Judge Engoron Decision in Trump's NY Civil Trial Feb 19, 2024

In this episode Hawk delves into the intricacies of the 92-page order delivered by Judge Arthur Engoron in the Civil Fraud Trial brought by New York State Attorney General Letitia James against Donald Trump, his two adult sons,and the Trump Organization. The burden of proof in this case, being a civil one, is the preponderance of evidence, a lower standard than in criminal cases. Hawk then provides an overview of the seven causes of action in the case and highlights the significant motion for summary judgment granted by the judge, establishing a decade-long pattern of fraudulent behavior. The episode breaks down the defenses presented by the Trumps and their attorneys, including claims of no fraud and shifting blame to accountants. Hawk discusses the judge's comprehensive findings of fact and reveals the extent of deception, including false financial statements, persistent fraud, and deceitful practices. They basically lied to everyone about everything all of the time, including lying to one another. In the latter part of the podcast, the discussion centers around various witnesses and their testimonies in the trial. Notably, the focus is on Michael Cohen, who, despite being a convicted perjurer, was deemed credible by the court. Cohen's testimony was corroborated by other trial evidence. The judge's assessment of Cohen's credibility is highlighted, underscoring the importance of his truthful testimony despite the evident animosity between him and Donald Trump. Additionally there were inadequacies and contradictions of expert witnesses presented by the Trump defense team. 5th Circuit Court of Appeals Jan 13, 2024

Discussion includes the 5th circuit court of appeals covers Texas, Louisiana and Mississippi and the district courts within the 5th circuit, how things are structured, the responsibilities of each court and how appeals work with circuit courts.

The 5th circuit is one of the most conservative circuit courts in the country. Of the 17 active judges only 2 were appointed by democrats and 6 of them were appointed by Donald Trump. There are 9 senior judges that have a large body of experience that basically work 1/2 time and have not yet retired. The only court that is above the circuit courts is the United States Supreme Court.

Hawk specifically discusses a court within the 5th circuit containing around 20-30 counties in North Texas. Of interest is a case that is pending with the US Supreme Court Securities and Exchange Comission v. Jarkesy which came from an appellate decision that was written in the 5th circuit (link below):

This case has the potential to gut the regulation and enforcement capacities of departments and agencies within the Executive Branch of United States Government. This could create a level of havoc in the United States by rendering parts of the Executive Branch toothless. Republicans love this because they hate regulation and government.

Project 2025 is a plan to reshape the executive branch of the U.S. federal government in the event of a Republican victory in the2024 U.S. presidential election. Established in 2022, the project seeks to recruit tens of thousands of conservatives toWashington, D.C., to replace existing federal civil service workers it characterizes as the "deep state", to further the objectives of the next Republican president. Although participants in the project cannot promote a specific presidential candidate, many have close ties toDonald Trump and theTrump 2024 presidential campaign. The plan would perform a swift takeover of the entire executive branch under a maximalist version of the unitary executive theory— a theory proposing the president of the United States has absolute power over the executive branch upon inauguration.

The development of the plan is led by the Heritage Foundation, an American conservative think tank, in collaboration with some eighty partners including Turning Point USA led by Charlie Kirk; the Conservative Partnership Institute including former Trump chief of staff Mark Meadows as senior partner; the Center for Renewing America led by former Trump-appointee Office of Management and Budget director Russell Vought; and America First Legal led by former Trump senior advisor Stephen Miller.
