In an exercise of propaganda that would make George Orwell blush, Georgia Representative Andrew Clyde tells the American people that the January 6 insurrection never happened and that the behavior of the people in the US Capitol that day "looked like a normal tourist visit." With those absurd statements, Congressman Clyde likely has made himself a star witness at all future trials of those who breached the Capitol, damaged property and assaulted police officers. Each defendant now has a basis to subpoena Clyde and force him to testify in their defense that there was no insurrection on January 6 and that the people in the Capitol behaved just like tourists on any other day. Based on new Washington Post reporting today we've learned that "The Big Lie" was actually cooked up two years ago by a Republican political dirty trickster as a way to cast aside the will of the American voters and corruptly keep Donald Trump in power. The Republicans are insisting that all party members adhere to The Big Lie and pledge allegiance to The Big Liar or face ouster. This is yet another reason Merrick Garland's Department of Justice must move toward charging Donald Trump for his crimes. It seems like it's taking an eternity for justice to come for Trump. There are two main ways mental health issues intersect with criminal prosecutions: 1. competency to stand trial and 2. insanity defenses. Here is an overview of those two features of the criminal justice system and why a "Foxitis" defense is not a legally viable defense in a criminal prosecution. However, the fact that defendants are saying they were inspired and incited to violence by the incessant lies of Donald Trump as repeated and amplified by Fox News should give the federal government, specifically the executive branch, every reason to regulate "news" outlets that peddle fiction as fact and should give the legislative branch reason to prohibit "news" outlets from peddling fiction as fact when it incites imminent violent conduct. Judge Amy Berman Jackson issued an opinion ordering the release of a Department of Justice Office of Legal Counsel memo and related DOJ internal communications that Bill Barr claimed factored into his conclusion that Donald Trump could not be charged for the obstruction of justice offenses documented in the Mueller report. Judge Jackson's findings are scathing, criticizing the representations of Barr's DOJ in the litigation as "disingenuous" and unworthy of "credence."
