Jon Gruden’s Leaked Emails & Washington Football Team Investigation Oct 12, 2021
    Show notes

We discuss all things Jon Gruden (1:15) following his leaked emails and swift resignation of head coach of the Las Vegas Raiders. Interestingly, these emails were uncovered during an unrelated investigation by a law firm into allegations of sexual harassment and toxic workplace surrounding the Washington Football Team. WFT Owner Dan Snyder, not Jon Gruden, was the subject of that investigation yet we didn’t see a single email about Snyder and a written report was never generated so we don’t know what quite what happened.

According to the Wall Street Journal, the NFL reviewed 650,000 emails during its investigation into the Washington Football Team's workplace culture. Either Jon Gruden had the only offensive emails within the 650,000 or - far more likely - his were the only ones ownership ALLOWED to come out.

Ask yourself why now? Was it to get out from under Jon Gruden’s albatross 10yr / $100M record contract to coach the Raiders until 2028… or did they need a fall guy to try and divert everyone’s attention from the WFT chaos. If owners wanted this kept secret, it would have been.

We analyze the emails, talk about the lawyers involvement, and revisit the allegations against the Washington Football Team which led to these emails in the first place to try and get a better understanding of why they are coming out now.

We then preview the St. Louis Rams Town Hall (29:37) and the latest on the case.

UFC, Brock Lesnar, & Dana White Lose Federal Appeal to Heavyweight Mark Hunt Oct 01, 2021
    Show notes

Dan, Mike, and Jason dissect the viral story up now on Conduct Detrimental.

Former UFC Heavyweight Mark Hunt once sued the UFC, President Dana White and one of UFC’s biggest stars Brock Lesnar, over an alleged doping scheme and fraudulent cover up. Specifically, Lesnar beat Hunt and then - afterwards - failed a drug test. Hunt alleged that if Lesnar didn’t have illegal drugs in his system that Hunt would have won the fight. The case was largely dismissed at the District Court level but in a surprising move, the Ninth Circuit overturned the dismissal on appeal. It has been revived... [Cue the Undertaker sit up GIF]

Now that the case is back, Mark Hunt is doing a victory lap on social media and EXPLICITLY singing the praises of Jason Morrin and Conduct Detrimental for breaking the news to the world. The most-read article in the young history of ConductDetrimental.com

    We break it down.

Re-Litigating the St. Louis & Rams Divorce and It’s Worth In Court Sep 29, 2021
    Show notes

You ask, we deliver. Following Parts 1 & 2 of our St. Louis Rams Relocation Lawsuit coverage, the people of St. Louis reached out and asked if we could have someone FROM St. Louis on to talk about the important history - and build up - to this lawsuit. We asked our contacts in the area for an appropriate guest for Part 3 of our coverage and one name kept popping up… so we HAD to get him.

Ben Frederickson (@Ben_Fred) is that man and he's our special guest this week. He’s the Sports Columnist at the St. Louis Post-Dispatch and has a lot of opinions on this topic having covered the Rams firsthand and lived through the City’s efforts to save the team. Ben joins the show (6:55-55:04) to explain STL’s slow and painful divorce from the NFL, why he feels the city was unlawfully misled during these interactions, and what exactly it means to be a "Professional Liar". This includes the important backstory concerning the team’s stadium lease and the city's rejected proposal to build a new stadium. In so doing, he gives us all a window into the potential mindset of a St. Louis juror who will be called on to decide the fate of the NFL from within a St. Louis courtroom.

As is clear, the wounds are clearly still fresh in St. Louis. This will certainly factor into the jury selection process and the NFL’s damages evaluation.

Trial Lawyer Jim Quinn on STL Rams & OAK Raiders Relocation Lawsuits Sep 28, 2021
    Show notes

Our special guest this week is Sports Law Attorney Jim Quinn, one of the preeminent trial lawyers in the nation. In his 40+ years of practice, Jim has an incredible sports taw background including his representation of the players’ unions in all four of the major professional North American sports leagues. This includes a long history of fighting the NFL in Collective Bargaining Agreement negotiations and, more recently, in a court of law in his representation of the City of Oakland in their lawsuit against the Raiders, the NFL, and every team owner.

Jim joins the show (9:36-42:20) to talk about how his Oakland Raiders lawsuit compares and otherwise impacts the St. Louis Rams lawsuit, the NFL’s relocation policy, expert studies on the feasibility of further expansion (48 teams!), as well as the terms and conditions of a potential settlement.

Jim is a wealth of sports law knowledge and, notably, was a pioneer in shaping modern day free agency in sports. He shares his insights in his book, “Don't Be Afraid to Win: How Free Agency Changed the Business of Pro Sports” - available now on Amazon.

Sports Tribunal: Deshaun Watson & Evander Kane; QB N’Kosi Perry Talks NIL Sep 23, 2021
    Show notes

Neither Deshaun Watson nor Evander Kane have been hit with criminal charges, yet both might not be able to play this year. For better or worse, with sports legal issues, the fear of a public relations nightmare seems to outweigh our traditional notions of justice, i.e., innocent until proven guilty goes out the window. We discuss the latest on Deshaun Watson and the NFL (1:56) and then AJ Perez of Front Office Sports joins to cover the breaking news on Evander Kane and the NHL (13:30).

A FIRST in Conduct Detrimental history. We are thrilled to be joined by our first college athlete. N’Kosi Perry, Starting QB at Florida Atlantic University. N’Kosi joins (32:30) to discuss how he signed the first ever NIL deal with an alcohol company in the history of the country alongside Jose Herrera of Islamorada Beer Company and Trent Robison of First Round Management. We cover how three of them made history, how Florida has been as the forefront of the NIL movement, and the future of college athlete compensation.

The St. Louis Rams Relocation Lawsuit Sep 20, 2021
    Show notes

The biggest case in sports law that no one is talking about. When the St. Louis Rams franchise left for the greener pastures of Los Angeles it sparked a multi-billion dollar lawsuit between the City of St. Louis, the NFL, and team owners. It’s a case involving allegations of fraud, unjust enrichment, and breach of contract — and for sports purposes, it could change the team relocation process forever.

Ben Fischer (@BenFischerSBJ) is our guest this week. He’s the NFL Staff Writer at the Sports Business Journal and has been closely covering this case. Together, we give you everything you need to know about this behemoth of a lawsuit.
