SC2024-0317 In Re: Amendments to Florida Rules of Appellate Procedure
This case concerns proposed changes to the Florida Rules of Appellate Procedure, as submitted to the Court in a report from The Florida Bars Appellate Court Rules Committee. In part, the proposed amendments would provide civil or criminal defendants with a right to bring an interlocutory appeal from an order denying a claim of Stand Your Ground immunity.
SC2023-0915 JJJTB, Inc. v. Stephen V. Schmidt, et al.
JJJTB seeks review of a Second District Court of Appeal decision in a foreclosure case. Other courts of appeal decisions conflict on the issue of whether certain jurisdictional issues can be waived.
SC2024-0096 Michael H. Hunt v. State of Florida
Hunt was convicted and sentenced to death in the 2019 murder of Alexandra Peck in Panama City. He raises six issues here in a direct appeal of his conviction and sentence.
SC2023-1298 Michael James Jackson v. State of Florida
Jackson was originally sentenced to death for the 2005 murders of James and Carol Sumner that began with robbery and kidnapping in their Jacksonville home. Jackson’s death sentences were later vacated. At his 2023 resentencing, Jackson was again sentenced to death for the murders. Jackson now raises 14 issues challenging his 2023 resentencing.
SC2023-0593 Christopher Allen Pryor v. State of Florida
Pryor appeals his life sentence as a violent career criminal in possession of a firearm, seeking resolution of the district court’s ruling in conflict with other appellate decisions. Also at issue is whether escape from a juvenile detention facility counts as a qualifying offense under the violent career criminal statute.
SC2023-0807 Juan Javier Oquendo v. State of Florida
Oquendo appeals his manslaughter conviction on the basis of conflicting opinions from the district courts of appeal concerning the admissibility of evidence of post-traumatic stress disorder in a self-defense claim and the related jury instructions.
SC2023-1662 Scottie D. Allen v. State of Florida & SC2024-0543 Scottie D. Allen v. Secretary, Dept. of Corrections
Allen was convicted of and sentenced to death for the 2017 first-degree murder of his cellmate at the Wakulla Correctional Institution. This Court upheld Allen’s conviction and death sentence on direct appeal. Allen then filed a postconviction motion seeking to vacate his conviction and sentence. The trial court denied that motion. Allen now appeals the trial court’s denial. Allen also petitions this Court for a writ of habeas corpus.
SC2023-1476 Mesac Damas v. State of Florida
Damas was convicted and sentenced to death for murdering his wife and five minor children in 2009. This Court affirmed Damas’s conviction and sentences in 2018. Damas moved to vacate his conviction and sentences in postconviction proceedings, raising four claims. The postconviction court denied Damas’s motion. This is his appeal.
SC2023-0988 Citizens of the State of Florida, etc. v. Florida Public Service Commission
The Office of Public Counsel (OPC) appeals the final order and the clarifying final order of the Public Service Commission (PSC) in a rate case filed by Florida City Gas, a subsidiary of Florida Power & Light Company. OPC challenges the PSC’s approval regarding reserve requirements, depreciation, and the continued acquisition adjustment.
SC2023-0320 Mark H. Wilson v. State of Florida
Wilson challenges his death sentences in the 2020 Putnam County murders of two boys, brothers of his girlfriend’s sister with whom they were living. He raises 11 issues in this appeal.
SC2023-1000 Donald Otis Williams v. State of Florida
Williams was convicted of first-degree murder in the 2010 Lake County murder of Janet Patrick. The trial court sentenced Williams to death after the jury recommended the death penalty by a 9-3 vote. In 2017, this Court affirmed Williams’s convictions but reversed his death sentence and ordered a new penalty phase. After being resentenced to death in 2023, Williams now appeals his death sentence and raises four issues
