killed by Deputy Sean Grayson inside her own apartment earlier this month. Grayson has since been fired and charged with murder and other crimes.
In my legal analysis I concluded that the available evidence--in the form of the body worn camera video of Grayson and a second deputy with him at the time--made clear that the shooting of Massey, while tragic, was almost certainly lawful self-defense.
This, of course, has led to a tsunami of protesting comments, as my analysis runs counter to the consensus view of this police use-of-force event.

REAL LAWYER: A Brooklyn Pew: Lawful? Jul 08, 2024

On Saturday July 6th an event called "Freaknik Picnic" held in Brooklyn NYC's Prospect Park (nearly?) almost had a bit of fisticuffs turn into a fatal shooting--and a rather unusual shooting, at that, as it appears to have involved a derringer!
With only a very short (~7 second) video clip of the confrontation available, and little news reporting that I was able to find, it's not easy to arrive at any definitively RIGHT ANSWERS about who might have been acting lawfully--or not.
What we can do, however, is identify the RIGHT QUESTIONS as a foundation for any legal analysis of this event, and that's what we'll do in today's show.

Will Judge DISMISS the Baldwin Manslaughter Indictment? Jun 24, 2024

On October 21, 2021, actor Alec Baldwin, on the set of low-budget Western movie "Rust," pointed what he knew to be a real gun directly at cinematographer Halyna Hutchins, cocked the hammer, depressed the trigger, and fired a fatal bullet into her body.

Baldwin is now approaching trial on a charge of involuntary manslaughter.

Last week the Baldwin defense team began arguing to the court that the manslaughter indictment should be dismissed WITH PREJUDICE--so that it could never be brought again--on the grounds that the prosecution "destroyed" evidence.

The "destroyed" evidence consists of the revolver used by Baldwin to kill Hutchins, which had some small internal parts broken during function testing by the FBI.

In today's live stream we complete this argument to the court, hear the State's response, and hopefully get an immediate real-time decision by the judge.

State to Expose Baldwin's Reckless Conduct! Jun 20, 2024

New Mexico has charged actor Alec Baldwin with reckless manslaughter over his shooting dead cinematographer Halyna Hutchins on the set of the low-budget western movie "Rust."
Baldwin's immediate conduct that results in the firing of the bullet that killed Hutchins ought to be enough, on the legal merits, to support his conviction beyond any reasonable doubt--he (obviously) never checked to ensure there was no live ammo in the gun, he pointed what he knew to be a real gun directly at Halyna Hutchins, he manipulated the hammer of the gun while doing so, and he arguably manipulated the trigger at the same time. BLAM!
Prosecutors, however, want to introduce evidence of Baldwin's firearm recklessness beyond this conduct immediately proximate to the gun in his hand discharging into Hutchins. They also want to introduce evidence of Baldwin's reckless firearms conduct--and misconduct--in the days immediately proceeding the shooting.
Normally, evidence of "prior bad acts" for which the defendant is not charged is presumptively inadmissible in court--but Prosecutor Kari Morrissey is arguing that THESE prior bad acts are an exception, and in the motion we'll cover today she explains to the court exactly why.

In California Shooting a Burglar = Murder? Jun 18, 2024

A 77-year-old Oakland CA homeowner is confronted by multiple burglars in a stolen vehicle, armed with a crowbar, a fake gun, and disparity of numbers. He manages to fatally shoot one burglar, and holds another at gunpoint for police.
Result? The HOMEOWNER is arrested on charges of murder.
Can this REALLY be the use-of-force law of California?

Car thieves wave an apparently full-auto Glock with a drum magazine at the door camera of the victim's home, obviously threatening overwhelming deadly force if the victim attempts to thwart their theft of his vehicle.
Would the owner have been legally justified in simply shooting THROUGH his door at the thieves in defense of himself? In defense of his home? In defense of his vehicle?

If Only USCCA Had Done It Right: Part 1 Jun 13, 2024

The United States Concealed Carry Association (USCCA) along with its partner Delta Defense LLC purport to pay their members legal expenses if the member is involved in a use-of force event. Indeed, their sophisticated internet advertising campaigns frequently feature CEO Tim Schmidt assuring the public that "We've got your back!"

In recent years, however, USCCA has refused to meet that apparent obligation to its members. When asked about this the organization has either provided no particularly substantive reasons--e.g., "we just feel we're not obligated to do so"--or has made up an outrageously not credible explanation months after the fact--e.g., "actually that member preferred we not help them."

It is for these reasons that I'm personally unable to recommend USCCA in good faith to anybody seeking legal services coverage in a use-of-force context.

That said, there DO EXIST scenarios in which it would arguably be appropriate for ANY use-of-force legal services company to decline to provide coverage--and we'll explore one of those scenarios in the context of a recent New Mexico Supreme Court decision.

If THIS had been USCCA's explanation for its repeated failure to cover its members, they'd have had a point. Too bad for them, however, that this was NOT their explanation.

State "Destroyed" Baldwin Revolver ... Charges Dismissed? (w/ Steve Gosney!) Jun 11, 2024

The legal defense for actor Alec Baldwin, scheduled for a manslaughter trial next month over the shooting death of Halyna Hutchins on the movie set of "Rust, is once again trying to get his indictment dismissed, this time with prejudice (meaning, he could not be re-indicted).
An earlier effort to have the indictment dismissed on the premise that it "failed to allege a criminal offense" was recently swatted down by trial Judge Mary Marlowe Summer--but now the defense is taking another swing.
The FBI examination of the Baldwin revolver involved a mallet test, in which the revolver was struck with a mallet from various angles to see if the gun could be fired without the trigger being pressed (Baldwin denies having pressed the trigger, and claims the gun "just went off.") At one point the cocked hammer of the revolver was struck hard enough that the hammer-sear engagement surfaces within the revolver were broken.
The defense is now characterizing this as the prosecution having "destroyed evidence," and arguing that the indictment against Baldwin should be dismissed with prejudice as a result.
Sound argument? Or just more smoke and mirrors?

“Rust“ Armorer to Testify against Alec Baldwin? Jun 10, 2024

The prosecutors in the upcoming manslaughter trial of Alec Baldwin for the shooting death of Halyna Hutchins on the movie set of "Rust" have asked the court to order set armorer Hannah Gutierrez--herself recently convicted of manslaughter in this case--to be compelled to testify against Baldwin.
In addition, the Baldwin defense has abruptly decided to withdraw several of its planned witnesses, for reasons the prosecution suggests indicate that these defense witnesses would testified in a manner harmful to Baldwin.

OnlyFans Killer Mini-Trial: Key Testimony! | Courtney Clenney (2/5) Jun 04, 2024

In today's show we cover the Courtney Clenney Arthur hearing testimony of the lead investigator, Detective Brecino. Specifically, we cover Brecino's cross-examination by Defense Counsel Frank Prieto.

Overview:
This week we're covering "OnlyFans Killer" Courtney Clenney, who on April 3, 2022 killed her boyfriend Christian Obumseli with a knife in their Miami apartment. Obumseli suffered a single knife wound to the chest.

Clenney would tell investigators that the much larger and heavier Obumseli was a domestic abuser, and had pinned her to the wall by her throat and thrown her to the ground. She somehow managed to escape, move 10 feet away, grab a small kitchen knife, and toss it in his direction.

That knife managed to penetrate Obumseli's chest, severing carotid arteries, and quickly leading to his death from massive blood loss.

Although investigators initially perceived the event as an act of self-defense, they quickly began to suspect otherwise. Much evidence emerged that Clenney had been a violent abuser in the relationship--indeed, it seemed that she had previously stabbed Obumseli on an earlier occasion, simply because she was angry that he had stayed late to watch the overtime of a football game. There also emerged video of Clenney attacking Obumseli with her fists in an elevator.

Ultimately Clenney was charged with second degree malice murder by Florida prosecutors, and she is in jail awaiting trial on that charge today.

In late 2022 Clenney sought pre-trial release, offering to stay under house arrest with her parents in Texas. Florida prosecutors disagreed, and a motion was filed for an Arthur hearing. This is a Florida-specific hearing that is essentially a mini-trial, in which prosecutors have to prove by a strong presumption that the defendant is likely to be convicted at trial (Phase 1) as well as that the defendant is a flight risk if released (Phase 2).

The Arthur hearing was held on Tuesday, November 15, 2022, and Thursday, November 17, 2022, with key testimony primarily from the lead investigator and the medical examiner on those two days, respectively. Spoiler: On December 8, 2022, the hearing judge would ultimately deny pre-trial release. Nevertheless, the testimony of these witnesses provides us with insight into how the evidence is likely to be presented at the actual trial.

Over the next few Law of Self Defense shows I will be working our way through those two days of Arthur hearings and testimony.
