In a rare display of unanimity, ALL 9 Supreme Court Justices told the Trump administration that it MUST provide due process - notice and opportunity to be heard - to every single person it seeks to deport.

As Justice Sotomayor said in her dissenting opinion: "To the extent, the Government (the Trump administration) removes (deports) even one individual without affording him notice and a meaningful opportunity to file and pursue habeas relief, it does so in direct contravention of an edict by the United States Supreme Court."

Trump-Appointed Judge Rules Trump Administration Violated 1st Amendment by Banning AP Reporters Apr 10, 2025

Another day, another judge ruling against the Trump administration. Trump-appointed Judge Trevor McFadden found the following: "The Court simply holds that under the First Amendment, if the Government (the Trump administration) opens its doors to some journalists . . . it cannot then shut those doors to other journalists because of (their) viewpoint . . . The Constitution requires no less."

Judge REJECTS DOJ's Position In Eric Adams Case; Blasts DOJ Attorney For Unethical Conduct Apr 08, 2025

In a remarkable 78-page ruling, Judge Dale Ho, the presiding judge in the public corruption case of New York City Mayor Eric Adams, denied the DOJ's efforts to dismiss Adams' case without prejudice (temporarily) so they could hold it over Adams' head as political leverage.

Glenn does a deep dive into Judge Ho's ruling, and the implications of his findings regarding the unethical conduct of the DOJ official who made "pretextual" arguments in the case.

Trump Administration UNCONSTITUTIONALLY Deports Legal US Resident in Violation of Court Order Apr 07, 2025

As CNN reported previously, "Trump calls for the termination of the Constitution in Truth Social post." Well, it looks like Trump is putting his money where his mouth is, as he seems to be trying to terminate the due process rights to which we are all entitled under the 5th Amendment. The Trump administration has deported a young man named Kilmer Arbrego Garcia, even though he's a legal US resident and was protected by a court order issued in 2019, in which a judge prohibited his deportation to El Salvador. Indeed, Garcia had fled the country because, according to court filings, "he left El Salvador to escape gang violence after gangsters threatened to kill him in an attempt to extort money from his parents." The Trump administration said his deportation was an "administrative error." But shockingly, they are now saying they have no way to get him back! The 5th Amendment to the Constitution provides, "No person shall . . . be deprived of life, liberty, or property without due process of law". Kilmer Arbrego Garcia's rights have been blatantly violated by the Trump administration.

Two More REPUBLICAN-APPOINTED Judges Rule Against Trump's Executive Orders Punishing Law Firms Apr 03, 2025

Donald Trump seems to spend his days golfing and signing unconstitutional executive orders. Two more federal court judges have halted executive orders Trump signed to punish law firms who displeased him for one reasons or another. And one of the Republican-appointed judges, Judge Richard Leon, had some choice words for the absurd arguments that were made in court by Trump's DOJ lawyers, saying: "Have you ever practiced law? Have you had clients? Then use your common sense". Glenn reviews these two rulings and the judges who made them.

Two More Law Firms Sue the Trump Administration to Block Presidential Orders Punishing Law Firms Apr 02, 2025

And then there were three. Two more big law firms have sued the Trump administration for issuing executive orders punishing firms that Donald Trump doesn't like for one reasons or another. Paul Clement, former United States Solicitor General in the George W. Bush administration, is representing WilmerHale, one the the punished law firms. Attorney Clement wrote: " The President's sweeping attack on WilmerHale (and other firms) is unprecedented and unconstitutional." Glenn discusses these new legal developments and the implications for the rule of law if Trump is allowed to abuse his power by bullying law firms of his choice.

Appeals Court Sides with Judge Boasberg and Against the Trump Administration in Deportation Case Apr 01, 2025

The DC Federal Circuit Court of Appeals ruled that Judge James Boasberg's temporary restraining order would remain in place, rejecting arguments from Trump's DOJ lawyers to lift the ban so they could resume deporting Venezuelan immigrants without honoring their constitutional due process rights to notice and opportunity to be heard. In her written opinion, Judge Patricia Millett highlighted the human toll and tragedy that can result when human beings are deported without having their claims heard in court.

Trump's DOJ Lawyers Creep Closer to Contempt of Court Mar 31, 2025

In the ongoing litigation over whether the Trump administration violated Judge James Boasberg's order to turn around planes which were carrying Venezuelan immigrants to El Salvador - DOJ attorneys are now refusing to provide additional information about who was deported and when the planes took off and landed. Those attorneys are claiming that such information can't be disclosed under the "state secrets" doctrine. Glenn takes on the contention that the information being sought by Judge Boasberg to determine if the Trump administration violated his orders and should be held in contempt - can't safely be disclosed to the judge, who, incidentally, is also the Chief Judge of the U.S. Alien Terrorist Removal Court. Could it be that the real reason the Trump administration won't provide this basic information to the judge is because it will prove that they violated the judge's order?
